Goodell cites destroying phone in upholding Tom Brady’s suspension

AP

In a not-at-all unexpected end (for now) to the #DeflateGate saga, NFL commissioner Roger Goodell has upheld his four-game suspension of Patriots quarterback Tom Brady

In the league’s release on the matter, they stated that “important new information disclosed by Brady and his representatives” during his appeal hearing came into play.

“On or shortly before March 6, the day that Tom Brady met with independent investigator Ted Wells and his colleagues, Brady directed that the cell phone he had used for the prior four months be destroyed,” the league statement read. “He did so even though he was aware that the investigators had requested access to text messages and other electronic information that had been stored on that phone. ‎During the four months that the cell phone was in use, Brady had exchanged nearly 10,000 text messages, none of which can now be retrieved from that device. The destruction of the cell phone was not disclosed until June 18, almost four months after the investigators had first sought electronic information from Brady.”

As a result, Goodell did not shorten his initial punishment, which will now certainly be headed to court.

“The commissioner found that Brady’s deliberate destruction of potentially relevant evidence went beyond a mere failure to cooperate in the investigation and supported a finding that he had sought to hide evidence of his own participation in the underlying scheme to alter the footballs.”

Let the games begin.

  1. Domestic abuse = More probable than not that someone did or did not do something with a football?

    Goodell must go!!!!!!!!!!!!!!! #freebrady

  2. This is exactly how I figured this would happen.

Like I said earlier, now when he sues them and it
gets thrown out, he can turn to his owners and say

“I tried”. This is the only way Goodell could have saved
    face.

    Brady Wins.

    Again.

  3. excellent….. discipline gets upheld… now get ready for court because Brady will try his best to wiggle out of his punishment

    asterisk….

  4. Just need to get one comment on here before ignoring everything Pats fans post.

Couldn’t happen to a classier organization. Have fun with your defamation lawsuit. If it took this long to uphold the suspension, the NFL knows a lot more than you people are speculating and whining about.

Have fun vs. Greg Hardy when you return, Nancy.

  5. I guess they didn’t care that there was no air missing. LOL

I guess this is what happens when you dominate your opponents for too long.

Pats dominate our thoughts…and our teams…

  6. I wouldn’t give my cell phone to that clown Ted Wells either. If I was Brady I would have Gronk spike the phone right in front of Teddy.

  7. Destroying the phone the NFL requested for an investigation is quite incriminating. Due to that, I don’t see how taking it to court will help Brady.

  8. Awesome decision. Otherwise anybody else that was penalized in the past would have been up in arms. Now let the little baby sue.

  9. Funny, Hillary destroyed the emails and the server, and that was over classified National security issues. This is about 0.5 psi in a football.

    Clown show is right.

Goodell, Wells, Irsay, and Bisciotti better destroy their phones next, because those devices will soon be in the hands of a federal judge.

  10. Another guilty Patriot comes to mind when it comes to destroying evidence. Starts with an A and ends with aron Hernandez

  11. Destroyed his cell phone yet we will still hear from Brady apologists. Time for Goodell to take away the last Super Bowl.

  12. Or…he realized that the phone was his personal property containing his personal information and did not have to submit it to anyone outside of official enforcement and judicial systems.

Anyone have an employer that can/will demand your personal property as part of their investigation?

Would you hand over ALL your personal data on the phone?

  13. Yes !!!!
A win for the NFL owners and management.

The tail does NOT wag the dog, no matter how much ESPN/PFT/NFLPA demand that it does.

  14. So Greg Hardy and Tom Brady each got the same punishment. One deflated a ball and the other assaulted a women…. Way to go Goodell.

That week 5 matchup between NE and Dallas should be interesting….

  15. Something is fishy here. If Brady was going to destroy his phone why would he “direct it to be destroyed” instead of just like dropping it overboard from a boat or running it over in his driveway. I want to hear both sides of this story, as I do not trust the NFL side.

  16. It’s ON: BRADY VS NFL: Goodbye Goodell, Kensil, Wells, Vincent, a couple of mil in fees, ALL of Brady’s NFLPA’s court costs, possible loss of control of disciplinary matters in the future to a new independent body. NOW lets see which owners are SANE. Want to play hardball– did you not see Brady’s grim determination in the fourth quarter of the Super Bowl? BRING IT ON TURKEY, WE’LL DESTROY YOU IN COURT!

  17. You were right, Patriots fans. Totally exonerated… LOLZ

Turns out he’s more crooked than we thought.

  18. Tom Brady is a punk for destroying his phone. Guilty people do not destroy evidence that clears them. Have fun watching your team go 0 and 4 because you can’t be honest!

  19. “B-b-b-but no way Brady is dumb enough to destroy a cell phone, he’s way too smart/his lawyer would’ve told him the records still exist!” – myriad Pats fans, comment thread from 6 hours ago

  20. HAHA GUILTY!!!!!!!!

Please take it to court Tom, we want to see your “destroyed phone” and the ball boys claim he was the “deflator” due to weight loss.

    Bwhahahahahhaahhahah ****

    #tainted4ever

  21. Stop saying “see in you in court.” Brady will lose again just like he lost here. Destroying your phone is not the act of an innocent man.

  22. It’s going to court. The phone records will be exhibited in court. The truth will be told. Whatever that truth is. But, because of the FACT that Tom Brady destroyed his phone, I’m thinking this one is not going to go well for Brady.

  23. Brady got caught in a lie. Also, he destroyed his phone. For what reason? The texts are out there and not just on his phone. Brady started this by lying from the beginning. No appeal can change that. So Tom, just bite it and go on.

  24. My apologies to Stephen A. Smith.

I do not now nor have I ever had a problem with Brady not turning over his cell phone.

I do have a problem with Brady destroying/wiping his cell phone.

  25. The new evidence is too much for Brady to overcome. No judge is going to waste time hearing this lawsuit after it comes out that he destroyed his cell phone.

Take the four games and try to rebuild your legacy after that.

  26. Bradys legacy is forever tarnished.

He dug his own grave, and Belichek knew it the entire time.

The Wells report is completely irrelevant now, it was not cooperating, not cheating, that gave him the suspension.

    LOVE IT

  27. “He did so even though he was aware that the investigators had requested access to text messages and other electronic information that had been stored on that phone. ‎During the four months that the cell phone was in use, Brady had exchanged nearly 10,000 text messages, none of which can now be retrieved from that device”

Thats a huge lie. Cell phone companies by law have to retain those for 2 years on a server for any police investigations or court cases. The NFL didn’t have the authority to pull it so they instead said its “non retrievable”

    Yep they are screwed

  28. Not shocked, Tom will just beat them in court. then slap a defamation law suit on the league. Tom wins again in another comeback victory…what else is new!!!

  29. In light of this new knowledge, I don’t understand why the patriot fans on the websites I’m looking at are still feeling Tom is being targeted. Tom destroying his cellphone is akin to Aaron Hernandez hiding the murder weapon. Making it disappear doesn’t take away culpability and the very act of making it disappear lends to the likelihood of some guilt. (I realize murder and deflated balls are very different, but the analogy between the two makes sense).

  30. HE DESTROYED HIS PHONE???!!!

REALLY PATS FANS, WHAT ELSE WILL IT TAKE TO CONVINCE YOU THAT YOUR LITTLE PRINCESS IS GUILTY, GUILTY GUILTY!!!

Now I think 4 games is too few….Cheaters. Plain & simple!

  31. Because innocent cheaters always destroy their cell phones after they’ve been asked for in part of an investigation. B****Y and the New England Cheaters deserve this.

  32. if he gets an injunction and still plays, when the case is tossed out the Patriots should have to forfeit every game he played in.

  33. I guess next they will blame Irsay and Bisciotti for convincing Brady to destroy his phone.

It won’t ever be anyone’s fault in NE. Why would it?

  34. I knew all along this was going to happen. A return against the colts was planned from the start because the amount of money they can make off hyping that game was too good to pass up

  35. There’s some real thick irony in that Goodell cites the destruction of the phone, when just a mere 7 years earlier, Goodell destroyed the videotapes.

  36. I don’t know for sure, but if this goes to court, won’t the League then have power to subpoena his phone records from his provider?

  37. if Brady files suit and gets an injunction he should be forced to go on the Commissioners suspension list for conduct detrimental to the game until the court case is resolved.

  38. This is an integrity issue. Brady impeded the investigation. If you have nothing to hide hand over the phone. He is lucky he didn’t receive a life long ban. I wonder how the blatantly bias Boston press and Tom Curran is going to spin this?

  39. Say it isn’t so Tawmmy. His lawyers should explain what an “adverse inference” is in litigation.

  40. How convenient you forgot to put in the part that Brady says he does this periodically, when he gets a new celphone. Either him or his assistant do it….sucks to be the NFL, this is going to court. and brady is going to get off….

  41. “So glad Brady didn’t settle for a game. Fight this idiot in court.”

This persistent delusion of infallibility is remarkably entertaining.

Goodell didn’t just make it up, you clowns. Brady is screwed. Get on with your lives.

  42. profootball13 says:

Go ahead, tell us how destroying your phone is an act of an innocent man. There was a reason he was initially given 4 games, there is a reason he destroyed evidence and there is a reason the appeal was turned down. At some point, your going to have to face reality.

  43. Brady’s suspension should then be extended. The NFL extended Von Millers suspension from 4 to 6 games upon appeal for the same “reason” of extra steps to cover up wrong doing. He should be suspended for 8 games. He clearly did it and lied and then tried to cover it up. It’s a shame, him, Hernandez… Just a shameful organization.

  44. I’m ok if the court gives him the same punishment as Hernandez. Murder vs integrity of the greatest game on earth. Yep, works for me.

  45. So does that mean admitting guilt when you have electronic records attached to a case deliberately destroyed ?

  46. Sean Payton got a year for ‘not cooperating’ and ‘ignorance is no excuse’. Tom Brady should be thankful it wasn’t more…and Belicheck, what a joke! What a double standard…Goodell should be ashamed of himself.

  47. Why do you believe this claim? These are the same smear artists that claimed all the Patriots footballs were 2 lbs underweight, stopped measuring Colts footballs when they were coming up deflated, and didn’t even know heat changes ball pressures. 6 months of lies and you still buy them, really something.

  48. He tried to deflate his iPhone.

    So let’s recap, Patsfan:

    $1M fine
    2 draft picks
4 game suspension of the mastermind.
The lifelong scorn of every other fan of football that doesn’t support a cheater.

Let’s see if El Chapo can get the Supreme Court to listen.

    #Starting0and5
    #TaintedAndDeflated
    #NotJoeMontana

  49. Patriot fans your organization is full of cheaters.

    Your team Cheats.

Your team hasn’t won a single superbowl honestly, and most likely a single game under Billy honestly.

No other team’s fan base hates you because “we ain’t you” (Again reaaaaaaaally using that Massachusetts education there)

The reason we all hate you is because your team cheats.

