Goodell cites destroying phone in upholding Tom Brady’s suspension

In a not-at-all unexpected end (for now) to the #DeflateGate saga, NFL commissioner Roger Goodell has upheld his four-game suspension of Patriots quarterback Tom Brady

In the league’s release on the matter, they stated that “important new information disclosed by Brady and his representatives” during his appeal hearing came into play.

“On or shortly before March 6, the day that Tom Brady met with independent investigator Ted Wells and his colleagues, Brady directed that the cell phone he had used for the prior four months be destroyed,” the league statement read. “He did so even though he was aware that the investigators had requested access to text messages and other electronic information that had been stored on that phone. ‎During the four months that the cell phone was in use, Brady had exchanged nearly 10,000 text messages, none of which can now be retrieved from that device. The destruction of the cell phone was not disclosed until June 18, almost four months after the investigators had first sought electronic information from Brady.”

As a result, Goodell did not shorten his initial punishment, which will now certainly be headed to court.

“The commissioner found that Brady’s deliberate destruction of potentially relevant evidence went beyond a mere failure to cooperate in the investigation and supported a finding that he had sought to hide evidence of his own participation in the underlying scheme to alter the footballs.”

    Thats a huge lie. Cell phone companies by law have to retain those for 2 years on a server for any police investigations or court cases. The NFL didn’t have the authority to pull it so they instead said its “non retrievable”

He had effectively converted it into a work phone in that case and every employer I’ve ever known of in internal investigations reserves the right to search work phones.

    And of course the CBA, that the union agreed to, permits the league to gather evidence in an investigation.

    At this point debates about the gas laws and pressure physics are irrelevant, a cover up is punishable completely separately from the core accusation.

The integrity of the game should be the NFL’s biggest concern and someone thinking they are above the rules and breaking them is a huge problem for the NFL.     So, yes, if my multi million dollar a year job depending on me showing an independent investigator a string of text messages and not all the data on it, like you claim, I would hand it over.

Might get stuck with the 4 games now.

    It will be interesting to hear the Brady camp’s reply. Even if it was a regular occurrence to wipe his personal phone and get a new one every few months, which is possible because it’s what people often do if they get a new iPhone from a Samsung or something like that, it still would be an issue if they had requested the text messages before hand. He could have just left it sitting in a drawer in his house intact.

    Hard to defend that one even as a Patriots fan. If he was hiding something it couldn’t have been texts to the ball boys, because they were already out there.     Do they have evidence that he specifically had it destroyed to thwart the investigators? I mean after all, he never had to hand it over.

    So it seems more likely, that cell phone he was never legally require to hand over, was naturally disposed of in the course of someone who wanted to get a new cellphone, and that the LEAGUE is once again ASSUMING that Brady’s new cellphone was ONLY bought because he was trying to thwart them.

    The NFL extended an offer in which Brady did not even have to turn over his phone. His lawyer would have been able to sort through the messages and then hand over only relevant texts. Brady may sue initially in an attempt to save his image but he will back off at the last second because the truth coming out in court will tarnish his image forever.

    There is so much word of mouth swirling about what the Pats have done, it wouldn’t surprise me what else will come out in the future. There has been those within the NFL that claim the Spygate was much worse than the NFL ‘proved’ (then destroyed). There have been complaints about game balls years back.   196. Florio is the lawyer. My understanding is that cell phone records can only be requested by a subpoena issued by a court of law so the NFL needed the phone. That is until Brady files his appeal through the court system which makes it a court case which gives the NFL access to request a subpoena for his cell phone records and the content of his texts. Therefore, Brady loses two ways by filing a case against the NFL. First, with an injunction we don’t know when the case will be decided and he could still be suspended for four games. If that decision comes a week before the playoffs then he will serve his suspension during the playoffs. Is that what he wants? Secondly, he now opens himself up for the NFL to actually see what he sent in those texts. Listen, at this point, take the penalty, come back and help your team. By dragging this out, especially when your coach has pretty much let everyone know he thinks Brady did it.     Point Five. You will continue to not make available your personal phone and direct all communications with your lawyer who will deny, deny, deny everything.

    Point Six. You will then hold a press conference with hand picked journalists and they will ask you only questions that they have submitted ahead of time and that you have approved. At no time will you ever admit you talked about football on your personal phone. This was not a court case where such records would be the subject of a subpoena. This was a private matter internal to the league. There was no subpoena power available to the league. In fact, in some instances, a court order would be necessary to get the records from the phone company. So, at the time of the request, the only way to access Brady’s phone records was through the phone itself and with Brady’s permission.

    -Next, in order to rationalize a multi-million dollar, long and drawn out investigation, they harp on Brady being “uncooperative” to validate their suspension.
    -Then, Goodell says that a decision would be reached soon, and that “we” (even though he’s supposed to be the sole arbitrator) just want to take “our” time to get this thing right.
    -Next, independent research either directly disproving Exponent’s findings, or questioning their validity due to an inability to perfectly replicate their experiments, begins to flood in, swaying public perception.
    -Then, it takes TWO MORE WEEKS since Goodell said a decision would be reached “soon”, for Goodell to uphold the suspension. How does he defend this move? By invoking Brady’s “destruction” of his phone. If what Brady did was truly “destroy” his phone (which as you can tell by the first part of my comment, I’ll doubt until more news comes out), why did it take so long to mention it?

