Jameis Winston sued by sexual assault accuser

Jameis Winston recently expressed his negative feelings about the focus on off-field incidents while discussing his viability as an NFL quarterback, but it doesn’t look like that focus is going to be going away anytime soon.

Matt Baker of the Tampa Bay Times reports that Erica Kinsman has filed a lawsuit related to her allegation that Winston raped her in 2012. Winston is accused of raping her after she had a drink she believes included something other than alcohol at a bar in Tallahassee.

The lawsuit makes claims of sexual battery, assault, false imprisonment and “intentional infliction of emotional distress arising out of forcible rape.” Kinsman’s attorney John Clune released a statement about the suit.

“Today, a very brave young woman filed her lawsuit against Jameis Winston for the sexual battery that she reported to police in December 2012.,” the statement reads. “Over the past two years, this survivor of sexual violence has had to endure a delinquent police investigation, a hostile FSU athletic department, and Mr. Winston’s bullying lawyer. But the more these forces sought to silence her, the more determined she has become to step forward and hold Jameis Winston accountable for his actions. With the support of her family, she is prepared for this fight and for the counterclaims and the smear campaigns that will surely follow.”

Winston was not charged by the Tallahassee police department and was also cleared of violating the Florida State University code of conduct.

  2. two weeks before the draft? I’m not choosing side because I don’t know what happend. But I don’t think she wants it to go to trial.. she wants a settlement.

    Imagine having to base your continued employment on whether or not to draft Winston, and realizing that it may be off-the-field events that determine the outcome.

    If I’m running the Bucs, I’m trading out of the top spot or picking Mariota.

  9. I’m sure it’s a coincidence that she’s suing a couple of weeks before Jameis gets a huge contract.

    Honestly, this is probably the best resolution for her. By not charging Winston criminally, the D.A. left the door open for the young lady to sue Winston civilly. Instead of a trial with murky evidence and a likely acquittal, she will (at least) be compensated for her trauma.

  12. If these allegations are true he should have been charged with rape and the Tallahassee police department should have been taken over by the federal authorities. With this new lawsuit I don’t think the bucs will select him he may have a free fall in the draft unless he addresses these rape allegations right now and not hide behind his lawyers to clear up any uncertainty with the teams that might draft him. Whichever team drafts him will get a huge backlash from the community.

  15. You’d think they would approach Winston first to ask if they want to settle quietly out of court. I would imagine she would have tremendous leverage since he’s entering the draft and doesn’t want the bad PR. Unless she just wants to get him back publicly or Winston didn’t do it.

  18. Matt Baker once again sticks himself in the forefront on this. He has been connected to Erica Kinsman and her family way before this alleged incident.

    I’m sure he prays Jameis doesn’t go to Tampa because Baker would have to see and interact with Jameis on a weekly basis as part of his job at the Tampa Times. EK wants a check and Baker wants Jameis anywhere but Tampa. I hope he goes to Tampa and doesn’t pay her anything. Although his new team will urge a payoff to avoid a big distraction and not have to revisit all of this again in a civil court.

  22. No trial or plea deal in criminal case has no bearing on this case. She has to prove 50.00001% he raped her, which then caused X damages. Criminal is supposed to be over 90%. People really should learn the basic rules of the civilization they live in.

It should say: “after she had a drink she NOW believes included something other than alcohol at a bar” because her first story was that she’d been struck on the head and violently assaulted, until medical examiners didn’t corroborate that narrative. Then she said she was too drunk to consent, until her friends at the bar did not corroborate that narrative. Then she finally said her drink was spiked and that the police tested the wrong blood since the results showed no drugs.

  24. She should also sue the Tallahassee Police Department and the FSU Police Department and whoever else when they conspired to try to sweep it under the carpet. Nobody really knows what happened except for the accuser and the accused. The actions of the Tallahassee PD though certainly makes one wonder why they did what they did and would they have done the same were it not the QB for FSU.

    He’ll have to settle this because he probably doesn’t want the details to be made public. Remember, FSU won’t be able to whitewash this for him in a civil court.

  29. Sounds like, she doesn’t want him to get drafted. I would of waited until he got drafted thinking more money. I guess it’s double edge sword, if she waited , then he could say money grab and if you do before. He could side down draft board and not make as much. I just glad he won’t be Raven.

  32. Well, we already knew she was going to do this. Laying low for him to jump to the NFL and then pounce. It’s time for him to clear his name in court once and for all. He should consider counter suing.

