Has NFL given Kraft an assurance on Brady suspension?

If it’s true that the NFL and the Patriots were engaged last night in “back-channel” negotiations and given that the Patriots declared that they’ll drop the matter two days before the period for appealing the penalties imposed against them expired, the next question becomes whether owner Robert Kraft opted to declare that he won’t appeal the punishment in exchange for a promise of some sort from the league.

Which means that, unless there’s some other type of consideration (such as the potential for hosting a Super Bowl), the carrot that persuaded the Patriots to accept the stick most likely relates to the four-game suspension imposed against Patriots quarterback Tom Brady.

The arrangement would have to be subtle. Already, Greg Bedard of Sports Illustrated has reported that a high-ranking league official has denied a link between the Patriots giving up on their discipline and the league eventually giving in on Brady. That’s not a surprise; the arrangement would have to be kept secret in order to prevent the NFL Players Association from developing yet another avenue for attacking the Commissioner’s judge-jury-executioner powers.

The challenge for pulling off the quid pro quo arises from finding a way to retreat on Brady’s punishment without raising too many eyebrows. The answer to that approach possibly resides within the cell phone of Tom Brady.

Commissioner Roger Goodell could give Brady a final chance to comply with the offer that investigator/prosecutor Ted Wells previously extended to Brady, allowing Brady’s agent/lawyer Don Yee to gather the texts and/or emails from Brady’s phone and to submit them to Goodell directly. Goodell could then conclude that the investigation finally has ended and that Brady has fully cooperated with it, which would qualify him for a reduced suspension — or possibly no suspension at all.

It still wouldn’t be easy for Goodell and the league office to sell this reversal, and Brady would have to be on board with the approach. But Brady’s phone gives Goodell a potential pathway out of the maze, allowing him to explain to league employees, the other 31 teams, the media, and the fans the reason for reeling in or completely eliminating the suspension of Tom Brady.

  1. There’s no deal like an inside deal. It’s a shame one of the best teams in the league has to resort to cheating and then has to work back channels to determine it’s fate. Just stop cheating already!

    Brady cheated. Kraft retreated when he read the report all the way through. He should be suspended for the season.

  5. I’m so sick of all the media vitriol over this, I hope:

    1.) Brady is only suspended for two games, tops.
    2.) The Patriots host a future Super Bowl.
    3.) They get at least one of the draft picks back, preferably the fourth one.

    WAY too much has been said about this, a byproduct of a 24/7 media with too much time on their hands and not enough interesting other things going on.

    And I’m not even a Patriots fan.

  6. No way the suspension gets reduced. Imagine the uproar if he reduces Brady’s suspension while taking draconian measures against Ray Rice, Greg Hardy & Adrian Peterson. By the way, they are all African-Americans. Goodell doesn’t need a racism component to this. He knows that. So don’t be surprised if there is no reduction in the suspension.

    The NFLPA and Kessler have provided some cover, but now there is no place to hide. This thing is over. Kraft’s not gonna appeal and Brady’s appeal is just a cry for a reduced penalty.

    All parties are figuring out what language is most palpable to the fans and media, who will realize that Brady and Kraft have just been venting. Bottom line, it over.

    Soon enough a league source will leak the plans about a NE Super bowl and that Brady and Bill will be traded to the LA Rams next off season, the league wants star power, much like the Beckham move to LA.

  13. I think the easier explanation is that the league has evidence …. they’ve now talked to the two working stiffs the Patriot’s fired and they are getting a whole lotta venom. Some, if not all of it, the Patriots and probably the league, would sooner leave behind closed doors. I would guess Kraft saw that Roger had the 31 behind him.

    Or Goodell caved. I find that very hard to believe. Watched him kick the crap of the Steelers defence for playing too rough … even two DPOY. Watched him destroy the New Orleans team. He was less than kind to the Miami franchise. What he did to Dallas and especially the Skins for their contract activities between CBAs … unbelievable.

    And when it comes to players, he has been tough. Does anyone really think Josh Gordon deserved a year suspension. How about Dion Jordan getting a year on the Dolphins. Leveon Bell got three plus a game check.

    I think it would be out of character for Goodell to cave.

  19. the obvious path forward now, and the only “secret” deal that makes sense is for goodell to have agreed to allow an independent mediator to decide the brady appeal.

    with kraft getting brady to agree with the result of the mediation.

    if goodell decides the appeal and lessens brady’s suspension he is going to be taking hits from all sides.

    he has a massive expensive investigation done and then signs off on the results of that investigation, then… he goes back on it just a few weeks later?

    independent arbitrator with brady agreeing to live with the result and not sue is the path out of this.

    everyone takes a hit to their rep for a while but everyone lives. best result in the interest of the entire NFL.

