Tom Brady’s agent calls NFL appeal process “a sham”

After NFL Commissioner Roger Goodell upheld Tom Brady’s four-game suspension, Brady’s agent ripped the decision.

In a statement distributed this afternoon, agent Don Yee called the league’s appeals process “a sham” and insisted that Brady has done nothing wrong in Deflategate.

“The Commissioner’s decision is deeply disappointing, but not surprising because the appeal process was thoroughly lacking in procedural fairness,” Yee said. “Most importantly, neither Tom nor the Patriots did anything wrong. And the NFL has no evidence that anything inappropriate occurred.

“The appeal process was a sham, resulting in the Commissioner rubber-stamping his own decision. For example, the Wells investigative team was given over 100 days to conduct its investigation. Just days prior to the appeal hearing, we were notified that we would only have four hours to present a defense; therefore, we didn’t have enough time to examine important witnesses. Likewise, it was represented to the public that the Wells team was ‘independent’; however, when we requested documents from Wells, our request was rejected on the basis of privilege. We therefore had no idea as to what Wells found from other witnesses, nor did we know what those other witnesses said.

“These are just two examples of how the Commissioner failed to ensure a fair process.

“Additionally, the science in the Wells Report was junk. It has been thoroughly discredited by independent third parties.

“Finally, as to the issue of cooperation, we presented the Commissioner with an unprecedented amount of electronic data, all of which is incontrovertible. I do not think that any private citizen would have agreed to provide anyone with the amount of information that Tom was willing to reveal to the Commissioner. Tom was completely transparent. All of the electronic information was ignored; we don’t know why. The extent to which Tom opened up his private life to the Commissioner will become clear in the coming days.

The Commissioner’s decision and discipline has no precedent in all of NFL history. His decision alters the competitive balance of the upcoming season. The decision is wrong and has no basis, and it diminishes the integrity of the game.”

Although Yee’s statement doesn’t say so, Brady is expected to take the NFL to court in an effort to have the suspension overturned.

  4. This is all about power and Goodell’s god complex. The NFL has no right to Brady’s personal phone. Any texts they were interested in would be on the receiving party’s cell phone anyway. This maneuver is another sleazy attempt by Godger and the NFL…it actually makes me despise him.

    The NFL is coming perilously close to extinction under the watch of the man empowered to enhance it. Hater or Pat lover, nobody should be happy about the inept way this whole thing has been handled, I’m now waiting for the NFL to investigate the overinflation of Aaron Rodgers’ footballs….god help us,

  5. Remember, Goodell is fighting over 0.4 psi deflation that likely didn’t even happen, to protect the integrity of the game from the reigning SB MVP who won with league approved game balls. It’s like a pilot responding to reports that someone might have smoked in a bathroom by crashing the plane just in case.

  6. I call the destruction of evidence “obstruction of justice” and recommend increasing the length of the ban. That would certainly APPEAL to me.

  10. The telephone company does NOT have records of text messages sent.

    Verizon is the only one of the top four carriers that retains text message content, however, and it keeps that for three to five days. Call detail records, meanwhile, are retained for one year by Verizon, five years for T-Mobile (two years for pre-paid), five to seven years for AT&T, and 18 to 24 months for Sprint.

    So his phone was the only source for those messages and that is why he destroyed the phone.

  12. What appears to be over looked is that the League was in possesion the PHONES of the Patriots two employees who actually may have deflated the balls. Any text messages from Brady would have been on their phones, thus no real need to see what Brady’s phone may have revealed.

That said I really feel that this issue has lacked transparency and the NFL has been responsible for the clouds of uncertainty clinging to this matter. I have no idea at the end of the day whether Brady is innocent or guilty but its time to bring everything out into the light of day. I want to see this unprecedented amount of electronic data. I want to see what Wells is hiding. I want to see what Brady is hiding. There is not a single person in this mess that I trust to tell the truth.

    Yee – you have yet to do anything to help your client. At some point you may want to just be quiet.

  17. Brady was hoping he could finish out his career without “certain” things coming to light. For a long time the patriots were the NFL’s golden child and they proved it by making sure the spygate tapes were destroyed. It was becoming obvious to even the most casual fan that the NFL’s image was becoming tarnished.

    Here is the thing, the balls air pressure was NOT that bad however I think after all the different situations where the patriots skirted the rules, they had to draw a line in the sand and the patriots defiantly stepped right across.