This is just another example that we all knew was true since it came to light in JANUARY.

  50. Has anyone noticed that Gooddell isn’t saying that Brady deflated a single football, which is what this whole thing was supposed to be about????

  51. Tell me if this makes sense:

Fidel Goodell was aware of Brady’s “destruction of the phone” (something I doubt happened) on June 18th. Before the hearing with Brady, a hearing that lasted a whole day, and it took you 35 days to come up with the idea to maintain a ruling, a ruling based on a 51% vs. 49% argument?

  52. Wow, if only the NFL’s original libelous report about the 11 of 12 footballs being 2 pounds under were true this whole thing would have been a slam dunk.

Too bad they’ve been lying this whole time. Let’s not pay attention to the lies the Wells report proves the NFL told, they don’t matter right? Only the lies we think Brady told matter.

  53. Come you Brady lappers lets here your excuses now! Dude is a cheater and a lier and his legacy is forever tainted as it should be he is a scumbag

  54. Nothing the league has presented, leaked, or outright paid for has turned out to be credibly true so far. Why are any of you people treating this like fact?

    ‘Nuff said

  56. I guess Steven A Smith was right huh! This even makes it worse! Tom Brady is the worse QB of all time! This makes me sick!

  57. I wouldnt hand over my cell phone for people to dig over either, and I am nobody. Tom Brady? multi million dollar cultural icon? no way he should have handed over the phone for 20 dudes to leak gossip to the internet about

  58. Hahahhahahahahahaha! Look at all those high and mighty Pats fans scramble! You were so confident in the lies that you all stroked each other with that he would get off. Truth hurts doesn’t it. Brady would be an absolute fool to try this in court and you all know it!

  59. OK…wait a second.

    1) If they can retrieve stuff without the phone, what does the phone matter?

    2) If Goodell found out 6 weeks ago that Brady destroyed his phone, why did it take 6 weeks to issue a ruling?

  60. “NO WAY THIS GOES TO COURT-BRADY ISN”T THAT STUPID”

Why not? What does Brady have to lose by going to court?

All they can do is uphold the suspension. It’s not like they’re going to suspend him for additional games for taking them to court.

The only party who has anything to lose by going to court is the league. People keep talking about Brady’s phone. How do you think the NFL feels about the prospect of Brady’s defense team taking a look at Mike Kensil’s phone?

  61. If he uses that phone to communicate with the team about work related matters, then yes his employer does have an interest. He had effectively converted it into a work phone in that case and every employer I’ve ever known of in internal investigations reserves the right to search work phones.

And of course the CBA, that the union agreed to, permits the league to gather evidence in an investigation.

At this point debates about the gas laws and pressure physics are irrelevant, a cover up is punishable completely separately from the core accusation.

  62. Not sure why the appeal took so long as the appeal being denied was a no brainer with the phone being destroyed.

I can’t believe Kraft and the Pats were able to keep the fact that Tom deliberately destroyed his phone hidden for so long.

Pats and Brady look guilty as hell with this additional information.

I can’t see a court overturning it (if the “court” option wasn’t just bluster) on the “failure to cooperate with the investigation” grounds.

Looks like the Pats do deserve the “*” whether they get it or not.

If there wasn’t incriminating evidence on the phone, why destroy it?

Oh yea, good luck on that “defamation of character” lawsuit that pats fans have been trumpeting incessently. Looks like they are the ones with egg on their face.

  63. “The commissioner found that Brady’s deliberate destruction of potentially relevant evidence went beyond a mere failure to cooperate in the investigation and supported a finding that he had sought to hide evidence of his own participation in the underlying scheme to alter the footballs.”
    Truth hurts!! Lol

  64. Doesn’t Brady destroying his phone kinda tell you he had something to hide?? It would be dumb for him to take it to court. You do the crime you do the time.

  65. Stephen A. Smith was right.
I guess that proves that even a blind squirrel find a nut now and then.

  66. I cannot believe he destroyed his phone. I completely get not turning it over to your employer, but destroying it? What does that do but make you look very guilty of something. Those texts didn’t disappear with the phone. Whatever he was trying to hit will come out if this goes to court.

  67. Yep, all innocent people destroy their cell phones.
Brady will get crushed in court. He is a cheater.

  68. Yes, exactly, mackcarrington: if this goes to court, the NFL can subpoena Brady’s phone records. Which would be outstanding.

Of course, for Patriots fans, Brady ordered his phone destroyed because he was innocent.

  69. He dstrod his phone? Big deal. As soon as the NFL would have gotten hold of it, they would have leaked the contents like thy always do. NFL and confidential do not go hand in hand.

  70. I’m not a Brady fan but Goodell got this one right…If it had been ANY other player, the result would have been the same. He was/did try to hide something, it’s apparent based on the statement. I’m disappointed as a football fan that a guy who has always been “spotless” has stooped to this level. I hope he sues and it get’s thrown out of court…

  71. Domestic abuse = More probable than not that someone did or did not do something with a football?

    Goodell must go!!!!!!!!!!!!!!! #freebrady
    __________________________________

No, but lying and destroying evidence when caught cheating does. And that’s what your golden boy Brady did.

Domestic violence is a society problem that should be handled by law enforcement, not the NFL. The integrity of the game should be the NFL’s biggest concern and someone thinking they are above the rules and breaking them is a huge problem for the NFL. Stop comparing a crime to breakings rules in a sport.

  72. myvickinabox says: Jul 28, 2015 2:44 PM

Or…he realized that the phone was his personal property containing his personal information and did not have to submit it to anyone outside of official enforcement and judicial systems.

Anyone have an employer that can/will demand your personal property as part of their investigation?

Would you hand over ALL your personal data on the phone?.

    ======================================

Except that is not true at all. Brady just had to show the relevant texts and could maintain possession of the phone during this.

So, yes, if my multi million dollar a year job depending on me showing an independent investigator a string of text messages and not all the data on it, like you claim, I would hand it over.

  73. Do you delusional Pats fans think he will win in court? A real court can supina his cell phone records, he didn’t destroy the phone because there was nothing on it. They can also get him for destruction of evidence.

  74. “thesteelhurtin says:
    Jul 28, 2015 2:48 PM
If there were no messages then why destroy the phone? He helped the NFL’s case out tremendously right there.”

Because there were 10K messages on there and it was a GUARANTEE that Wells would have found something on there to embarass him. Look what he did to JJ and ‘Dorito Dink”

  75. mackcarrington says:
    Jul 28, 2015 2:49 PM

Yes, and thats why this wont go to court at all. He was bluffing and telling the NFL this will go to court if they dont drop the suspension in hopes they would just comply. But he destroyed his phone, no one on earth can say he is just avoiding ‘setting a precedent’ at this point. Right now he is covering up for Bill and Kraft who are no doubt in those texts and associated with the cheating.

  76. Goodell the Master Hypnotist

Everyone, IGNOR all the Evidence against me and stair into Brady’s phone – Just imagine it is in front of you –
Now repeat after me = Brady’s Phone Brady’s Phone Brady’s Phone
Brady is GUILTY Brady is GUILTY Brady is GUILTY

  77. It’s so much fun to watch Patriots fans squirm. If the NFL took it’s job seriously, they’d be stripped of all their Super Bowls. By any serious accounting, the Patriots are 0-8.

    Suck it, Pats fans. Ha!

  78. Innocent people don’t destroy phones. Better crank up the excuse machine Patriot nation…..

“He was just protecting himself from NFL leaks” won’t hold water anymore.

  79. A good commissioner is like a good referee, the best you never notice. By this standard Roger Goodell is the worst commissioner in the history of sports and that’s not a high bar.

  80. I can’t stop laughing at the Pats fans. “They hate us for our freedom”.

You sound as dumb as Bush/ChainHe taking us to war.

  81. Has anyone checked in with Florio? He’s got to be devestated…all his efforts to exonerate Brady crashing to earth. Everyone needs to offer him their condolences. It’s going to be allright Mike, just hang in there.

  82. Destroyed his phone? That sounds perfectly innocent. Just like Aaron Hernandez destroying his phone and surveiliance equipment, just like the Spygate tapes, I can’t say I’m happy though, now more and more crying and whining from scumbag Patriots* fans. Now all whiny Patriots* fans will shift from being scientists to cell phone experts and legal analysts. Shut up with your nonsense and take your punishment like a cheater should.

  83. I love all the see you in court comments.

Yeah, its obviously going to be court challenged. Possible even Brady will win and get the suspension reduced/dropped. Of course, winning the court case will do nothing to impact people believing whether he did it.

So all we are really talking about is a relatively short suspension that is pretty unlikely to have any lasting impact on the outcome of the season.

Have your day in court. You’ve already had it in the court of public opinion.

  84. Here we go!!! LOL!!! Another Patriot on trial…another loser in the game of life who can only win by C H E A T I N G !!! How well did it work for Hernandez in the long run…

Winners don’t always need to come in first in the record books, it’s a much deeper satisfaction to be able to hold your head high. Something the Patriot org. would know NOTHING about…

  85. There has to be more to the story – Brady can not be so very stupid as to purposefully destroy his phone while knowing that Ted Wells wants access to it and then to ADMIT destroying it on purpose to Goodell. It just makes no sense what so ever.

  86. Weird that he would destroy the phone he knew the investigators had requested to see texts from? I mean, him being 100% innocent of these villainous and unwarranted accusations which are only about conspiracy, jealousy and refutation of all scientific fact! So strange–he must not be that smart, likely that phone could have exonerated him entirely, and had it destroyed. I guess he is just not very smart, bless his heart.

  87. I don’t know for sure, but if this goes to court, won’t the League then have power to subpoena his phone records from his provider?
    ……………

Absolutely… but so will Brady’s lawyers be able to go to Goodell’s, Well’s, Vincent’s and many other NFL employees, maybe some NFL owners like Irsay and Bisciotti.

This is going to be very interesting!

  88. I have to admit this looks poor for Brady. I am shocked though that if this took place prior to Wells’ interview why was this information not in his report? That seems suspicious on the surface. I guess its time to wait for the other shoe to drop…

  89. Brady bald face lied to his owner, his coach, each and every one of his teammates, the entire NFL, all NFL fans and the American public in general.

He is a sleazy little greasy lying cheater.

    CASE CLOSED!!!

  90. This makes my day ha ha ha ha ha The New England Cheaters will be without their star cheater. I’m hoping they lose all 4 games

  91. Now time to get Tommy Boy and the Cheat-riots for violating the salary cap. Think all those “home town discount contracts” weren’t being paid under the table?
Could that have been on Tommy-Boys phone?
    Hmmmm

  92. Damn man, I tried that same thing with my wife and now I’m out on the streets.

Apparently destroying your phone when someone asks for it makes you look damn guilty, who knew?