  20. At this point the first round pick is more valuable than a 38 year old pop gunned QB who averages 6.8 yards per completion (Ranked just behind Derrick Carr, but ahead of Johnny Football!) and needed to deflate the ball to get any velocity on it.

    Although in hindsight they’d probably just draft some lineman from Rutgers with the Pick anyway.

  23. I dont think there is any way Brady walks free, ani i doubt any reduction. The discipline on the team was stiff, if you reduce the discipline on Brady, the one who caused this mess, would not look good at all.

  27. I think Roger revealed some damning evidence to Kraft that was left out of the Wells Report. The evidence was so bad (like the burned evidence from Spy-gate) that Roger chose to not damage the NFL brand by allowing it to go public. They met, and Roger laid it out in front of Kraft and said “Do you want this out there with regards to your team?” “It will leak if you challenge me on this and drag this out.” Kraft did a 180 and decided it was best to squash it and end this controversy to save his team massive embarrassment and further scrutiny of their championships. Kraft will now talk Tom down of his high horse.

The League took tiny variations in internal ball pressure so minute they cannot be detected by the human hand (thus raising the issue of how it affects anything), applied a ball pressure rule so obscure that balls had never been tested in games during nearly a century of the sport; and used it to fine a team millions and numerous draft picks based on an investigation so shoddy high school chemistry students laughed at it. And this is supposed to protect the integrity of the sport?

    Honestly, goal line cameras aren’t needed, but we’ll use a fifty cent pressure gauge to trash a billion dollar franchise? I hope the owners ride Goodell’s madness express all the way to bankruptcy.

  34. As a Pats fan, I can’t think of any other reason why Kraft would just roll over like he did. Unless Bradys suspension is eliminated, not cut to one or two games but ELIMINATED, I’ll have lost a little respect for Robert Kraft, which is saying a lot, because despite what Patriot haters think, Kraft has a done A LOT for this league, arguably more than any other owner by a long shot.

    chargers caught tampering with balls and not cooperating, $20 000 fine
    Vikings and panthers caught tampering with balls on live tv, given a warning
    jest caught tampering with revis and multiple infractions for similar offenses, $100 000 fine

    I see no way Kraft vehemently denies the accusations and says one thing (fight this), but then does nothing in the end, WITHOUT a hand-shake agreement with Goodell to reduce the 4 game ban of Brady.

    He suspended Ben 6 games (reduced to 4) after not even being charged with a crime.

    Oh yeah, he gave Ray Rice 2 games for knocking his GF out…until the tape came out and there was massive outrage.

    See how easy it is to point white/black in the other direction? Also, when 70+% of the players in the league are black, there’s a good chance 70% of the ones getting punished by the league are black.

    But, Brady doesn’t want any suspension no matter how short, because that would officially say he was a cheater. He will still appeal.

    The whole thing is that half the people polled thought he was a cheater and another poll two thirds said the number of suspended games was appropriate. If for what ever reason the suspension is lifted, you would have to naive to not believe that Kraft and Goodell talked about the Brady suspension during that meeting of theirs. Crap will hit the fan if that happens.

    “I see nothing here to give me any indication you were involved, Tom.” says Goodell “Suspension revoked, you are cleared for all 16 regular season games.”

    Tom is cleared, the Patriots made their case (and a good one at that), Goodell saves face and agreed (during the hug with Kraft) to no more witch hunts on the Patriots.

    NFL agrees to allow Beavis and Butthead to be reinstated by the Patriots.

  51. I would find it hard to believe that Robert Kraft would or could ever trust Roger Goodell again. Having said that what if a majority of league owners ask Kraft not to sue as only one person has ever done that before and of course it could be very disruptive to the league bottom line and in return give a wink and a nod and assurances to a majority vote down the line that Mr. Goodell does indeed get the axe. Yes and perhaps on the other hand a Superbowl Bid which would make the Krafts millions. I like the get rid of Roger Goodell move even better, but money talks does it not?

  52. If a deal was made behind closed doors then the other 31 owners need to know about it and I don’t think any of them will be happy about it. A backroom deal also undermines the integrity of the game, probably moreso since it means league is by default party to the cheating as well. Cutting a deal means the league endorses players and teams doing what they can to skirt the rules and cheat.

    As for Brady turning over his emails and text message; wont ever happen. One, it will implicate him and Goodell will have to impose a stiffer sentence based on the new evidence. If Brady did erase those emails and texts, be sure they are NOT gone. Nothing ever sent electronically ever goes away. Someone WILL find them.