    I have a bad feeling, as much as I love pro football, many more things will come to light and sadly it will probably be years after Brady is gone and Belichick has departed. When that time happens the sport itself will take a huge credibility hit.

    No thanks, i’m fine. It doesn’t matter if he destroyed his phone, all the same texts would have also shown up on the recipients phone. You know, cause that’s how phones work. He called himself the Deflator in May. How much NFL is going on in May? Somewhere around none to none. He’s not deflating balls in May. You’re right, he didn’t steal the bag. It’s on video that he simply took the bag like he usually does… while the refs were in the room with him. Hardly sneaking around, stealing balls if the refs let him go out with them.

  55. The sad thing, the agent thinks Brady did nothing wrong. He destroyed evidence that was requested by the investigation. If he was so hell bent on clearing his name he would give the NFL permission to look at transcripts from text messages which can be retrieved from the cell phone provider.

  76. He can’t put the toothpaste back into the tube. His only winnable options were 1. Deny any involvement and show the NFL had no evidence to punish him, or 2. Accept some degree of responsibility and either take the full suspension or argue for some sort of reduction. Instead, he chose a dangerous third course which was never denying anything while simultaneously wanting all punishments be wiped away. And that one totally blew up in his face.   79. Back to basics. 1) You need both phones because text messages can be deleted. Depending on what type of phone you have the message may or may not be forensically recoverable.     Are they serious with this? Why would they tell you what the witnesses had to say? So you can figure out what lies you need to tell to counter act what they said. Of course they didn’t tell you. No investigator in their right mind would.

    He seems to think it’s like two lawyers in the courtroom. That they have to share all information. Sorry guys you’re skipping a step. The part you were in was the interogation phase. You know the part where they separate you and don’t tell you what the other guy said so they can catch you in a lie or contradiction? The same part where they tell you the other guy said this or that to try to trip you up? The whole point of it, besides getting a confession, is to catch you off guard. To break up whatever stories, if there are any, that you and your co-defendants decided to tell during questioning.

    Its all designed to get at the truth. Sorry but trying to find out what everyone else said before you make a statement is an act of a guilty man. If you were telling the truth it wouldn’t matter what anyone else said.

    None of this proves guilt, but it is another piece of circumstantial evidence that seems to point in that direction.

    Think of this, if Wells would have told Brady and his agent everything everyone else said and Brady found out no one ever said anything about him asking people to destroy their phones would he have ever admitted to it?

    Yea that’s what I thought too.

  88. It is a sham. You shouldn’t be able to be both judge and appeal judge.

    But for me, the biggest sham is that he wasn’t suspended for a YEAR. He clearly cheated to move on in the playoffs (and worse, likely didn’t have to). That to me is worse FOR THE GAME (not in society) than any off the field item. He should have been suspended as long as Sean Payton.

    Brady was never under oath before the appeal, and then he was under oath voluntarily. It probably went something like this:

    Goodell (or more likely, an underling): “Mr. Brady, do you swear to tell the truth, the whole truth, and nothing but the truth, so help you God?”

    Brady: “I do.”

    Goodell: “I want your phone.”

    Kessler: “I object!!! Per the CBA, you are not allowed access to a player’s phone!!! This is another cheap fishing expedition!!!!”

    Brady: “I got this, I’ll answer. Truthfully, I don’t have the phone.”

    Goodell: “Why the [edited] not?”

    Brady: “I had it destroyed when I got a new one. It’s what people like me do.”

    Goodell: “WT [edited]?!?!?!? How come I don’t know about this?!?!?!?”

    Brady: “You see, when actual stars or celebrities get new phones, it is common practice to destroy the old, since any as…terisk out there might try to get access to it, for the purposes of defamation of character.”

    Brady: “You did say that you want a ‘fair and open’ process…”

    Goodell: “I think that you’ll find that what I meant by ‘fair and open’ is that as a ginger, I have fair skin and that since my mind is a sieve, everything passes through it, like an open flood gate…oh, wait…transcriptionist, don’t include that…”

    Kessler: “We’re through here…Roger…I look forward to our next meeting. Please arrive with your shorts about your ankles, you’ll find it easier to reel your junk…arguments…that way.”

    Goodell: “I’m on it…oh, wait…transcriptionist…”