  93. for all you moronic Pats fans who will correctly note that destroying the phone doesn’t destroy the messages – the NFL has the power to obtain neither the phone nor the phone company records. But they asked Tommy Boy for the phone, and his response was to destroy the device. That creates a presumption in 50 states in the land that he had something to hide. About time you opened your blind eyes and accept that you have been rooting for a QB, coach, and thus an organization that cheats whenever and however it can. Truth hurts, but don’t deny it, deal with it…

  94. Ouch, that hurts. What’s worse than this is now Stephen A Smith looks more credible….just great.

Now if the NFL wanted to make more money, they would televise the court case – but if TB really did destroy his phone in an Aaron Hernandez type manner, not sure how he wins. Jimmy G time.

  95. Pats fan; put it this way, if this were a Federal investigation Brady would be going to jail for destruction of evidence and obstruction of justice. Do honestly think any federal judge would see it differently in this case? He destroyed the evidence and because of the CBA Goodell is judge, jury and executioner.

  96. Yeah, Ok. Tom instructed someone to destroy the phone? Am I to believe that Tom Brady himself is incapable of breaking a phone? He has servants do it? Didn’t they get the phones from the people he’d be texting to set up this grand scheme?

And what right does the NFL or the people they hire to investigate have to that phone? Absolutely none. He can serve pizza to his kids on it if he wants.

Like I said a few days ago, Adam Silver took a franchise from an owner in 24 hours and it took Goodell 6 months to make a ruling on under inflated footballs.

If he backed down he’d look even worse…if that’s possible. Goodells a joke and this whole thing is a black mark on the league. 4 games for not helping us hang you over underinflated footballs….hahahahaha this is so dumb!

  97. The US Judge does not need Brady’s phone, does not want Brady’s phone.

The US Judge will look at the Well$ Report, LAUGH, and then question Goodell, LAUGH some more, then wipe out the suspensions.

If phones & records are requested by the Court it will also include Goodell’s and others.

Court is a Two-Way Street people – It does NOT belong to Goodell the Foolish One.

  98. Destroying evidence is a sure sign of guilt. Brady is a coward and a cheater, and his supporters are mindless enablers

  99. this doesn’t make any sense.

If they were trying to negotiate a deal, and the NFL was offering a 2 game suspension, under these circumstances, why wouldn’t Brady take it?

there’s more to this than what they are telling us. as usual.

That week 5 matchup between NE and Dallas should be interesting….
    ________________________________
The Patriots have a bye. He won’t be back until week 6.

  101. Brady must have learned about destroying electronics that may contain evidence from Hernandez… I know it’s apples and oranges but that’s not something an innocent person would fear….

  102. If he did what Goodell said it won’t be favorable in a court case. Any judge will see that as an attempt to hide evidence. Not providing the cell phone is one thing, but requesting it be destroyed is another. Of course he wasn’t under any legal obligation not to destroy the phone like he would be in a legal proceeding, but it still is bad. I don’t think a judge could be supportive of that. Might get stuck with the 4 games now.

It will be interesting to hear the Brady camp’s reply. Even if it was a regular occurrence to wipe his personal phone and get a new one every few months, which is possible because it’s what people often do if they get a new iPhone from a Samsung or something like that, it still would be an issue if they had requested the text messages before hand. He could have just left it sitting in a drawer in his house intact.

Hard to defend that one even as a Patriots fan. If he was hiding something it couldn’t have been texts to the ball boys, because they were already out there. Maybe he was texting to other people about it. Could be protecting BB or Kraft I guess, but that’s a big assumption. It could also be that his mistress’ texts would be public. Could be anything.

One thing is for certain… once someone starts a discovery process you can never delete anything. That’s going to go badly every time.

  103. If Brady’s smart then he probably used an IP based txt message app that doesn’t keep records. Destroying the phone would get rid of the evidence. He’ll probably win in court. He’ll still forever be a cheater to all but the deluded Pats fans.

  104. HAHAHAHAHAHA

Destroys his own phone? Guilty as sin. Lucky he didn’t get more than 4 games now IMO.

  105. How did that work out when Hernandez destroyed his home surveillance system? The texts can’t be taken off the phone now, but they can be obtained from the carrier.

  106. Wow. Someone owes Stephen A. an apology.

Tom Brady does not want to take this to court. The last thing he wants is to testify under oath. If his lawyer is any good, he will remind him what happened to Roger Clements.

I guess Tom learned a few things from a certain former Patriot tight end about evidence.

  107. The Patriot Way ===> ****

Are those asterisks next to their Super Bowl victories? That’s how I see it.

Ok, so why doesn’t the league disclose HOW it was destroyed?

I mean, you could literally make the case that EVERYTIME YOU GET A NEW CELLPHONE… and for some people that’s a few a year, then that previous cellphone is ‘destroyed’.

So I’d really like a clarification of what they mean.

Do they have evidence that he specifically had it destroyed to thwart the investigators? I mean after all, he never had to hand it over.

So it seems more likely, that cell phone he was never legally require to hand over, was naturally disposed of in the course of someone who wanted to get a new cellphone, and that the LEAGUE is once again ASSUMING that Brady’s new cellphone was ONLY bought because he was trying to thwart them.

Once again it seems like Goodell is reaching and grasping at straws.

Besides, how in the hell does Brady ‘direct someone to destroy a cellphone’… Is he incapable of taking it and using his NFL QB arm to destroy a cellphone against the ground?

Hell I know someone who has literally gone through about 20 cellphones the last 2-3 years, and he doesn’t even have a job.

  109. Innocent men don’t have their phones destroyed the day they are collecting evidence.

  110. I’m a Pats fan and even I find it fishy that Brady destroyed his phone.

Of course, I also find it fishy that Goodell can’t get the information from other sources, in this day and age.

The most suspicious thing, though, is how Steven A. Smith had legitimate inside information.

  111. Yes, because the NFL always disseminates truthful and complete information. If they say that Brady “destroyed his cell phone in order to hide evidence”, it MUST be true and taken at face value… Haters are gonna hate, the NFL administration is a complete fraud, and Brady will start opening day. This is all SO ridiculous!

  112. I just laugh at Brady thinking destroying the phone would work. I imagine him, Belichick and Kraft in a room somewhere like that scene from “Office Space” where they’re looking up how to launder money in a dictionary.

  113. mswravens says:

    HE DESTROYED HIS PHONE???!!!

REALLY PATS FANS, WHAT ELSE WILL IT TAKE TO CONVINCE YOU THAT YOUR LITTLE PRINCESS IS GUILTY, GUILTY GUILTY!!!

    _______________________________________

Brady could come out and say “I did it’ and Pats fans would still say he didnt…Pats fans have supplanted Jets fans as the dumbest in the league

  114. There is more to this than we are hearing. I will wait for the response from the Brady camp. It’s too convenient for the NFL. Something is not adding up. 35 days for Goodell to decide, and he knew Brady destroyed his cell phone? 35 days! Come on, what’s the rest of the story?

  115. We all knew Goodell wasn’t going to admit he was wrong, unless a video game out with prove (IE: Rice). So we’re off to court. The phone thing isn’t going to help though, they never had a right to his phone so he should have just held it. It’s not like the text records get deleted anyways.

  116. Regardless of any court outcome, the court of public opinion finds you Tom Brady GUILTY!

You can pokes holes in the rules, the evidence collecting, trash evidence, etc. It really doesn’t matter.

You are guilty of lying to the public. You continue to do so. I will never respect you for that.

Time to be a man and come clean. It doesn’t matter how insignificant the crime is. Not taking ownership of your mistakes is the biggest crime.

Just ask McGwire, Bonds, Clemens, & Rose. It’s the lies that ruin you.

  117. myvickinabox says:
    Jul 28, 2015 2:44 PM
Or…he realized that the phone was his personal property containing his personal information and did not have to submit it to anyone outside of official enforcement and judicial systems.
    ——————–
You are correct. And the NFL is correct in suspending him for not cooperating with an internal investigation. He does not “legally” have to cooperate, or turn over his phone. But he isn’t charged with a crime now, is he?

He should have been suspended indefinitely for not cooperating. He could come back once he started cooperating.

  118. These Pats fans are funny. What’s a judge gonna say to Brady once he tells him he destroyed the only key piece of evidence to clear his name?

He’s gonna tell Brady well when anyone tampers with evidence they do hard time in my courts. Your lucky your only getting a 4 game suspension.

POOR POOR Pats fans will never admit Brady is a cheater.

  119. I’m wondering exactly how the NFL found out Brady destroyed his cell phone. Did he actually tell them that? He couldn’t put it in a locked box and say he asked Giselle to put in a secure place for safekeeping and have Giselle forget where she put it?

  120. My favorite part of the ruling is how Goodell claims this is totally different from the Vikings/Panthers ball tampering as well as heretofore unreported cheating by Jets employees prior to a game against the Patriots in 2009 because — reasons! Check out page 15, it is a hoot.

  121. Since when are text messages lost when you destroy a phone? What kind of stupid claim is that NFL? If you want them, you will get them when this goes to court, dont say 10,000 texts can never be retrieved again

  122. I wonder how Patriot fans will defend him now, except saying the lame Brady will win in court. If Brady was so innocent than why would you destroy a phone.

The new rule in the Patriots Way must be that you must destroy your phone to hide evidence.

  123. if Brady sues won’t the courts look at the same action of destroying the phone as destruction of evidence? why would you destroy your phone if you had nothing to hide?

  124. “What happens when the NFL does its testing this season of all balls before and at halftime and the finding show balls deflate?”

Then people will wonder all the more why Tommy felt it wise to destroy his cell phone.

Time to wake up Patriot fans. The destroyed cell phone is too much to ignore.

    Possible scenario:
Brady likes the football near the low end of the limit. He instructs the guys to keep it there and gets ticked off if it is too heavy. The guy in charge of that is called the Deflator simply as a sarcastic nickname as if that’s his only role.

Now in the course of a game the balls deflate even further as to be below limit. Nothing illegal here.

Until the ball boy gets caught on video going into the washroom AFTER they tested OK. did he do something illegal then? Maybe – maybe not.

What happens next is simply arrogance on the Patriots part. Refusal to fully cooperate – not because of guilt but because of arrogance. And THAT’S when the real problems start – and end.

A lot of messaging back and forth about air pressure worries Tom that he looks guilty – even if not. Quite possibly messages even to Bill and Kraft. So Tom panics and destroys the phone.

The Patriot way is to get every advantage possible. Nothing wrong with that. It’s a grey area to push the boundaries to see what you can get away with, but again not necessarily illegal.

The problem – as always – is the cover up. There is no way at all Brady takes this to court. Too many people – like BB and Kraft – will be called to testify. Tom will be told to take the suspension and end it – like Kraft agreed to the team punishment.

  125. Where are all of the “See You In Court” Patsie* fans?????
The only thing the court would rule on is that your QB is a moron!