    Can’t wait for McNally and company to sell their story to TMZ, ESPN, Extra, or whoever is the highest bidder! That is unless Kraft paid them for their silence which is something the NFL should look into.

  57. Goddess still has the problem that he cannot prove that Tom Brady at ANY time asked ANYONE to lower the PSI in the footballs to below regulation. In fact, there isn’t even any proof that Tom Brady even wanted the PSI of the game balls lower than regulation. That being said, how can Tom Brady be blamed for something that he may not have done. If there is no proof, and I have seen none, zippo, ZERO, then they need to get rid of the Brady suspension. The penalty of $1 million and loss of 2 draft picks should be punishment enough for what may (or may not) have happened.

There’s not going to be a Super Bowl in Foxboro a there is basically a single road with 2 lanes each direction in most places feeding the stadium.   64. Goodell is skating on thin ice with hot blades. If this ewent to court he knew the WR would be laughed off the stage.. That said, exposing league corruption/incompetency/etc is not good for the league’s (and hence an owner, Kraft’s) bottom line. I bet they each have dirt on eachother, but this backpedalling by both sides is straight P.R. damage control. Crippling the league is in neither’ best interest so this is the only way they can both save face and not kill their the NFL golden goose.

  67. You Saints fans are frickin hilarious! Trying to compare organized head-hunting of other players to balls that may or many not have been ever-so-slightly under-inflated, either purposefully or due to temperature-induced air contraction, is a JOKE!

  68. The Cell Phone is an excellent excuse, but, Goodell should add that he has reviewed matters with DeMaurice Smith and Paul Tagliabue (or even Judge Judy), and that it would be in the best interest of the NFL to set aside Brady’s punishment for ‘x’ reasons.

    (The reasons that could be ‘x’ are legion.)

    This has a charming symmetry to Kraft’s decision to accept the NFL penalty as being the best thing for the NFL.

    Granted, if Brady cheated it is not ‘in the best interest of the NFL’. If Brady did not cheat, however, then it was not in the best interest of the Patriots’ to accept punishment. Neither side gets what they want, but neither side has to fully swallow a bitter, bitter pill.

What you may not recall is the day this all broke after the AFCC game I posted that if proven true I wouldn’t accept anything less than Belichicks firing and Brady being traded away or suspended for a very, very long time. When they all, Kraft included came out guns ablazing I honestly thought they were being set up. I wanted All involved to fight to the death if they felt they were right. Kraft caving in like a roof too heavy with snow crushed me, a 50+ year Patriots fan. Just like him. Behind them thru all the bad years and the good. It pains me to admit this but I have never been able to enjoy any championship as I should have been able to. I wanted the respect of other teams fans and because of scandals that will never come until Bill, Tom and the Krafts are no longer associated with the team. So. I again call for Belichick to go, Brady too and I want Kraft to sell so we can start fresh and start gaining some semblance of respect again.

The Wells report states that investigators offered to allow Brady’s counsel (Yee) to screen and control the production so that it would be limited strictly to responsive materials and would not involve Wells or the NFL taking possession of Brady’s telephone or other electronic devices. In other words, Yee would have been expected to turn over only those emails and texts relating to the deflation of the footballs, not his personal affairs.

    Its not really about throwing or not throwing someone under a proverbial bus. It is about making a good decision from a football and business perspective by accepting a plea deal that causes the least amount of damage to the organization.

    If Brady is really the ultimate team player, you know the guy everyone was saying he was for accepting a “team friendly” contract that didn’t really reduce the actual amount of money he received, he should have no problem sitting out 4 games if it is what is best for the team.

    This is the best thing I heard from a Pats fan all week. I know guys say we’re haters of winning while most teams have won more. It’s all about winning without cheating. You guys either have an owner that knows everything and encourages cheating with Belichick or the most soft gullible owner that believes everyone and can’t fire them. That’s bad for a league like the NFL.

    There’s always going to be 1 or 2 really bad guys on a team (even the best ones i.e. Hernandez, Strahan, LT, Harrison, Big Ben, Lewis, and so on.) The PEDs are massive problem. Those will always be around because the testing follows the new PEDs created unless they get lifetime bans. I don’t defend any of this crap. I would never be able wrap my head around being an owner if I had enough to buy the Giants. My morals are too high. I’d fire all these guys, but you can’t because of the union. My rules would be like you fail test once = lifetime ban. There are a lot of teams that try to stay away from the bad character people.   127. Couldn’t Goodell “explain to league employees, the other 31 teams, the media, and the fans” that he is voiding the suspension because the alleged offense only warrants a small fine and suspending someone because of the air pressure of a football is absurd on its face?

