Report: Tom Brady “testifying under oath” at appeal hearing

Despite the small army of lawyers dispatched by both sides, today’s Tom Brady appeal hearing is not happening in a courtroom.

But it still has the feel of a trial, right down to the Bible, apparently.

According to Adam Schefter of ESPN, Brady “is testifying under oath, per source.”

While that makes it sound like the previously zipped-up Brady is going to be totally honest, it’s also hard to figure out what exactly it means, or whether it matters.

(Place your right hand on the 2011 Collective Bargaining Agreement. Do you swear to Roger to tell the whole truth, …)

While we won’t be provided with a transcript of today’s hearing — that’ll have to wait until the get to an actual courtroom — the leaks in this one will be fascinating.

And they might be more profound than the amount of air that may or may not have leaked out of any footballs.

  1. This will not be over until Ted Wells testifies under oath and turns over his e-mails and texts. Which is why this may yet end up in federal court.

    Of course, as in most litigation, we will probably not find out what really happened until the attorneys on both sides also swear to “tell the truth, the whole truth, and nothing but the truth.”

  6. If Brady is willing to testify under oath, it’s because he wants it clear he is innocent. His lawyers will then ask that the NFL people also testify under oath. It looks bad when they refuse. Just my $0.02.

  7. At this point I just want the suspension to be overturned for 3 reasons:

    1) the story will go away
    2) the egg on Godells face
    3) my Steelers can spank the Pats fair and square and we won’t have to listen to these whiny ass Patriots fans anymore.

  9. Brady, more probable than not, is testifying under oath because he has ‘NO NEW INFO’ for the sharks to feed off of.
    Brady will testify, as he did on National TV, that he did not violate Rule 17.

    This, he will do, because it will allow Kessel to expedite the initial Hearing in U.S. Courts as a Judge will place a restraining order on the 4 game suspension by Goodell until this is Officially & Legally ruled on.

    Kangaroo court will soon be over.

    Actually the penalty for lying under oath is a felony. Up to 5 years in prison.

    Lying to NFL media doesn’t carry any penalty. If he truly did lie initially, and is continuing to lie under oath, he is the dumbest man alive.

  15. What’s the point? No crime has been committed. There are no charges. Would Brady face perjury charges if he was later found to have lied about something? Would it be a felony or a third degree misdemeanor? And would perjury be pursued? If not, then again I say, what’s the point?
    Goodell has always said that lying to him when he asks a direct question will greatly impact punishment, maybe mireso than the original violation. So if there is no risk of criminal charges, then this is just a ploy.
    Brady and his now unemployed cohorts did it. We all know they did it. No one is going to believe Brady more or less because of this “oath”.

    His answers should have been in reverse. That much is clear.

  30. Love hearing the phone argument. The conspiracy involves Brady and the two former employees sending each other texts. The two former employees have team issued phones, which were immediately taken and checked out. Brady has a personal phone. So follow me here, if the texts are between the three phones, why do they need Brady’s personal phone. Does his have ‘secret’ texts and phone calls that show up under ultraviolet light that don’t appear on the other two phones?

    The fact they have yet to take TMZ or any other media outlet up on a golden parachute offer to tell their story about what Brady did or didn’t do with deflating footballs speaks loud and clear.

    And you know TMZ and the media have already made them many offers that will set them up for a very very long time.

  51. Testifying under oath doesn’t mean he is telling the truth, he may be telling the truth but his credibility is in question based on his initial reactions so we will never know if he is being truthful.
    Arod, Rose and Palmeiro proved to be liars so being under oath means very lite.

    Oh we’re over it, especially since we beat ourselves and we know we have the best roster in football again. Meanwhile you guys went all in on copying our defense and now you’ve lost Wilfork, Browner, Revis and any chance you have of contending. Seeing Brady exposed as a cheat is really just icing on the cake for us.

    I for one have no problem with people using WE and US when referring to THEIR team (and it is not something I normally do).

    I’ve been a Patriots fan since the late 70s……I’ve watched/followed them through every season, even watching every game when they went 1-15. I’ve suffered through many a season. I remember back in the 80s posting a cartoon on the bulletin board at work (cut out of the Boston Herald) that showed a stumbling baseball player wearing a Red Flops uniform handing the baton off to a goofy looking football player with a Patriots uniform. I knew the team would likely suck, but still followed them. I’ve invested a lot of time and money (game tickets, gear, etc). It’s one of the reasons I come on this website and post rebuttals to Patriots bashing.

    I presume that there are fans of other teams that feel the same way, and although I don’t usually use the WE and US when referring to the Patriots, I have no problem with others doing it for their team.

