Agent: Aldon Smith wasn’t drinking at Ray McDonald’s house

Though he was named in a search warrant affidavit as having been drinking at Ray McDonald’s house, the agent for 49ers outside linebacker Aldon Smith said his client consumed no alcohol there.

The allegation in the affidavit is completely false,” agent Doug Hendrickson told Matt Maiocco of CSNBayArea.com. “He was not there drinking.”

Hendrickson said Smith was merely dropping by McDonald’s house on his way to a charity appearance.

“This is unfortunate because we’re talking about a kid who is doing everything right, working in the community and with kids,” Hendrickson said. “And his name gets lumped into this and it’s all anybody is talking about.”

Hendrickson’s passionate defense is admirable, for a man paid commission by Smith to do just that.

But the question brought up in a legal document is still pertinent, since Smith’s still on probation for a previous DUI charge, and was suspended nine games this year for substance abuse and personal conduct policy violations.

According to the affidavit, the woman accusing McDonald of sexual assault reported to police that while at McDonald’s house “…one of his friends showed up by the name of Aldon Smith. She stated that the three of them went to the store and bought some vodka and cranberry juice and started drinking again at his house and remained there until later in the night.”

The 49ers are obliged to look into it. While Smith’s probation does not preclude having a drink, it would preclude him drinking and then getting behind the wheel of a car and going some place not a house where vodka and cranberry juice was being served.

    This girl sounds like she’s money grabbing anyways and I usually try not to blame “victims.” But why would you stay and drink with a guy who you think raped you?

  7. Problem is the text transcripts already show it was a setup to try to get Ray on bs charges. His fault for putting himself in the position but she has already been proven as a liar. Aldon is an idiot too but just because a known liar said it, doesn’t make it true.

  8. According to the transcript, she passed out and woke up naked with McDonald in the bed next to her. McDonald denied anything happened. Later an investigator posing as her on her phone got him to admit something did.

  9. A lot of the people commenting on here are really nasty individuals, it’s clear Aldon needs someone on that team to step in and give him guidance and keep him out of these situations. It is obvious the guy needs help if he really was drinking and either Bowman or Willis the other linebackers on this team need to step in. Alcoholism is no joke and something people shouldn’t underrate, you grow a dependency on it just like Heroin or any other opiate. I really hope someone helps the guy just like the Jags are doing with Blackmon.

  10. If his probation requirements allow him to drink alcohol they should be changed. He would be helped by stopping drinking altogether. That would be the justice system effecting positive change which is very hard for it to do.

    Sometimes justice calls for punishment whether it changes future behavior or not other times trying to get a person to change is worth the attempt.

    Only thing the justice system cares about is if you’re drinking and driving…they don’t care if you have a drink. Alcohol is still legal in this country.