    Seriously, why? Why didn’t the Well’s report mention this ONCE? The report went on and on about how Brady’s refusal to turn over the phone was an indication of being “uncooperative”, but it neglected to mention that he DESTROYED POTENTIAL EVIDENCE. Why?

    Why wait until now to divulge that information, unless “destroying” isn’t what really took place, and the league is just looking for a way to rationalize everything that’s transpired over the course of these many months…

  219. How many of you have read the 20 page response by Goodell? It’s available and would give both sides of the argument a better understanding of what they are arguing about.

    My take aways is that it looks like Brady should have had the NFLPA involved from the start. I think he got bad advice from his lawyer regarding his phone. Having it destroyed doesn’t look good regardless of why it was done.

    Secondly the NFL, as one would expect, brought in another “expert” to discredit anyone pointing out the obvious flaws in the Wells report regarding the gauges and support Exponent. Goodell (or his lawyers who actually drew up the document) go out of their way to point out how credible this expert is and how his conclusions that Exponent did a “first class job” prove that all the other scientists and think tanks are obviously wrong. This expert was, of course, also hired by the same people who wrote the Wells report. Shocker that they agreed with everything Exponent, also hired by the authors of the Wells report. If the league wanted credibility, they should have gone outside the Wells/Exponent group to hire a true third part to prove/disprove Exponent.

    It’s clear that the document was crafted with CYA very much in mind. I’m certain in the coming days we’ll get a rebuttal or two (or hundreds) that will point out the flaws and inconsistancies. Barring Brady completely back-peddeling, this will go to court where the procedural arguments will be made that Goodell was biased and unfit to hear the appeal in the first place.

    As much as Brady didn’t help himself with having his phone destroyed, Goodell also did not help himself by waiting 5 weeks to render a decision when he was aware the phone had been destroyed before the appeal even took place. It’s going to be fun to watch the fireworks.

    My guess is Brady tried to tell the NFL the reason he denied the requests for the cell phone was because he had gotten a new one and the old one had been destroyed so he knew it would look bad. Then he probably tried to provide an innocent reason why the phone was destroyed.

    Unfortunately it backfired if that was the strategy. Destroying potential evidence won’t be looked at in a good light no matter what the circumstances.

    Not sure why he would admit that if he already denied their request. He should have just denied again. Then he might have gotten 2 games.

    The CBA does allow for this. It’s under the part about cooperating with an investigation with includes any relevant cell phone records.     I don’t think so, because you are not usually allowed to bring in new evidence on an appeal, only to argue over what the evidence used in the original decision supports. If the original matter had been a court case, then the NFL could have subpoenaed that information from carriers, but I doubt they have subpoena power in an NFL investigation.

    Anyone going through the roof should calm down and look at this objectively. Whether he was obligated to provide it is irrelevant to what his actions indicate. If we have now heard the whole story I think the saga has to end here (indeed it should have ended long before this) but if there is still more to this story, then it will and ought to proceed to court.     Wells report didn’t mention phone destruction because he didn’t know. He asked for the phone and was told “no”. He asked for a transcript and was told “no”.

    No one at the nfl was told of the destruction until the appeal.

    Why can’t Brady destroy his own phone? There is a difference between throwing a phone against a brick wall so it won’t work, and permanently and completely wiping all data.

    Will the phone destruction play badly in the lawsuit? It may not even be relevant. The first point of challenge is likely to be purely whether Goodell has the authority (and no controvening conflict of interest) to even do the appeal. Brady has to win that in court, and only then does it even matter what evidence there is or is not.

    My searches on the subject could not find ANY carrier that kept the actual text messages for more than 2 weeks. The meta data (what # you called, what time etc) is kept indefinitely but not the actual message. Some in Congress are trying to change that to further aid law enforcement.

    Anything kept on the “cloud” is done by your phone not your carrier. So if they want to know what the texts actually said, not just that they were to the equipment guy, they need the phone. It appears Brady and his lawyer knew exactly what they were doing.

FACT: Brady’s telephone records were produced at the hearing which showed the time and date of every text and phone call and the identity of Patriots personnel and anyone else involved in those texts and phone calls.     Despite numerous comments like the above, I dont know many Pats fans that expected anything different than Goodell upholding the 4 games and then Brady/NFLPA taking it to court. Reducing it to 1 or 2 games wasnt going to be enough for Brady and would have made the NFLs already weak case even weaker in the courts. So anyone with a functioning brain fully expected this ruling.

  312. This really isn’t about footballs anymore. This is about the ball boy ducking into the restroom with the footballs. It is about the Patriots firing two employees, it is about the text messages back and forth between the employees and the quarterback and the cover-up. ‘Deflator’ and weight loss? Please!

    And for those who are citing ‘FACT’, can anyone really say at this point they know for certain what all the facts are?

    Brady and his attitude deserve 4 games minimum.