What if the entire truth came out and we find that Goodell ordered Wells to keep digging until he had enough to convict Brady, even if no crime was committed? We find out that Wells paid Exponent to use science to concoct a believable scenario where the Ideal Gas Law wasn’t the only reason for the pressure loss. We find out that the leaks of erroneous information in the early days was from someone in authority in the NFL. We find out that Wells kept coming back to Goodell saying, “I can’t find a shred of evidence Roger, what do you want me to do?” and Roger answered back, “Make something up damn it! He needs to be guilty!”

    What if all that came out in court in the near future? How many Patriot haters out there would admit they were wrong and that Brady is a real class act? My best guess is that they would still insist he cheated, because admitting that he didn’t cheat is admitting that he really is that good.

    The most despicable franchise in sports is your Steelers, without a doubt.

    They are 100% to blame for the introduction of performance enhancing drugs to the NFL. Maybe even to major sports. Mr Rooney and Coach Noll looked the other way when the cheating was happening. And because of this negligence when the cheating went on, players died young from the cheating.

    Not enough bad things can happen to that franchise in my opinion. Hopefully one day they fold and those 6 tainted titles can finally be off the books.

Any one who has read the Wells report can come to the same conclusion as the rebuttal did. Wells cherry picked his evidence, and came to conclusions based on his own narrow opinions. What texts are you referring to? The deflator texts, that many of us have pointed out actually are plausible for a number of different reasons. Using “deflate” as a term related to losing weight was used before any of this junk became relevant and also used by people un-related to the Patriots. Even beyond the weight loss reference, the only the texts prove is that Brady was legitimately incensed over the NFL’s own Refs complete disregard to appropriate game day ball pressure when they inflated game balls to nearly 16 psi. So the texts just show that Brady wanted to make sure the Refs didn’t over inflate balls. Knowing that, having a nickname “the deflator” also fits into that scenario. Since Mcnally was asked by Jastremski to make sure the refs didn’t put too much air into the game balls. Since Brady is on record as stating he prefers a gameball set closer to 12.5, the minimum pressure allowed per the NFL’s rules.

    That’s all you can extrapolate from the texts between Mcnally and Jastremski. There’s no evidence anywhere that Brady ever sent a text or email to Mcnally. He did send some texts and email to Jastremski, which the NFL and the Wells report has since they were allowed to obtain those records by the Patriots. Unless you don’t fully grasp how email and texts work, since they have Jastremski’s phone and email records, they have all correspondence between Brady and Jastremski.

    The only people that believe the texts are damning are those of you who are just accepting this entire investigation at face value. You, much like Wells, can’t think of any reason beyond some trumped up conspiracy that would fit into your narrow view. The Pats have been winning with Brady and BB for 15 years, clearly they must be cheating.

Yea, that is MUCH more likely than brady calling him to make sure he knows to keep his mouth shut and to go over what to say and what not to say. You’d have to be an idiot to think all the sudden Tom is so worried about this guys feelings. And how do we know the pats used over inflated balls? apparently the NFL never checks these things. And Tom himself said he never once noticed a difference in the balls in the Colts game from start to finish. So apparently he says he cant tell the difference between 10.5 PSI or 13.5 PSI, yet the ball boys text back and forth about how crazy he is about the ball pressure, not to mention every NFL qb can tell the difference, but Tom claims he cant. Inconsistency…………….that usually means there is lying. And again, unless the ball boys are under a gag order by the patriots, why not tell ur side of the story and get paid big time by TMZ? And why put a gag order on these two guys if no wrong doing happened? it all just doesnt add up, at all.

    I appreciate the honesty and research. That does not address the fairy tale the other guy told but that’s fine. Let’s compare those sanctions to the Pats only in the Belicheat era. I, like most, conclude that $350k in fines and a 3rd round pick spread over 80 years isn’t comparable to $2million in fines, and losing two 1st round picks and a fourth over 15 a year period. I didn’t even include the petty stuff like Rodney Harrison on juice…

    Read Steve Coursons book, it is a shocking account of the cheating that was going on with that team.

    And of course there was Dr Rydze more recently.

Kraft has supported every decision by the Roger, in Krafts eyes the commish deserves 44 million/yr and all his rulings are completely fair.   123. Dear David Wells and Rodger Goodell,

    Here’s 3 glaring things WRONG in the Wells football pressure report:

    1. TEMPERATURES: The start/end temperatures used in the Wells report for the ideal gas law calculations are all wrong and favored the tampering argument, the room temp measurements used in the Wells report are completely bogus, they were measured on February 7th when no one was in the locker room, on game day there were 12 or more officials in the room, plus attendants moving air around and adding body heat. The room temperature had to be greater than ambient temperature 72-74 degrees, this is a big mistake. Haven’t you ever been to a party and it got warm inside the room because people add heat? Also, the field temperature at halftime was more like 45 degrees, not 48 degrees as used in the Wells report according to the National Weather Service, again slight mistake, favoring tampering. These mistakes just simply add up to the level of overall inaccuracy used in the Wells investigation.