  126. He destroyed a phone that he had every legal right to NOT turn over.
It’s like me taking a hammer to my microwave right now. Nobody’s business but mine.
    Court will be funny.
    Roger’s goose is cooked. Again.

  127. Judge : Mr. Brady, why did you destroy your phone – have you ever done this before?

Brady : Every Year I destroy my phones your Honor – I do this to protect my family from unscrupulous people who would seek to steal private information & photos from us, as well as selling it as a souvenir.

Judge : Mr. Goodell wanted to see that phone Tom – It could of resolved this.

Brady : Goodell wants a guilty verdict and nothing else your Honor – the FACTS that you have before you are GUARANTEED to resolve this.

Judge : FULLY AGREED – Now bring forward Goodell & Well$

  128. None of this matters. The league has no right to his personal phone. ALL that matters is the science of whether or not the balls WERE ACTUALLY DEFLATED. They were not.

Trying to sway public opinion about a possibly destroyed phone at the last minute (which is working very well, based on the above comments) isn’t going to do a thing to help the NFL’s case in court.

    Brady: Game. Set. Match.

  129. seahawkboymike says:

Guilty. Cheater. Lucky to get off with 4 games.

Now what will you say Deflatriots fans?

    ———————————————————

    Easy…28-24.

  130. Take it to court, the cheater destroyed evidence!!! Better yet Brady just retire with Gisele you don’t need this stuff. Then BB can quit right after that & the the by GOD patsies, the darlings of the NFL will SUCK again just like the 70’s 80’s & early 90’s AGAIN!!!

  131. Now we know why the NFLPA was begging for a settlement. Oh, they’ll try suing over whether Goodell can be arbitrator, but this fact leaves very little doubt about his guilt.

  132. So let me get this straight. I’m supposed to believe that in an effort to hide his text messages, Tom Brady ordered someone else to destroy his cell phone?

This makes sense… how? Is he not capable of destroying his own phone? Is he not smart enough to wipe it without destroying the hardware? Is he not smart enough to delete the offending texts and any phone backups?

No. He just ordered someone to destroy the phone. Right.

  133. All you spewing Pats fans owe Stephen A Smith an apology. You also owe PFT an apology for spamming evey single thread whining about Deflategate.

Pats fans have easily become the WORST fans in the league even surpassing Redskins fans

  134. Intentional destruction of evidence will surely be overlooked by a Judge. Said no one ever.

Would YOU want to go to Court with that little tid bit handing out there against you?

  135. He’s a football player, not a salesman. His phone is his, not his employer’s.

The NFL has the relevant texts from the two guys they say deflated the footballs, the ones that science says were not deflated. And Vincent, Kensil, and Wells are pissed Brady wouldn’t incriminate himself in their fishing expedition.

  136. All you ‘See you in court’ Pats fans might consider how destroying one’s cell phone is going to look in court. Especially when the texts will then be accessible by subpoena to the phone provider anyway. I predict Brady nobly accepts this unfair punishment rather than proceed in court and have all sorts of fun things that we don’t even know about yet come out for everyone to see.

  137. I can’t wait to hear Robert Kraft’s excuse as to why the destruction of the cell phone shouldn’t be looked at in a negative light for him and and his team.

  138. Brady is the ultimate scumbag. He already got special treatment. 4 games for blatant cheating is a gift from the NFL. He should have been suspended a year and put on the commissioners exempt list like everyone else. Cheating is a much bigger issue for the NFL than anything a player does off the field in their free time.

I want to give Roger credit for FINALLY getting something right.. But he got it wrong. Should have been much more than 4 games.

  139. Belicheat was on the text messages. The Patriots forced Brady to take the fall alone, because Belicheat would have been out a minimum 1 year suspension.

    ****

How else are the Cheatiots cheating right now? My guess is some illegal manipulation of helmet communications.

  140. Keep hearing the NFL does not have a leg to stand on in court, but not sure they really have to. Seems to me, Brady’s insistence not to cooperate with the NFL investigation, may be all the NFL needs to punish him. Having his phone destroyed the same day as his meeting with the NFL is out-n-out defiance to the league, and sure does not seem to be the actions of an innocent man.

  141. Well, looks like a whole bunch of you owe Mr. Smith a lil’ apology (including you, ampats, who claimed Smith’s claim made no sense at all.)

I’m sorry, but this tears it… now we’re talking obstruction of justice and destroying evidence territory. I wonder if even the Pats Fan Junior Lawyers and Scientists Brigade can explain this one away.

You must really have stuff to hide if you go this far.

Like I said to the “see ya in court crowd,” don’t be too sure Tommy wants some of this fishy stuff made all public.

  142. All of you saying that Brady didn’t have to turn his phone over obviously don’t understand the CBA. By signing that and helping oush others to sign it Brady agreed to cooperate in any investigations by the league. Brady really doesn’t have a leg to stand on in court. You can question the Wells report all you want but you can’t queston wether he cooperated or not because it is pretty clear he didn’t.

  143. myvickinabox says:

    ———————————————————

By the way, Robert Kraft PROMISED everyone in the Patriots organization would fully cooperate with the investigators.

    Brady did not.

  144. “See you in court” That’s all you got Pats fans? I’m not laughing with you. I’m laughing at you.

  145. There could have been quite a few things that he didn’t want leaked that I can think he might of destroyed that phone for that weren’t deflategate related….
Bad mouthing his coach? Talking to other teams? Naked pics of his wife? Naked pics of Garoppolo? ;p

  146. The State of New Hampshire just called to report that Brady’s nose has extended across the border. LOL.

  147. Florio, if this goes to court will those 10,000 text messages be used as evidence in the case? Also, the NFL can afford better lawyers than Brady.

  148. Finally some real news. Stephen A Smith reported something accurate! Now that is some serious stuff.

  149. Get over it Pats fans. This is not the last time your team will be caught cheating. Belichick, Brady and Krafts collective ego’s drive them to cheat and they simply cannot stop. You are letting yourselves be duped.

  150. fmckenney says:

    =========================

    NO KIDDING!

He should have been suspended for a year after destroying the phone.

  151. This entire fiasco is an embarrassment to the NFL. This is about as petty as it gets. Who really cares? Other than Brady and the Patriot haters-
    nobody!

I am a Packer fan, and could care less.

  152. Becomes more and more obvious if Brady was so squeaky clean as he says he would not have destroyed his phone. The only ones blinded are the Pat fans that can’t quite get a grip on the fact. Yet no word from the two equipment men that supposedly did all this on their own. A cheat is a cheat no matter how you look at it.

Thats a huge lie. Cell phone companies by law have to retain those for 2 years on a server for any police investigations or court cases. The NFL didn’t have the authority to pull it so they instead said its “non retrievable”

    Yep they are screwed

Sorry bro you are wrong, This is what I do for a living text message are not kept by phone companies for more then a few weeks, AT&T dont keep them at all. Sprint is like two weeks and Metro PCS is the longest at 4 months. Trust me I know. So by destroying the phone he destroyed ALL evidence of the TEXT messages. Smart move. Probably alot more damning stuff on there then just deflate gate.

    __________________________________
The NFL extended an offer in which Brady did not even have to turn over his phone. His lawyer would have been able to sort through the messages and then hand over only relevant texts. Brady may sue initially in an attempt to save his image but he will back off at the last second because the truth coming out in court will tarnish his image forever.

  155. Wells had no right to compel production of Brady’s phone. If anyone has any labor law or CBA language that states otherwise please educate the rest of us.

  156. If I were Brady I would of had my phone melted and then shaped into a football with AFCCG PATRIOTS 28 -colts 0 inscribed on it, and then I would of given it to Goodell.

  157. Judge :
“First text on Goodell’s phone : July 28… First text on Kensil’s phone : July 28… First text on Irsay’s phone : July 28… First text on Bisciotti’s phone : July 28… First text on Vincent’s phone : July 28… First text on Wells phone : July 28…

Mr Commissioner, have you ever seen such a coincidence?”

    Goodell :
“Yes, Your Honor. It also happened with all the videotapes during Spygate. They all disappeared at the same time. I mean, we need to protect the integrity of the Shield. It is a common procedure inside the NFL to destroy things randomly once in a while. But this procedure does not apply to players. Well… maybe some players, but not all of them. You know, it is for the integrity of the Shield.”

    We need this on TV!

  158. Just when you thought “The Deflator was a fat guy on a diet”, was the stupidest thing that would come out of all of this……we find out Tammy destroys her phone.
    BWHAHAHAHAHAHAHAHAHAHA!!!!!!!!!!!!!!

  159. IF brady were smart he would just take the suspension and keep his mouth shut and out of the courts.

  160. They can still get all the text messages. Brady would have to sue the NFL and then the text messages can be subpoenaed. The question is, will Brady take this to court?

  161. The game just changed. It’s no longer relevant whether there is evidence to show that the footballs were tampered with. He destroyed the phone. He deliberately concealed evidence. That in itself is enough to justify the suspension. Just ask Martha Stewart and Scooter Libby, who went to jail, not for the crimes for which they were investigated, but for lying and impeding the investigation itself. See you in October, Tommy Boy.

  162. Guilty. Cheater. Lucky to get off with 4 games.

Now what will you say Deflatriots fans?

    ====================
So still nothing on whether or not Brady deflated or having somebody else deflate footballs?

  163. The best part of all this (besides all the Pat fans crying) is Brady’s camp tried to broker a deal to a fine.

    ……………

Absolutely… but so will Brady’s lawyers be able to go to Goodell’s, Well’s, Vincent’s and many other NFL employees, maybe some NFL owners like Irsay and Bisciotti.

This is going to be very interesting!

No they can’t! Only in civil court. Not in federal court.

  166. He destroyed his phone. I can understand not giving it over, but he destroyed it.

All that egg on the “brady is innocent!” faces.

  167. Brady must have thought he was working for Obama’s IRS or State department. But then, just like Lerner and Hillary, there is no shortage of bone-headed apologists who would be quite content for the rules not to apply to him

  168. Trade him to the Redskins for a 1rst, a 2nd and RGIII. They can still get out of the 5th yr option on RGIII. Kraft and BB can’t put Brady on the field now.

There is so much word of mouth swirling about what the Pats have done, it wouldn’t surprise me what else will come out in the future. There has been those within the NFL that claim the Spygate was much worse than the NFL ‘proved’ (then destroyed). There have been complaints about game balls years back. There has been accusations made about Brady receiving an unfair advantage with direction being given through his helmet after the 15 second cutoff (personally, that one would destroy his legacy completely). It’s kind of like Al Capone. We all know what he was, but all we could nail him for was tax evasion (i.e. ball deflation)

  175. Fight all you want Brady and Pats fans, but you don’t destroy your phone if you’re innocent. And Goodell has full authority to suspend Brady 4 games simply for failing to comply with an investigation. Case closed.

