Roger Goodell upholds Tom Brady’s four-game suspension

NFL Commissioner Roger Goodell has upheld the four-game suspension of Patriots quarterback Tom Brady over Deflategate.

In a ruling announced today, the league said Goodell has denied Brady’s appeal.

“NFL Commissioner Roger Goodell upheld today the four-game suspension imposed on New England Patriots quarterback Tom Brady on May 11. Brady’s appeal ‎from that discipline was heard for more than ten hours on June 23,” the league’s statement said.

“In the opinion informing Brady that his appeal had been denied, Commissioner Goodell emphasized important new information disclosed by Brady and his representatives in connection with the hearing.

“On or shortly before March 6, the day that Tom Brady met with independent investigator Ted Wells and his colleagues, Brady directed that the cell phone he had used for the prior four months be destroyed. He did so even though he was aware that the investigators had requested access to text messages and other electronic information that had been stored on that phone. ‎During the four months that the cell phone was in use, Brady had exchanged nearly 10,000 text messages, none of which can now be retrieved from that device. The destruction of the cell phone was not disclosed until June 18, almost four months after the investigators had first sought electronic information from Brady.

“Based on the Wells Report and the evidence presented at the hearing, Commissioner Goodell concluded in his decision that Brady was aware of, and took steps to support‎, the actions of other team employees to deflate game footballs below the levels called for by the NFL’s Official Playing Rules. The commissioner found that Brady’s deliberate destruction of potentially relevant evidence went beyond a mere failure to cooperate in the investigation and supported a finding that he had sought to hide evidence of his own participation in the underlying scheme to alter the footballs.”

For Brady, the next step is either to accept Goodell’s ruling or to take the NFL to court. A lawsuit appears likely.

Sad day for Patriot fans I’m sure………I still wanted to face him come September 20th, if we win without him, it won’t be the same, plus I didn’t want to hear any excuses. Best of luck Patriot fans, long season and I’m sure we will hear more about this in the coming weeks.

  7. Please someone answer the question: why were the footballs not deflated, if we accept the memory of the head ref as to which pressure gauge he used? The Patriots footballs lost, on average, 1.01 psi of pressure as they cooled over 20 degrees, EXACTLY as the MUST, in our universe, because of the ideal gas law.

  12. Based on the deliberate destruction of evidence (the cell phone) that had been specifically requested I would say Brady is fortunate it is only 4 games. In legal terms it is a spoliation of evidence that would allow drawing an adverse inference against the party destroying the evidence. In English that allows the commissioner to assume he destroyed it because he had something to hide. I know many judges who would have thrown the book at him for that act alone.

    3).Chris Mortenson reports 11 out 12 balls. Sal Pal reports owners are pressuring Goodell then retracts the statement. Stephen A. HEARS something but doesn’t know for sure.
    Let’s wait a few days before we jump to conclusions either way

    The most suspicious thing, though, is how Steven A. Smith had legitimate inside information.

  18. whether or not he had anything to do with the air pressure changes or nature did is a moot point. He was suspended mostly for failing to cooperate with an NFL investigation that the collective bargaining agreement that the players signed off on. Now not only has he not cooperated but he’s destroyed evidence, as much as I think he does a crappy job Roger was correct to uphold the suspension.

    Homeless people upgrade their phone every 3 years. I’m sure those with $ upgrade theirs more frequently than that. How many people have upgraded in that time frame? I upgraded my own just last week and all my old texts are gone now. Guess I was hiding something from Roger as well.

    I have to admit that you need to give Roger credit. He’s doing everything he can to spin this in his favor.

This could all have been dealt with with a simple policy change, but instead it’s turned into a year-long scandal that makes everyone connected to this – first and foremost, the champion of the league – look ridiculous.

    It seems as though Goodell’s job, first and foremost, is to *prevent* things like this happening and getting out of control. Instead, they’ve *caused* it.

  26. I believed that Brady had a fairly good chance at overturning the decision should he appeal to court. Now that he has
    admitted destroying evidence I no longer believe that an appeal would be successful. Once a party knows or should have known that evidence
    is relevant to the controversy, that party has a duty to preserve it. I would believe that no judge would allow a party to succeed in an appeal where the appellant willingly destroyed relevant evidence. Brady’s move was dumb and it also saved the NFL from an embarrassing appeal.

    When the CBA and each player’s contract stipulates that it must be surrendered upon request as part of an investigation, then the right was there. They even made it lax enough to say ‘Just surrender hard copies of any relevant texts, we don’t need your actual phone, and we’ll be satisfied.’ and he did not comply. That is the main reason for the punishment: Obstruction of the investigation.

  41. What really doesn’t make any sense is WHY the NFL allows the Teams to do anything with the Balls. MLB supplies the balls, NBA supplies the balls….don’t know what you’d do to a Hockey Puck.   49. The phone connects Belicheck and that’s why Brady will never go to court. It’s a far gone conclusion that Brady’s phone contained texts related to the deflation of the balls.

    That actually becomes secondary. Brady surely told his coach what was brewing, once they got caught and maybe even before. Anything that hints that Belicheck knew, means he would be severely hit by the league, possibly up to banishment.

    Further, the case will no longer be solely about whether Brady’s punishment is commensurate with the alleged deflation of footballs. It now is also whether his punishment is commensurate with an employee who openly defied his employer and failed to comply with the collective bargaining agreement. Good luck with that in court.

    Brady dug his own grave if he destroyed the phone. He gave the league no choice but to suspend him. And it explains why Kraft backed off.