    2. VAPOR PRESSURE LOSS: The fact is air is not an ideal gas, air also has water vapor in it, the water molecules in the air would take up less space in colder environments and add additional vapor pressure loss, this is pretty simple stuff on a scientific basis. Plus it was raining, thus more water vapor in the air on that day. You never even considered that air is not an ideal gas and would lose more pressure than an ideal gas in colder environments…

    3. COLTS FOOTBALLS: Most of the conclusions in the Wells report basically said, since the Patriots footballs lost more pressure than the Colts footballs, the Patriots must have tampered. Come on man, the ideal gas law calculations alone using the correct temperature changes account for a 1.2 psi drop at a minimum. No investigation was done as to why the Colts footballs didn’t lose enough pressure??? Maybe they were kept warm on the sidelines by a nearby propane heater and you didn’t figure that out or even investigate it. Plus, the Wells report clearly said wet football’s consistently measured lower than dry footballs and the Wells report never included which footballs were measured for the Colts, wet or dry?

    Guys seriously, the level of inaccuracy and lack of true science and research done in your Wells report wouldn’t pass a high school science fair, I’m not kidding. The conclusions just don’t pass the smell test, it’s like you were looking for an answer and pulled some information together to support your conclusion, without really considering if that conclusion was even possible?

    QUESTION: So here’s the real question to you? We all know real scientists always test their conclusions. If the Patriots had tampered, would not all of the pressure measurements at halftime been much lower than what you recorded? Assuming the Patriots took out just 1.0 psi and had 1.2 psi of loss due to the temperature change, plus 0.3 psi of vapor pressure loss; that means all of the measurements had to be around 10.0 psi at halftime and none were that low, come on guys it’s not that hard. Tampering is just not possible in this case unless the Patriots took out just 0.1 to 0.3 psi out of each football which is negligible, that doesn’t make any sense.

    SOLUTION: All you have to do is inflate a few well broken in NFL footballs to 12.5 psi, take out 1 psi each with a needle, then get them really wet in cold water approx 45 degrees, and drop them from 75 degrees F to 45 degrees F in a temperature chamber for 1 1/2 hours, and they all would have measured much lower than any of the measurements taken at halftime to prove the Patriots could NOT have tampered, come on its not that hard to figure out…

    Bad, bad science work in the Wells report, I grade it: D-

    Sorry there are NO text that specifically say to deflate a ball after inspection. There is a text that saying they checked a ball AFTER a game and it was at 16psi

    There is however science that proves NO balls were tampered with. From MULTIPLE agencies that have zero affiliation with the Patriots

    And ask yourself this. If this has been going on for years (like the crybabies say) then why has no one ever complained?

The biggest takeaway from the AEI report continues to be the commonsensical explanation that the footballs used by the Colts showed less of a reduction than the footballs used by the Patriots because the footballs used by the Colts were exposed to the warmer temperature of the locker room for a longer period of time, allowing for a greater degree of expansion of the air inside the bladd

    The fines and punishments handed out were under different commissioners. If Taglibue was in power at the time, you can bet the Pats would have received a slap on the wrist, like they should have, due to the insignificance of the “crime”.

    If Brady’s suspension is overturned, the Pats SHOULD receive their 1st and 4th round picks and the $1 million back from Goodell. It likely won’t happen since Kraft backed down for some reason.

    Interesting perspective. I was thinking the opposite. Brady agreed to speak under oath so that there was no confusion in anybody’s mind that what he said today, he will repeat again when he brings this to court.
    It has to go to court. Goodell abused the authority provided him in the CBA in how he handled deflategate. He undermined this authority by taking on the smallest of issues against the greatest of players, of course thinking his judgement was unassailable. Of course, he was wrong because the smallest of issues wasn’t an issue at all. It didn’t happen. So Goodell’s house of cards will now fall and it can not end here, even if he did recind both Brady’s and the Patriot’s penalties. Because if he did recind both, the NFLPA knows they have him on his self aggrandised role as dictator. But Goodell wouldn’t possibly consider a change in the CBA at this point. So they have to go to court to accomplish that.
    I also believe that Brady dislikes Goodell very much. The opposite is even more true. Never-the-less, Brady is so incensed with how Goodell attacked his integrity, that having his suspension eliminated won’t be sufficient. He doesn’t want Goodell present when the 2015 Super Bowl and MVP trophies are handed to The Patriots and Brady respectively. So Brady will go to court and sue for defamation of character. And he let that be known by speaking under oath today.