  176. If Brady is innocent, why would he destroy his cell phone?

If the cell phone exonerated him of wrong-doing, there’s every reason not to destroy it.

Looks like Brady cheated after all.

  177. Everyone knows how much Brady sucks. He’s a 6th round draft pick. The entire roster sucks because Belicheat sucks as a GM. That’s why Belichick the coaches hires people to show crappy team how to cheat 99 ways every Sunday to beat crappy 3 win Jags teams. Next cheater up. That’s how they win. Not that they’re good. Nobody is scared. If Kraft fired Belichick after spygate then you’d see how crappy this team is. Or if he got drafted the Titans by their coaching staff. Brady would’ve been cut as a rookie. The QB or player doesn’t matter to Bill. Next cheater up.

I don’t understand how Pats fans defend their embarrassment of a franchise. They think the other teams can’t beat them. I wouldn’t want one player from the past 15 years of Pats players except Revis. That’s how crappy they are. Revis is the only Hall of Famer.

What kind 0f innocent people destroy phones and then say they’re innocent? Cheaters!!! Belicheat will show Garafolo how to cheat so they beat the 3 win Jags and the Pats fans will say everyone is scared of them. Belicheat will groom this years roster to cheat and how handle NFL investigations just like they have until Kraft fires his repulsive embarrassment of a coach. The fans of the other 31 teams know the Pats as a franchise don’t matter. If Kraft fired his cheating coach then they would never make it to Super Bowl for 20 years and lose like always. Then move away to L.A. Kraft knows he sucks as an owner and can’t make another good hire. He wouldn’t have taken this 15 years of humiliation by his coaching staff.

  178. Pat fans seem to confuse the Charles River with the DeNile River. In a few months they will see what the future holds without Brady and it wont be pretty.

Also as I recall on the stephan a smith the schmuck thread wasnt it posted that destroying a cell phone does not destroy the ability to get access to texts.

Cheating needs to have consequences 4 games is nothing compared to what the Pats gained by cheating.

  179. I bet there was a ton of questionable photos from Gisele on that phone, and he rightfully didn’t want to turn that over for people to see. he will win on court

  180. You don’t destroy your cell phone if it clears you of all accusations.

4 games is too leniant of a suspension. Willingly cheating the game of football and destroying the evidence deserves more than that.

Brady is lucky to have gotten off with only a 4 game suspension.

The haters think the absence of evidence is evidence.

You don’t assist a witch hunt.

  182. Brady is the NFL’s Lance Armstrong–cheating and then trying to cover it up. Cheating organization, cheating coach, cheating players. Pats fans will be crying on their Tommie Brady pillows tonight.

  183. You guys have it all wrong Brady didnt destroy his phone because he was worried about what was on it. He was on hold to long with his insurance provider like the little kid in the nationwide insurance commercial.

  184. So for all the morons that keep saying it won’t go to court because the NFL/court will subpoena his cell phone/records you are WRONG!!!!

It’s going to federal court NOT civil.

  185. SOOOOOOOOOOOOOOOOOOOOOOOOO guilty. If the deflation was not that big of a deal,

    a) why do it?,
    b) why destroy your phone?,
    c) why not just admit it?

  186. As a life long Cowboy fan who happily lived through the Superbowls of the 90’s, I get Patriot fans feeling “they hate us because they ain’t us” and clearly there is a lot of jealousy directed at New England BUT, come on, something stinks here. The NFL hasn’t tried to “destroy” any other very successful team in NFL history, it’s just bad business, so why would they try to do it to New England? The correct response is, they wouldn’t, even the most Pat loving fan has to see that, right? Your team has the stench of a cheater.

That is until Brady files his appeal through the court system which makes it a court case which gives the NFL access to request a subpoena for his cell phone records and the content of his texts. Therefore, Brady loses two ways by filing a case against the NFL. First, with an injunction we don’t know when the case will be decided and he could still be suspended for four games. If that decision comes a week before the playoffs then he will serve his suspension during the playoffs. Is that what he wants? Secondly, he now opens himself up for the NFL to actually see what he sent in those texts. Listen, at this point, take the penalty, come back and help your team. By dragging this out, especially when your coach has pretty much let everyone know he thinks Brady did it. If I was Billy Hoodie, I would make Brady sit for the benefit of the team to get it over with and to keep Brady from being suspended when the Patriots really may need him.

  189. Do the math. He sent one text every 17 minutes and that’s if he didn’t sleep at all during the last 4 months. What a clown. Reputation destroyed. Now I feel bad for Pats fans.

  190. Brady* and Bellichick* and the Patriots* are cheaters (as we already knew from Spygate several years ago).

For the last 5+ years, the Patriots* have had a fumble rate that is statistically freakish — not just the lowest in the NFL, but the lowest by FAR. That doesn’t just happen — it would be like a baseball player hitting .425 when the next best hitters are all around .350.

Guys that previously played for another team had their fumble rate suddenly drop when they came to the Patriots*, and guys that left the Patriots* for another team suddenly had their fumble rate go up.

    Cheaters, cheaters, cheaters!!!

  191. Goodell: You want answers?

Pat Fans: I think I’m entitled to.

    Goodell: *You want answers?*

Pat Fans: *I want the truth!*

Goodell: *You can’t handle the truth!*

  192. For all you clowns who dog Steven A. Smith calling all kinda names where are you now , face it Tommy Boy is a cheat. but I have another angle maybe the reason it took so long for Goodell to render a result was he was trying to throw The Pats a bone, and not bring the hold team down, but Brady was too stupid to take the bone. he was trying to spear the coach, cause you know Coach B knew what was going on and so did the owner that’s why kraft gave up to show Brady he man we can’t win they got us, but not the might Brady, now I hope he take it to court and the hold organization gets brought down, remember if Coach B is caught in any other cheating after sypgate he could be band for life, so the Pats could lose 1 Million dollas, 1 and fourth round draft pick, coach B and saint Brady lol cheaters never win. WAY TO GO STEVEN A. SMITH keep telling us the truth first.

  193. Dear Tomasina Brady,

You failed to grasp how to handle illegality and make it look like you give a flying monkey’s rump.

As someone who is skilled in the art of the lie, I wonder how you failed to take my example for handling deception.

First, you should have denied you had a smartphone. It doesn’t matter if you did or if someone says the contacted you on it, you first must deny having one. This may seem implausible, but denial sets up the second point.

Point two. When it is discovered that you most certainly did have a smartphone, you then state that you weren’t sure what a smartphone was and that you have turned over your “cellphone” to your lawyer to review all text messages and other data so that you won’t reveal personal data like wedding pictures, compromising pictures of you in drag, or other items. Your lawyer will then delete all the personal items.

Point Three. You will release selected remainders of emails and text messages that make you look good and you will deny you had any other emails. You will continue to hold in your possession your phone and allow the talking heads to run their yappers.

Point Four. When there is any hint that you have not disclosed all of the appropriate emails and text messages, you will then assert that you never talked about football on your phone. Your lawyer will certify that this is so.

Point Five. You will continue to not make available your personal phone and direct all communications with your lawyer who will deny, deny, deny everything.

Point Six. You will then hold a press conference with hand picked journalists and they will ask you only questions that they have submitted ahead of time and that you have approved. At no time will you ever admit you talked about football on your personal phone. And you will intimate that your phone might have contracted the bird flu or some other virus so as to call in question whether the information on your phone is really from you.

Point Seven. You will then state, “What difference at this point does it make” when people ask you questions. Put the ball back into the hands of the questioners and make them look stupid.

I hope that you will prevail but you should have followed my carefully scripted way of avoiding any responsibility for being a dirtbag and liar.

    Signed,

Stop bringing up Mike Kensil- he has NOTHING to do with Brady cheating. And as for “Going to court cant hurt brady in any way” you could not be more wrong. If they go through his phone and find out he had texted Belicheat or Kraft about this then they are implicated too and the whole organization goes down. So going to court can 100% hurt them more. I HOPE it goes to court and we can see what he so desperately (and feebly) is trying to hide.

  195. This is ridiculous. Brady pushed the envelope, no question, but a lot of QB’s have admitted to doing the same in this situation. That’s not the point though.

I would NEVER EVER turn my cell phone over to any entity representing the other side of a legal case or investigation if I did not have to, furthermore, no matter how innocent I was in that specific matter, only a huge idiot would turn over their cell phone to a legal team who did not represent them. I turn it over to my lawyer only, if my lawyer asks, and if my lawyer says destroy, that’s what I do. End of story. Since this WILL get appealed he likely won’t serve a suspension in his playing days (P and K Williams suit took 3 years to end).

  196. And, for all of you asking why they needed the phone when they could get the records from the phone company, it doesn’t work that way. This was not a court case where such records would be the subject of a subpoena. This was a private matter internal to the league. There was no subpoena power available to the league. In fact, in some instances, a court order would be necessary to get the records from the phone company. So, at the time of the request, the only way to access Brady’s phone records was through the phone itself and with Brady’s permission.

  197. All Brady had to do was produce printouts of the communications, not his cell phone. But he decided to not only had those over….but take it one step further and DESTROY his cell phone.

GUILTY is the only explanation for his behavior.

How did that work out when Hernandez destroyed his home surveillance system? The texts can’t be taken off the phone now, but they can be obtained from the carrier.

    —————

That might end up being Brady’s only possible defense. He got a new phone… had the old one wiped, which is pretty standard. He already said he wasn’t handing over texts. All text messages are available through the carrier anyway, so if an actual court asks for the records he would be supportive.

May not be the truth, but it’s about the only defense that could work.

  199. Too bad we can’t suspend Clinton for destroying her server to hide information about Benghazi. Innocent Americans died but she is not held accountable

  200. I read a very good comment that basically said you wouldn’t hand your personal cell phone over to your boss without a damn legal subpoena. Read another very good comment that said the irony of this whole thing is Brady didn’t have to cheat! My personal opinion about this is somewhere in the middle of those two extremes.

  201. “On or shortly before March 6, the day that Tom Brady met with independent investigator Ted Wells and his colleagues, Brady directed that the cell phone he had used for the prior four months be destroyed,” the league statement read.

Could someone explain HOW exactly he “destroyed” the phone?

Can someone explain WHEN exactly he “destroyed” the phone?

Did the man just, I don’t know, upgrade his phone? Why are so many people enthusiastically supporting this decision? I don’t get it…

This whole cellphone thing has never been anything other than a giant red herring; just follow the sequence of events to see this:
-First they couldn’t prove deliberate deflation, to the point where Wells’ hired ANOTHER scientific research firm (Exponent) after consulting Columbia University.
-Next, in order to rationalize a multi-million dollar, long and drawn out investigation, they harp on Brady being “uncooperative” to validate their suspension.
-Then, Goodell says that a decision would be reached soon, and that “we” (even though he’s supposed to be the sole arbitrator) just want to take “our” time to get this thing right.
-Next, independent research either directly disproving Exponent’s findings, or questioning their validity due to an inability to perfectly replicate their experiments, begins to flood in, swaying public perception.
-Then, it takes TWO MORE WEEKS since Goodell said a decision would be reached “soon”, for Goodell to uphold the suspension. How does he defend this move? By invoking Brady’s “destruction” of his phone. If what Brady did was truly “destroy” his phone (which as you can tell by the first part of my comment, I’ll doubt until more news comes out), why did it take so long to mention it?