    You, and many others, just don’t get it. NONE of the above by you matters. We are beyond the footballs now. This is about not cooperating with an internal company investigation. Do you have the legal right to not cooperate? Yes. Does the company have the legal right to then discipline, and or fire, you? YES!!

  69. Why would he destroy the phone if there wasn’t something on there that would incriminate him? That’s the reason his suspension wasn’t overturned or reduced. I personally think there was SOMETHING that happened purposely to those balls but I don’t think it would have effected the outcome of the game.   80. If Brady’s going to be suspended for his role in deflating footballs, how come the referees (who handle the ball on *every* play) aren’t getting suspended? Are we actually supposed to believe that it took a Colts player pointing out how underinflated the football was for the refs to notice?

    It’s much more likely that the refs noticed and chose to do nothing about it. But, if Brady’s done for 4 games, there needs to be an inquiry into how/why the refs didn’t notice the underinflation and/or didn’t take action before the Colts’ pick.

  82. If there is any question as to whether or not Brady is guilty, it has now been answered. There would be no reason to DESTROY the cell phone unless he didn’t want people to see something.

    Therefore, the preponderance of the evidence is clear in my opinion, not that my opinion means anything. However, there is no reason to support Brady’s claim of innocence.

    Well, then you don’t work under the same collective bargaining agreement as the one between Tom Brady and the NFL. Under that agreement, Brady was obligated to cooperate with the investigation; including the examination of his phone. Meaning that he waived any privacy rights to information on the device relevant to the inquiry.

    Besides, Brady never even took the position that the NFL wasn’t entitled to see his phone–he knew better so he destroyed it. He’ll get laughed out of court if he tries to make the argument now.

If Brady sues – and the case doesn’t get dismissed early, Tommy has to sit down at a conference table in his lawyer’s office, raise his hand to tell the truth and then get grilled for up to 8 hours on videotape.     Destroying a phone doesn’t erase phone company records of texts, fools. And those to employees would be called to testify under oath.

  91. Why has Belicheck been given a pass? Sean Payton got a whole year for Bountygate when he told Goodell he knew nothing about it. Goodell said “Ignorance is no excuse.” Why hasn’t Belicheck been suspended when he said he didn’t know anything about deflated balls. I’m sure the texts on that phone would implicate Belicheck. Well Roger? What’s the deal?

    Wait, I’m an admitted Pats fan, but this is insane. For months, this whole thing was about the fact that Brady “cheated”. Now, science proves that the air pressure was reduced naturally and Brady didn’t cheat, so it’s about the fact that Brady didn’t cooperate? Which one is it?

    If it’s the cooperation, show me where in the rule book that it says a player who doesn’t cooperate gets a four game suspension.

  95. The entire Pats organization and especially their fans blew this all out of proportion. The Pats had the angry and defiant press conferences complete with Bill giving his woeful misinterpretation of science and Bob angrily demanding press conferences. Then there are the Pats fans spamming every single thread of every sports talkboard whining about the controversy and slandering the Colts. The Pats agreed to the investigation but flat out refused to cooperate one iota. Then Brady inexplicably destroys the phone

    No wonder the punishment was so high and upheld. The NFL was forced to save face and stand firm in the punishment. Brady would have received a slap on the wrist if not for the non-cooperation and intentional obstruction of evidence.

It took ten years of SO MANY excruciating, heartbreaking, soul-deflating losses in big games, before the Patriots won another Super Bowl; yet to hear the fans on here, it would seem they have won them all and it’s a FORGONE (not ‘far gone’) conclusion that they will destroy everyone en route to another one in 2015. And now, as the final decision has been levied and Mr. Brady has shot himself in both feet in regard to any legal recourse, the delusions persist: “see you in court,” etc. Just, please, accept it and move on.

    I am so tired of this story, and I am not upset about the “cheating” either – that was a great Super Bowl and the team I root for came up THAT short, but it was an amazing thrill ride the whole way, right up to that Beckham-force kick to the groin that was the goalline interception. No sour grapes, no excuses, no worries. They won, fair and square, no doubt (leading up the game, I mean; obviously they were extra-scrutinized for Super Bowl). That’s the reality of it, and (most) Seahawks fans have no problem accepting it. The true stain on the game is the entitlement so many Patriots fans feel and their whiny bs in trying to spin it.

    The true humor in it all is how all these loudmouth idiots are suddenly science experts, trying to school everyone on the Ideal Gas law. Sorry, Good Will Hunting was a fictional character, and did not magically impart wicked smarts to you all. A little knowledge is a dangerous thing, come back when you actually attend college, not just hit on girls at townie dives.

    Why did he destroy it? Try this – text messages are private, meaning that they’re no one’s business but that of the sender and the receiver.

    Given that – is there ANY one out there who is so naive as to believe that if Brady had actually surrendered his cell phone to the ‘authorities’ that the contents would not have been leaked to the gum-chewing public (us) within 2 or 3 days at the most? Is that information any of our business? No.

    Finally, (this is directed to the most fervent haters, and you know who you are) – who among you would surrender his or her cell-phone with all its PERSONAL AND PRIVATE information to someone, and would you be so naive as to believe that that someone would respect your privacy?

  105. Ok, let’s be honest Tom Brady isn’t being punished for deflating footballs he being punished for destorying his cell phone. When this frist started I thought it was funny. But, now I don’t know. In my heart of hearts I believe that Pats tampered with the footballs. And, I also believe that there not the only one guilty of doing this. I think if TB would have just come across board when this frist happen then there would have been a warning and we would have just moved on.

  106. If an injunction is granted preventing the suspension until the case is completed, could Roger Goodall place Brady on the Commissioner’s exempt list?

    Tom would get paid but not be able to play.