  33. This could actually help the Bucs. It is a wonderful reminder about how letting your guard down can come back and bite you in the tail at any time. Even if he is innocent of these charges, he is going to have to learn to avoid situations like this moving forward as a high profile athlete.

  36. Kind of reminds me of Peyton Manning’s misadventures. . He’s lucky social media wasn’t around in 2000. . He and Tennessee athletics dept. paid his way out of 3 sexual assault charges.

  38. The Bucs would be completely derelict in their duty if they haven’t already done a Hawaii 5-0 style investigation of this case. They would not be drafting him if they weren’t already sure that this thing didn’t go down the way she says it did. Therefore, this shouldn’t affect their decision to draft him.

We’ll see how it plays out in the legal system as a civil trial. all we know for certain is that the authorities didn’t have enough to prosecute. Doesn’t mean we know for certain what went down between these two. Only means no one has proven anything. yet.

  42. Interesting that she’d wait 3 years to file a lawsuit. Problem is, if he didn’t do it and its proven, the damage is already done as this is going to be a huge issue come draft day. Again, if he didn’t do it, there’s no way he can recover monetarily from the damage done by her. Again, 3 years later? Really?

    love lives, to avoid these things.
    They need to put Women in Jail for as long as the Man’s sentence would be, if found guilty of extortion in these cases..

    I wonder what would happen, if a Judge stepped in and said, “There will be no out of Court settlements or monetary awards for the alleged Victim other than legal fees” Just Jail time (which he would deserve) if found guilty?

  53. This was filed when it was for media exposure. I would have advised waiting until now (next week, but that’s just me) too, if she were my client. However, the money he gets is slotted by position, per the CBA. Anyone could calculate what his contract would be (approx.) if they had the initiative to look.

  57. She has very little hope in a lawsuit. He was never charged and he even survived the university conduct code case. The only witnesses favor his side, including her friend who was texting with her both before and after the alleged assault. She’s changed her story multiple times, toxicology contradicts her various stories, and at last report she was even rethinking what room the supposed assault took place in. If she’s going to be that evasive and unsure on simple facts like that there isn’t going to be a judge or jury out there who will give her the benefit of the doubt.

    First of all, she reported it in Dec 2012…I imagine math is not your strong suit but that is 29 months ago. They sat on it and the whole investigation was a sham that finally concluded late 2013. So from Nov 13 till now exactly 18 months have gone by. That’s half of your claim of 3 years. It is a perfect time for her camp to file as it does damage him the most seeing as he wasn’t ever punished by the authorities. Does going to FSU kill your brain cells or something? Why all the hate for a rape victim?

    First, wayyy back During my 4 years at university, and 5years of touring with a punk band before college and nearly 5years after as well, that’s roughly 15 years and I’ve never once seen anyone turned away at the door, where about nearly 95% of all carding happens. Your Id’s get checked sure, But what they say matters very little LOL.

    And secondly, very very rarely does one actually have to pay or start paying attorney fees until after the case is settled. In civil cases and lawsuits, 99% of the time your banking that your going to win, so the fees ultimately always get worked into (or “out of” technically considering) any settlement #’s.

    Exactly!…….I just don’t get it, any and all rape claims no matter how (un) or likely, should be given upmost attention and taken very seriously With reserved judgement. Yet somehow even in 2015 we still haven’t found a way to progress past such “little and trivial” things like this.

    Yet, it seems as long as your a big time athlete, you are immune. Still…….

    When I think about this, I always happen to reason it as Colleges and Universities look at it as the money spent on huge scholarship to these guys and sweeping it under the rug Avoids them having to write that $ off as wasted investments.

  64. This is something serious but this lady has not got a verdict go her way yet and all legal analysts say that this is just a shot in the wind. I think this is all about money period. If there was something done illegal then he would be locked up already. I hope she will just try to get on with her life. I do not know who is wrong or right but law enforcement in florida say that there is not enough evidence so how does she think there will be enough evidence now. All I say is at some point this has to end. America is getting tired of this one case.

    That should be your biggest question about Kinsman then because no one ever claimed he was drinking, only she was the one saying she was at the bar taking shots (getting blacked out drunk, well until you actually did a blood test and found out that was a lie too to go with the others). She claimed he bought her the drink that was spiked (another lie since 2 tox screens taken a few hours after the incident show nothing), but even that was disputed upon scrutiny as she doesn’t know who bought her a drink. All of this is in the report.