Seriously, why? Why didn’t the Well’s report mention this ONCE? The report went on and on about how Brady’s refusal to turn over the phone was an indication of being “uncooperative”, but it neglected to mention that he DESTROYED POTENTIAL EVIDENCE. Why?

Why wait until now to divulge that information, unless “destroying” isn’t what really took place, and the league is just looking for a way to rationalize everything that’s transpired over the course of these many months…

  202. more to come for sure – Godell shifting the argument towards failure to comply which is handled differently under the CBA. Once the cheater, cheater chants from the morons slows down, we will get a better feel for what this really means (other than all NFL players rethinking their cell phone equipment now that Godell can claim rights to your personal property)

  203. At least now we have a ruling. Why in Gods name does this have to take so long. Fact is we all know the reason: Goody had to make it look like he agonized over a decision he more then likely made 8 weeks ago.

I for one expected it to stand. They have all the goods they needed for this. There never was a maybe in any of this, they knew the truth and who was guilty.

  204. Would you hand over ALL your personal data on the phone?
    —————–

I would if I had nothing to hide and the ONLY PERSONAL DATA THEY WERE ASKING FOR was printed out communications between him and the 2 deflator stooges.

Stop asking like they were demanding his cell phone or all of the data on it. That was not the case.

  205. What do AhleyMadison.com and Brady have in common? ( Insert you’re own punchline here )…. Hehe

  206. LMAO!

Don’t hurt yourselves over this scandle, really. Brady isn’t worth it.

Judge: At any point did you think it was dumb to destroy a phone that you were told they wanted to see and may be used as evidence?

Brady: no, i thought if i flushed it down the toilet all the evidence would go away.

Judge: Okay well we’ll take a look at your phone transcripts, and we’ll bring JJ and JM on the stand under oath to hear what they have to say.

  208. So Tommy gets suspended and loses in Court. NFL goes ahead with their new Ball Control. Switch to Green Bay, noted for its super heat played in mid December. Ref are taped airing balls to 13.5 psi. Game played in tempatures that made the Ice Bowl look bamy? Half time, Ref again taped and brocast live…. Balls are all measured at 12.1!!! Quick crucify Tommy again, he directed the ball boys to deflate the balls…
What a joke these idiots at the NFL front office.

  209. How many of you have read the 20 page response by Goodell? It’s available and would give both sides of the argument a better understanding of what they are arguing about.

My take aways is that it looks like Brady should have had the NFLPA involved from the start. I think he got bad advice from his lawyer regarding his phone. Having it destroyed doesn’t look good regardless of why it was done.

Secondly the NFL, as one would expect, brought in another “expert” to discredit anyone pointing out the obvious flaws in the Wells report regarding the gauges and support Exponent. Goodell (or his lawyers who actually drew up the document) go out of their way to point out how credible this expert is and how his conclusions that Exponent did a “first class job” prove that all the other scientists and think tanks are obviously wrong. This expert was, of course, also hired by the same people who wrote the Wells report. Shocker that they agreed with everything Exponent, also hired by the authors of the Wells report. If the league wanted credibility, they should have gone outside the Wells/Exponent group to hire a true third part to prove/disprove Exponent.

It’s clear that the document was crafted with CYA very much in mind. I’m certain in the coming days we’ll get a rebuttal or two (or hundreds) that will point out the flaws and inconsistancies. Barring Brady completely back-peddeling, this will go to court where the procedural arguments will be made that Goodell was biased and unfit to hear the appeal in the first place.

As much as Brady didn’t help himself with having his phone destroyed, Goodell also did not help himself by waiting 5 weeks to render a decision when he was aware the phone had been destroyed before the appeal even took place. It’s going to be fun to watch the fireworks.

  210. Which worried Tom more, having Goodell read the more than 10,000 text messages from the previous four months, or having Giselle read them?

“I wonder if even the Pats Fan Junior Lawyers and Scientists Brigade can explain this one away.”

You sir just won the internet for the day!

  212. Tommy went all Hillary on that phone. Don’t blame him but yes, he will have to turn over all messages on that phone if we are heading to court. Hope he didn’t say anything too bad and it gets out since we are in a hyper-sensitive world.

  213. this was the only path for Godell since clearly the Wells report was a farce and next year the air pressures in football will be public knowledge. His only move was to reinforce the “failure to comply” portion of his punishment.

He had no right to Brady’s phone and while Brady’s reputation will take a hit, I suspect he realizes that he could not allow the NFL to leak his personal information.

  214. for all you moronic Pats fans who will correctly note that destroying the phone doesn’t destroy the messages – the NFL has the power to obtain neither the phone nor the phone company records.

Oh wait, is the from the high educated and informed fan of the Ravens calling someone a moron? After last years Ray a Rice fiasco I would think you would be very uncomfortable living in a glass house….and even worse in a riot. I would be gloating as a Raven fan as the Ravens are far from a model franchise. The Pats cheated on the field the Ravens tried to hide abuse….right. Educated..maybe…informed…not even close. What you hate you have become….a hypocrite.

I’m wondering exactly how the NFL found out Brady destroyed his cell phone. Did he actually tell them that? He couldn’t put it in a locked box and say he asked Giselle to put in a secure place for safekeeping and have Giselle forget where she put it?

    ————-

My guess is Brady tried to tell the NFL the reason he denied the requests for the cell phone was because he had gotten a new one and the old one had been destroyed so he knew it would look bad. Then he probably tried to provide an innocent reason why the phone was destroyed.

Unfortunately it backfired if that was the strategy. Destroying potential evidence won’t be looked at in a good light no matter what the circumstances.

Not sure why he would admit that if he already denied their request. He should have just denied again. Then he might have gotten 2 games.

One thing is for certain, that Goodell is also spinning this in the NFL’s favor the best he can. Brady will have to say what happened soon or he will lose all his support.

They WILL have that authority if Tommy is stupid enough to file in court. Time for him to MAN UP.

  217. Brady now has a problem with going to court.

He can either try to claim the investigation was flawed and he’s innocent…

Or that he’s guilty but that the punishment was too harsh.

The former opens the door for the ball boy, Belicheat, Brady and everyone else on the stand as well as subpenaing the phone records from the phone company.

    That won’t happen.

The latter erases all pretense of innocence.

    #*****forever

  218. To the Brady apologists, you can make a point that Brady didn’t have to give his personal property to his employer, but he also didn’t have to destroy it. He only had to decline providing it. The fact he destroyed it, implies there was something on it that he really didn’t want them to see because he wanted to make sure that they couldn’t coerce him into providing the phone.

Regarding the lawsuit, it will never happen because it opens Brady up to further scrutiny during legal discovery. The NFL doesn’t need the phone to get the text messages in a lawsuit. Through the courts, they can subpoena transcripts from the cell phone provider. Brady can’t destroy those.

  219. Apparently no one is waiting for Brady to have his say on this latest development

All we can say for sure is the last time the NFL presented “information” it was flat out wrong (11 of 12 footballs deflated) or had Wells/Goodell doing some factual somersaults (accepting the “best recollection” of Anderson’s PSI readings but rejecting the simple yet important matter of which gauge he used)

But, guilty until presumed innocent is the Goodell way of thigns – especially in this matter in which Goodell didn’t even let the fact that the footballs weren’t deflated

  220. I think I see the NFL’s angle on this. Sure, no “crime” was committed, it can’t be proven. BUT, Brady hand wrapped them the perfect out by destroying his cell phone therefore just begging to be suspended for failure to cooperate. I’m a man of my word. I have been defeated. I have backed the wrong horse. The haters were right and I was wrong. You win. Enjoy the season. Let’s hope when it ends we won’t be talking scandal again for the next 6 months. P.S. I’m so pissed at Brady now I wouldn’t mind seeing Jimmy G the entire season.

  221. Unless Brady is using a cell phone from 2001, it doesn’t matter if the phone is destroyed because it is either backed up on his computer, the cloud or transferred to his new phone. Plus iPhones have a settting where his texts are automatically deleted after 30 days. (Assumption of iPhone based on his giving of macs).

  222. Um, when the NFL simply asks for assorted texts and says “we’ll trust you’ll give us texts that are germaine to the situation” and YOU DON’T and YOU IMMEDIATELY DESTROY the phone. You’re guilty. The NFL gave Tom every chance to cooperate, including handing over texts he could have cherry picked to his own benefit!!! Anyone outside of a Pats fan can see the dude cheated and tried to cover it up. Regardless if it helped. Perhaps it did in the Ravens game, didn’t need it in the Colts game. Cheating is cheating and yeah, slap that ASTERISK on it and lets move on. Tom Brady is a cheater and will miss 4 games for it.

  223. All the Pats apologists saying “see you in court” have probably never seen the inside of a courtroom and have no idea what the impact of destroying evidence means to a judge. Brady will regret the day he didn’t take a settlement of a lesser suspension. If the do get a restraining order, and he loses in court which he most likely will, then he might miss playoff games.

But in any event, he has permanently tarnished his legacy by destroying his phone which would have proved him innocent if there was no incriminating evidence on it.

    *****

  224. Wait, he destroyed his cell phone? Who does he think he is, Senator Lindsay Graham?

  225. Wells had no right to compel production of Brady’s phone. If anyone has any labor law or CBA language that states otherwise please educate the rest of us
    ————————-

The CBA does allow for this. It’s under the part about cooperating with an investigation with includes any relevant cell phone records. The fact that they didn’t ask for the entire phone, but just pertinent records to the investigation vetted first by Brady’s attorneys would fall under that category.

  226. I kind of think Brady is trolling the NFL and Goodell. Especially if Brady’s team is planning to sue. Brady could just get the text messages from the carrier and show them if he wants his personal info out there. His lawyers allowing the destruction of the phone seems odd but maybe it’s a bigger part of the plan and they’re baiting them. His personal off work data should not have to be mandated to prove innocence. The NFL case against him was weak and the lawyers know it.

  227. Cheatin’ bas+ards! I wonder what new rule Bill is planning to cheat this year…

You *Patriots fans think a court is gonna turn this over? A guy who destroyed evidence in an investigation? W R O N G !!!!!! That cell phone is probably next to his Original Whizzinator, because he’s clearly on drugs to think he’d get away with this one. *Brady is a tool.

    Thank God for Roger Goodell!!

I STILL want my apology from *Bob Kraft!