  128. On top of what I just wrote, the Patriots organization put them in all of these situations. The fans should be pissed at Kraft not calling people haters. Kraft can’t fire serial cheaters and/or liars. I’m a Giants fan, and I rarely watch much of the AFC unless the NFC games on at that time are better. The only teams that won more than my team are the Packers and the Bears. Lombardi is another one from the Giants coaching tree. He did things the right way. I’m sure that there are a lot fans of AFC teams that are haters. I pay attention to the teams that the teams that are close. I just hope that the Giants win at a faster rate than these teams the right way to become the all time leader. So every year I root against the Packers and Bears when they clinch a playoff spot. I don’t care if they win with class and stay ahead, but I’d prefer that my team gets there.

    My personal belief is that the balls were deflated by McNally under the direction of Brady, just not below 12.5 PSI.
    I think that after the 16 PSI Jets game Brady told McNally to ensure the balls were what he wanted them at, 12.5
    McNally was rewarded for this with memorabilia.
    The NFL launched a hugely expensive investigation to prove “cheating” that they couldn’t prove, but did find enough circumstantial evidence to show tampering and levied an unfair punishment for the “crime” to justify the cost and placate the masses, knowing it would be fought.
    Kraft/Brady were prepared to fight it more vehemently than the NFL anticipated, so the NFL dangled a carrot so all parties could call a cease-fire.
    I think (this is all just my opinion) Kraft, Brady and Belichick have enough dirt on the NFL and other teams to destroy the league. I think all long-term coaches do. Kraft’s choice was to go nuclear, thereby destroying his investment/gravy train and that of 31 other owners, or finding a way out that isn’t fair, but keeps the league viable.
    This is just my own speculation, but it fits all of the evidence. Certainly doesn’t make it so. I’m prepared to be skewered for it, even though it’s just my opinion.

  131. It’s simple. The back channel was Kraft telling Goodell to back off this suspension or he would create a very uncomfortable job environment for the commish. Remember, Kraft is one of three individuals who have a say in Goodell’s salary. Ya gotta love good old fashioned hardball.

  132. It’s as likely that the “secret deal” is that they won’t reveal just how widespread the Pats’ cheating has been over the last 10+ years. There would be no need to reduce Brady’s suspension and it would force the exact capitulation from Kraft that we have just witnessed.

    I see no need to perpetuate fantasy scenarios for Pats-homers who have been unwilling to face the truth for far too long.

  133. Stevan Ridley’s fumbles cost him severely. Were the fumbled balls mysteriously overinflated? I guess the so called “deflators” missed those balls.
    What a farsical argument by the legions of Patriot haters trying to explain the Patriots the consistent winning over the past 15 years! Ask Peyton what pressure he likes, or ask Drew Brees.

    Maybe those haters should focus on how TALENTED and MOTIVATED Tom Brady is, or how GREAT a COACH Bill Belichick is. OR how GREAT a TEAM CHEMISTRY and OVERALL SYSTEM the PATS have. Or the other GREAT PLAYERS the PATS have brought in to CONTRIBUTE year after year!!

    Of course though, the footballs explain the winning and the 4 Super Bowls, of course!

  134. Kraft is a businessman. He can absorb the fine which will probably be cheaper than prolonging the fight with the NFL and alienating the other team owners. He is also freeing Brady to pursue the litigation since the alleged condition for easing the team’s penalty is the commitment that Kraft make sure that Brady won’t file litigation against the NFL. On the surface it seems that Kraft threw Brady under the bus. Kraft stood down to calm the waters for his team and the NFL because distraction is bad for business and like it or not he is a big part of both. He has loyalty to both. He’s caught in the middle. Sure, we Pats fan want him to embark on a long drag out fight, but it’s not our headache. If we don’t like what he did, then we should show our displeasure by not buying the tickets and watching the game. But you know we won’t do that. We have probably 2 loyalties in this fight, truth and the team. The NFL fed us through the media lies and constrained the Pats org to correct or reveal the lies. The choice is a no brainer.— Now where on 2016. Five for Pride!!

  136. You can say many things about Bob Kraft – but backing down from a fight he can win isn’t one of them. It’s more probable than not he was shown damning evidence that: 1) might implicate others (possibly BB) in this fiasco; and 2) might expose additional occurances of cheating beyond the scope of the Wells Report (the AFCCG). Patriot fans might want to slow their roll bashing Kraft’s decision to accept punishment – especially if was made to protect the Patriots from even more humiliation.