    _______________________________________

Brady could come out and say “I did it’ and Pats fans would still say he didnt…Pats fans have supplanted Jets fans as the dumbest in the league

    ———————-

Patriots fans may argue that he is innocent. I have. However, mostly fans think that the offense is minor and they want him to play those 4 games and to maintain his legacy. No fan wants to lose their star starting QB for 4 games.

Admittedly this is pretty tough info to defend. It doesn’t really matter what the reason was it’s just not something you do when you are under investigation.

  230. I am not certain how long a carrier can keep texts, but a court can order the release of said texts. Although a customer can destroy them, they can be given to said after 10-14 days by request. Any time beyond that a court can order their release.

  231. If I paid for things with “BundchenBucks”, I would probably upgrade my phone every other week.

If I were married to Ms. Bundchen, I would also probably be destroying my old phone, because there are probably things on there I wouldn’t want public!

  232. What the hell does “Brady directed” mean? The omission of facts here is yet again selective disclosure by the league office in order to sway perception. Who did he direct? How did he direct it? Why did Brady say he “directed” it? Did he have Gronk spike it or did he simply request a new phone from his carrier, as do all celebrities on a quarterly basis?

  233. For the record his defense of I routinely destroy my phone may have held up if he had destroyed the phone he had prior to the destroyed one but curiously he still had that one.

  234. I seriously doubt this goes to court all things considered. It’s completely, undeniably, obvious he cheated. Moreover, he did the only thing a guilty person can do… destroy the incriminating evidence. Brady needs to come clean and apologize to everyone, including the blind pat’s fans.

  235. I’m no Pats fan, but this is absurd. What was once the league in contention to be America’s new pastime has now become a circus. The refs should check the equipment before the game. End of story.

“I don’t know for sure, but if this goes to court, won’t the League then have power to subpoena his phone records from his provider?”

I don’t think so, because you are not usually allowed to bring in new evidence on an appeal, only to argue over what the evidence used in the original decision supports. If the original matter had been a court case, then the NFL could have subpoenaed that information from carriers, but I doubt they have subpoena power in an NFL investigation.

Anyone going through the roof should calm down and look at this objectively. Whether he was obligated to provide it is irrelevant to what his actions indicate. It’s pretty obvious what inference arises from intentionally destroying evidence that you know will be requested as part of an investigation. It’s not really any different than Hernandez attempting to destroy evidence on his security camera system.

  237. Wow. If he really did destroy the phone that tells you all you need to know. I can’t believe him or his lawyer would have been that dumb. Fight like heck to never let anybody see the phone, sure. But destroying it is akin to proclaiming his guilt.

  238. I have to give it to Pat fans who have been posting for months that even if Brady went to court he would not have to give up the cell phone. I concede you got that ONE right.

GOAT to goat faster than OJ or Pete Rose

  239. For all the Pats saying Brady should sue, God I hope he does.
I’d love to see the league lawyers subpoena Brady’s phone records not to mention those two fired equipment managers.

Destroying a phone doesn’t erase phone company records of texts, fools.
And those two employees would be called to testify under oath.

  240. Filing suit opens the door for the league to subpoena:
    Old phone records
    McNally to testify
    Jastremski to testify
    TB to testify
    BB and BK to testify
Not sure you want to go down that road………

  241. “So still nothing on whether or not Brady deflated or having somebody else deflate footballs?”

Get over it – it no longer matters. This is now only about Brady not cooperating.

Cell phone records are GONE – see the post above from someone who knows. I’ve looked that up too. Trust me – everyone involved should have simply deleted their messages and said they do that once a week for protection.

Why destroy the cell phone and look guilty – and give Goodell a reason to uphold the suspension. Pretty dumb.

  242. Patsie fans are delusional.

Go to court? It just makes Brady and the Pats look worse. His legacy is tainted outside Boston now for good.

PS-I still want to see those text messages. My opinion is Brady is protecting the real culprit, Bill Belicheat!! And before you Pat fans start whining, you and your organization have lost all benefit of doubt from here on in.

  243. If a lawsuit is filed, will the NFL have subpoena power for the phone company text records for Brady’s phone? It’s hard to imagine that any appeal judge will have a favorable impression of intentional destruction of evidence.

    ———-

I remember hearing years ago about a theory that Belichick knows about a lot of dirt on a lot of NFL people. when Spygate happened Belichick agreed to take the hit at that time but vowed to “spill the beans” if they ever went after him again.

To quote Will Rogers: “It takes a lifetime to build a reputation, but you can lose it in a minute”.

  248. I like Tom Brady…

But, he needs to just serve his suspension and move on.

He is going to lose…. If he was innocent, he wouldn’t have destroyed his phone… And seriously, how many people on Earth ACTUALLY DESTROY their phones ??????

The cover up is always WAY worse than the crime…because in all fairness… I doubt a single, solitary poster in here would care if he said..”yes, I like them a little bit deflated” right after it was reported.

It’s like having pine tar too far up a bat handle…. It’s not like that the extra pressure in a football is going to make him suddenly turn into Jake Delhomme out there…

But, he elected to cover it up, destroy his phone, make it 9 Billion times worse, and should serve the full 4 games…

Innocent men don’t destroy their phones. Especially when the NFL has no real authority to make him hand it over.”

    Another illogical hater post.

If the NFL has “no real authority to make him hand it over” why wouldn’t he get rid of it and why would getting rid of it be an issue?

The haters think the absence of evidence is evidence.

You don’t assist a witch hunt.

Investigator: “*Tom, I’m gonna need your cellphone to see your texts.
    *Tom: No.
    Investigator: Why not?
    *Tom: Because I’m innocent.
Investigator: Then why not hand it over to me and we can prove it?
    *Tom: Because I destroyed it
Investigator: Why did you do that?
*Tom: Because this is a witch hunt and I’m innocent.
Investigator: So you destroyed the piece of evidence that could have helped show you did not ask people to deflate footballs because you are innocent.
    *Tom: Yes
Investigator: (scratching head) Hmmm. OK then, have a nice day. By the way, you might wanna think about NOT going to court on this one… And you might also want to hide that Original Whizzinator, it’s sitting right there on Gisele’s bedside table…

Biggest court case since OJ. Getcha popcorn ready!
    ———————————
Yes, both GUILTY as can be!
Patriots are cheaters and their fans are proud of it. Sickening how stupid these fans can be.

  251. And we learn, yet again, that the cover up is worse than the crime……..Tom if you had just laid it all out there you, maybe, are facing a one game suspension. At this point it’s three for the cover up and one for the illict ball tampering as far as I can tell. I’d bet the courts would say split the difference and get out of our face. But at what point in terms of timing in season would that be happening?

  252. Sounds like Brady and Hillary Clinton have the same IT consultant. Texts/emails…what texts/emails? Cell phone/server…what cell phone/server? This is 2015 not 1990. If you delete/wipe clean texts/emails when you are in the middle of an investigation, you have pretty much declared you are guilty of something.

  253. Please take it to court. A Judge would love to hear how you should be exonerated despite the intentional destruction of evidence (whether any evidence was on the phone or not) and, given how long it takes to get cases heard, this could happen later in the year when the court time would take away from game prep and that four game suspension would be either during the end of the regular season and/or playoffs. THAT would be justice. But Tom’s too smart for that, right?

  254. I would venture a guess that all you Pats geniuses who say you wouldn’t give up your cell phones either, do not have a 20 million dollar per year job to lose …It’s so brave of you to risk those Wal-Mart jobs by not co-operating…Good God are you people delusional or what ?? Your livingGod destroyed evidence,,.. You cry babies just need to let it go…
You cannot ever fix this- Everything the Patsies have done will now be tainted with the stench of cheating-forever

  255. The fact that he destroyed the phone and got a new one the SAME day that he met Wells is just classic. Must be another “coincidence” in this whole mix up involving the innocent Brady hahahahahha.

Go ahead, tell us how destroying your phone is an act of an innocent man. There was a reason he was initially given 4 games, there is a reason he destroyed evidence and there is a reason the appeal was turned down. At some point, your going to have to face reality.

  257. Unless Brady with held this latest information from his lawyers and the players union, not to mention Kraft, I can’t imagine why this matter would have proceeded to an appeal much less to a threatened court appearance. None of these people are stupid and it doesn’t seem plausible that any of them would have thought it was a good idea to proceed if they knew that Brady destroyed the phone. If we have now heard the whole story I think the saga has to end here (indeed it should have ended long before this) but if there is still more to this story, then it will and ought to proceed to court. I am a strong Patriot’s fan and the question is being asked as to what I would need to convince me of Brady’s guilt. For me, I want to hear him admit that he altered the balls and then tried to cover up the evidence or else I want it to go to court and let the chips fall where they may.

Above is another example of a delusional Patri*ts fan.

Yes, this is exactly what Shady had planned. Their “plan” is working perfectly…..

  259. I presume the Pat employees Brady sent texts to have not destroyed their phones. I wonder if the NFL tried to get their cell phones.

It seems like Goodell has been reluctant to put the hammer down but he has no choice.

  260. This has to be the all time record for replies 424 in just 2 hours. I just got in to be the last, but I’m thinkin’ maybe 100 more.

  261. This appeal would have never happened if Goodell had simply said..

If during the appeal we collect more evidence we can potentially add weeks to the suspension.

Case closed 4 weeks…done. We could have all been saved the cheater’s drama.

  262. What is worse Brady cheating, or Brady being so arrogant to think he can get away with destroying his phone?

Bellichek should have been suspended as well. He led all the Pats fans down the ideal gas law path. Everybody knew the only way those balls can get under inflated is if the ball boys are involved.

  263. You can’t blame Brady. He simply assumed that the NFL would cover up the evidence just like Spygate. He has known ever since the tuck rule there are NFL rules and there are Patriot rules.

  264. So Brady was punished 4 games for his participation in deflategate and not cooperating. Brady hasn’t been punished yet for destroying evidence. That’s got to be worth an additional 8 games if not more.

  265. How is this anymore relevant than Brett Favre just outright telling the NFL no you can’t have my phone….and he got a $50,000 fine.

  266. There is a whole lot of wrong in these comments.

Wells report didn’t mention phone destruction because he didn’t know. He asked for the phone and was told “no”. He asked for a transcript and was told “no”.

No one at the nfl was told of the destruction until the appeal.

Why can’t Brady destroy his own phone? There is a difference between throwing a phone against a brick wall so it won’t work, and permanently and completely wiping all data.

Will the phone destruction play badly in the lawsuit? It may not even be relevant. The first point of challenge is likely to be purely whether Goodell has the authority (and no controvening conflict of interest) to even do the appeal. Brady has to win that in court, and only then does it even matter what evidence there is or is not.

  267. I love the Pats but this is embarrassing and shameful. Brady could have won those games without cheating so I don’t get why he did this when looking at the big picture. Why take a risk like this when you are the best QB in the league with the best coach?

This story was pretty suspect in the beginning but I was still backing my team. Now with the destroying the cell phone conveniently after meeting with Wells, this is beyond denial now.

I still love my team but am ashamed.

  268. I’m just waiting for the “Tell All Book” from the dismissed ball boys ! Now that they are unemployed, can you imagine the number of phone calls or texts (presumably on their *new* cellphones as their old ones may have accidentally been destroyed…………..) Regardless, they must be receiving a great many calls that will pay them a handsome dollar for their respective stories about “how” & “why” the balls got deflated. I’m getting my Popcorn Ready !!! lol

How convenient you forgot to put in the part that Brady says he does this periodically, when he gets a new celphone. Either him or his assistant do it….sucks to be the NFL, this is going to court. and brady is going to get off….
    ———
Yeah, that’s the ticket… A new excuse (lie) is born. You pats fans are as pathetic as the pats organization itself.

  271. Goodell is the last person you want to show your phone to. I doubt if Gisele ever saw it, either. I know nobody gets my phone. If you do let people look at your phone, my advice is to get a life. I guess what I’m saying is, even tho I’m innocent, if you want to see who and what I texted contact the NSA. Otherwise, you’re flat outta luck.

  272. Does a man “who say he didn’t do anything” destroy the only evidence that could prove his innocence? I think not. I think Brady’s arrogance should earn him another 2 games suspension…. jerk.

  273. According to the NFLPA, the NFL already has the phone records that they asked for. The NFL is not about seeking the truth and doing what is right but instead swaying public opinion to cover their own butts.

    NFLPA Statement
“The fact that the NFL would resort to basing a suspension on a smoke screen of irrelevant text messages instead of admitting that they have all of the phone records they asked for is a new low, even for them…”

  274. Reserving judgment until its seen what the NFLPA is talking about in terms of phone records. Leagues already said two different things about this that were lies so not getting excited again until the whole story is out.

  275. Goodell is the last person you want to show your phone to. I doubt if Gisele ever saw it, either. I know nobody gets my phone. 276. I hope by now somebody has pointed out that the data isn’t destroyed just because the phone is.

    Duh.

  277. I highly doubt the NFL has the “phone records” they want.

My searches on the subject could not find ANY carrier that kept the actual text messages for more than 2 weeks. The meta data (what # you called, what time etc) is kept indefinitely but not the actual message. Some in Congress are trying to change that to further aid law enforcement.

Anything kept on the “cloud” is done by your phone not your carrier. So if they want to know what the texts actually said, not just that they were to the equipment guy, they need the phone. It appears Brady and his lawyer knew exactly what they were doing.

  278. Well then I guess what Goodell is saying is, “Fine, then have a nice time watching the first 4 games from home.”

    See how that works?

Yep, just how it worked against the Saints players.

  282. HEADLINES – BRADY DESTROYS PHONE!

Nothing changes the 19 January, 2015 OFFICIAL LETTER sent to Mr. Kraft from the senior vice president of NFL operations (David Gardi) that informed the Patriots that an investigation will be conducted.

WOULD YOU PROVIDE YOUR CELL PHONE TO FOLKS THAT ARE NOT TRUTHFUL (19 Jan. letter)???

    1. FACT: On page two, the letter states the following: … “each of the Colts’ game balls that was inspected met the requirements set forth.”

Accordingly, that statement turns out to be totally not true. Page 8, of the Wells report confirms that 3 of the 4 Colts’ footballs were in fact deflated.

    2. FACT/QUESTION: Who directed, at halftime, to STOP testing the Colts’ remaining 8 footballs at half-time (only four balls tested, 3 found deflated)?

    3. FACT: Ideal Gas Law (IGL) cannot be disputed.

    4. FACT: The NFL did not record pre-game PSI levels.

    5. FACT: The NFL had no procedures/protocol to determine PSI levels, UNTIL RECENTLY.

    6. When is the last time you heard the media or public discuss the 19 Jan. 2015 letter???

    7. FACT: This is America! The Missouri Supreme Court ruled in May, 2015 against Goodell: ….“the terms of the contract designating the NFL commissioner, an employee of the team owners, as the sole arbitrator with unfettered discretion to establish the rules for arbitration are unconscionable and, therefore, unenforceable”.

  283. Funny that all you clowns are celebrating Roger Dodgers appeal denial.

Did any of you really think he was going to shoot down anything he had already decided to believe.

He will nevber admit that he is wrong.

The court will prove him so again.

None of that is accurate at all, but what do you expect? The yahoos are out in full force today.

Tom Brady: the only player in history who’s life has been ripped apart simply for being accused (not even found definitively guilty) of something that is the NFL equivalent to jaywalking. A 25K offense at best.

    ———————————————-

The Patriots are Super Bowl champions and the Giants haven’t made the playoffs in years.

That’s the only factual retort needed to respond to this horribly inaccurate waste of typing.

  286. So how come he is not nullifying the Super Bowl and the AFC Championship game? According to him they were cheating. Cheating nullifies wins. Have a meeting of the Owners and vacate these wins!

  287. Tom Brady destroyed the phone not because of Deflategate; he destroyed it because there were incriminating text messages between him and Gisele’s twin sister.

  288. It’s amazing how willfully ignorant Patriot fans are being, Brady sends text messages calling Mcnally “the Deflator” and Pats fans buy the claptrap about it being because he lost weight. Now it comes out that Brady destroyed his phone on the same day Wells and co ask for his text messages and patriot fans claim it’s a coincidence. But I guess to the average Pats fan winning championships is more important than facing reality.

  289. Why did the appeal hearing taking 8 hours???
Didn’t it start with, Tom where is the cell phone?
Gee, I destroyed it. What could they have possibly discussed for 8 hours????

    Oh, I know.
Mr. Goodell, Tawhmy is a great player. He doesn’t deserve this. Sure…Sure…Lance was once great as well.

  290. So many sheep here… Let’s see what happens in court. If he was so guilty, why would he take it to court. This is just the start ladies, save your blowhard crap for another few months.

  291. King..

Why would Brady take it to court if he was so guilty???

    I will answer that.

Thieves and cheats are usually not too bright, or they are so arrogant they won’t accept the truth. Brady is 2 for 2.

  292. King as many real lawyers have said it is going to be really hard to get an injuction so he can play until it plays out in court. These are actual lawyers saying it not people on here. Courts don’t really like to step in on CBA issues because that is why the CBA is there and what is the point of havinh one if you can just take everything to court. His best option would be to admit guilt and take the reduced suspension. Goodell has already said that option still exsists because of the court filing by the NFL. That is also going to go in the NFL favor that they did everything in their power to settle this out of court where everyone can walk away with at least some of what they want. Lawyers have given Brady a less then 25% chance of this turning out in his favor. The CBA is there for a reason and Brady was one of the leaders in getting people to sign it

  293. Wells did not want the cell phone. Now Goodell wants it? It’s not about the balls deflation and integrity of the game anymore. Nothing was wrong with the balls so Goodell is shifting the argument. Brady gave them the lists they wanted. Wells did not require him to turn over his phone and Wells can’t even if he demands it. The NFL already has the ball boys phone. Whatever Brady said to them is there already. Goodell is hiding his incompetence by invoking the now deceased phone.

  294. This is pathetic. Did Brady exchange his phone or as the NFL put it “destroyed” the phone? The word “Destroyed” alters the perception of the individuals that are challenged in the area of critical thinking.

  295. Thank You Goodell! Brady is a cheat and a coward. Where’s Tommie boy’s Dad to defend the destroying of the phone? Kraft has gone from being embarrassed by his players, to embarrassing himself.

  296. Tom Brady*

    New England Patriots*

Repeat cheaters, cancel their season they got off easy. This would be like finding out A-ROD is juicing again. They do not follow the rules and they need to be penalized. Swallow the pill and move on. In Jerra’s words, sometimes you have to accept it for the greater good. Time to live up to your own word’s Kraft.

  297. I love how the NFL got exactly the narrative they wanted, and everyone is eating it up. They leak to Steven Smith about the phone, get everyone talking about it, then five hours later, release a statement about it. The leaks in the NFL offices are atrocious, and throughout this case, it’s been all about protecting the NFL’s image.

No one notices in the decision that it’s no longer a punishment about the deflated footballs, but now it’s about the destroyed phone. They leave the information about how Brady provided them access to his cell information and emails, but that the NFL didn’t put the leg work in to obtain that information in a footnote. Most people miss it. The NFL could have obtained everything they wanted from Brady, but they didn’t want to do it.

The NFL has played the media like a violin. And all of the fans are eating it up.

Don’t look at our incompetence, look over here! Tom Brady destroyed his phone! He’s evil!

Well played, NFL. The court of public opinion is on your side, let’s see if you can get the federal court on your side, too. Because if your case was as strong as you led everyone to believe, you wouldn’t have immediately filed with the courts after your appeal. That, to me, spoke volumes about the NFL’s case. It’s all about pointing the finger at Tom Brady rather than at their failed policies. Better for Brady to be the villain than for the league to be a bunch of morons.

  298. Innocent people do not destroy exculpatory evidence, the guilty destroy incriminating evidence all the time, see Hillary Clinton’s private email server as an example of that.

  299. Nothing changes the 19 January, 2015 OFFICIAL LETTER sent to Mr. Kraft from the senior vice president of NFL operations (David Gardi) that informed the Patriots that an investigation will be conducted.

    3. FACT: Brady’s telephone records were produced at the hearing which showed the time and date of every text and phone call and the identity of Patriots personnel and anyone else involved in those texts and phone calls. King Roger stated it wasn’t practical to review all of those texts and phone calls.

    4. FACT: Ideal Gas Law (IGL) cannot be disputed.

    9. COMMENT: As stated — Wells never asked for Tom Brady’s cellphone, and didn’t require it. “Keep the phone,” Wells told Brady and his agent. He insisted that his investigation was thorough without it. “I don’t think it undermines in any way the conclusions of the report,” he said. Those were his exact words. So were these, after interrogating Brady for more than five hours: “Totally cooperative,” Wells said of Brady’s

  300. Ouch. That’s got to hurt NE fans. I wish I could say I feel sympathy but they acted so ignorant that I don’t. Long live the ****

    ————-
Despite numerous comments like the above, I dont know many Pats fans that expected anything different than Goodell upholding the 4 games and then Brady/NFLPA taking it to court. Reducing it to 1 or 2 games wasnt going to be enough for Brady and would have made the NFLs already weak case even weaker in the courts. So anyone with a functioning brain fully expected this ruling.

  301. This really isn’t about footballs anymore. This is about the ball boy ducking into the restroom with the footballs. It is about the Patriots firing two employees, it is about the text messages back and forth between the employees and the quarterback and the cover-up. ‘Deflator’ and weight loss? Please!

And for those who are citing ‘FACT’, can anyone really say at this point they know for certain what all the facts are?

Brady and his attitude deserve 4 games minimum.
