Tom Brady: I’m very disappointed, I did nothing wrong

Patriots quarterback Tom Brady has issued a statement denying any wrongdoing in Deflategate, and decrying NFL Commissioner Roger Goodell’s decision to suspend him for the first four games of the season.

“I am very disappointed by the NFL’s decision to uphold the 4 game suspension against me,” Brady wrote on Facebook. “I did nothing wrong, and no one in the Patriots organization did either.

“Despite submitting to hours of testimony over the past 6 months, it is disappointing that the Commissioner upheld my suspension based upon a standard that it was ‘probable’ that I was ‘generally aware’ of misconduct. The fact is that neither I, nor any equipment person, did anything of which we have been accused. He dismissed my hours of testimony and it is disappointing that he found it unreliable.

“I also disagree with yesterdays narrative surrounding my cellphone. I replaced my broken Samsung phone with a new iPhone 6 AFTER my attorneys made it clear to the NFL that my actual phone device would not be subjected to investigation under ANY circumstances. As a member of a union, I was under no obligation to set a new precedent going forward, nor was I made aware at any time during Mr. Wells investigation, that failing to subject my cell phone to investigation would result in ANY discipline.

“Most importantly, I have never written, texted, emailed to anybody at anytime, anything related to football air pressure before this issue was raised at the AFC Championship game in January. To suggest that I destroyed a phone to avoid giving the NFL information it requested is completely wrong.

“To try and reconcile the record and fully cooperate with the investigation after I was disciplined in May, we turned over detailed pages of cell phone records and all of the emails that Mr. Wells requested. We even contacted the phone company to see if there was any possible way we could retrieve any/all of the actual text messages from my old phone. In short, we exhausted every possibility to give the NFL everything we could and offered to go thru the identity for every text and phone call during the relevant time. Regardless, the NFL knows that Mr. Wells already had ALL relevant communications with Patriots personnel that either Mr. Wells saw or that I was questioned about in my appeal hearing. There is no ‘smoking gun’ and this controversy is manufactured to distract from the fact they have zero evidence of wrongdoing.

“I authorized the NFLPA to make a settlement offer to the NFL so that we could avoid going to court and put this inconsequential issue behind us as we move forward into this season. The discipline was upheld without any counter offer. I respect the Commissioners authority, but he also has to respect the CBA and my rights as a private citizen. I will not allow my unfair discipline to become a precedent for other NFL players without a fight.

“Lastly, I am overwhelmed and humbled by the support of family, friends and our fans who have supported me since the false accusations were made after the AFC Championship game. I look forward to the opportunity to resume playing with my teammates and winning more games for the New England Patriots.”

Although Brady didn’t specifically say so, his next step will be to go to court to attempt to have his suspension overturned. This battle isn’t over, and Brady doesn’t sound ready to give up the fight.

    If you think Brady was a cheater – you still think he was a cheater. If you dont – you still dont. No change there.

    But yeesh, the NFL can not be thrilled with the idea of being dragged into court – under any circumstances. No matter what happens, it just cant be good for Goodell and his cronies.

  12. So this was NO last minute shock new development, the matter of the phone’s destruction but was known to Wells all the time. This follows a disturbing similar arc to the falsified 2 psi lie at the beginning of this fiasco: (1) a shock headline grabber confirms what all Pats haters think anyhow (and I admit, even gives Pats fans 2nd thoughts) is released then (2) a day, week or so later the truth comes out. Like the retraction that is hidden on p. 30, no one pays any attention to that, just the shock spin. The fact that Goodell was desperately shocking for a special court that he can steer the same way he leads ESPN by the nose as his own personal misinformation propaganda machine indicates his (lack of) confidence of how he’ll do in BRADY VS NFL. The discovery phase will be interesting, just to see the number of drunk dial demands for action from Irsay to Goodell.

    Uhhh, that’s not how the process works. Just because your lawyers are making a particular argument that relevant evidence shouldn’t have to be turned over doesn’t mean that destroying it is OK. Notice that he doesn’t say his lawyers told him it was OK to destroy it — only that they “made it clear to the NFL” that he wouldn’t turn it over. As a lawyer, if I ever counseled a client to destroy relevant evidence, I would “more likely than not” be disbarred.

  14. The Sheep buy everything the NFL says. The phone was never going to be turned over anyways the NFL had ZERO right to it, like the NFLPA said this is just a smokescreen.

    The Sheep believed the false reports about the PSI levels from ESPN that were never corrected and now they’re falling for this smokescreen. He who laughs last laughs loudest and when this is overturned in court Brady will be laughing. This is a sham, there is no evidence, and the CBA was violated at every turn, the court will side with logic and reason and Brady will be on the field for week one.

    See on on September 10th where a banner will be raised and the GOAT will take the stage.

There are too many details that point to Brady being involved. Granted..when you lawyer up this may not be something that he is found guilty of in a court of law but where there is smoke there is fire. The owner of the Pats would not have accepted the loss of a 1st round draft pick if he had doubts of Brady’s innocence. Too many Brady fans and Pats fans are in denial.

  24. the tables were set for this when the NFL deliberately, acting with malice in order to provide the rog with a situation where he could act with favorable public support, decided not to refute the erroneous Mortensen report regarding the levels of the psi in 11/12 after the afccg.

    This has been nothing but a screw job from the outset. As a member of the NFL ownership group who paid wells, Bob Kraft should demand to see all information related to the wells investigation, including phone records and emails sent between the wells group and the League.

    I aver I believe Brady, I believe in the Patriots Organization, and I strongly believe that they have done nothing wrong.

  29. Brady is guilty of one thing – not realizing just how insane this entire process was. With 20/20 hindsight I bet he would have put the BROKEN phone into a safety deposit box or other place for safekeeping.

    He and his attorneys did not read the situation well. Even after the farcical Wells report was released and the ridiculous penalties announced he still did not realize that he was the subject of a witch hunt. Looking back that was both significant and costly.

    Every time that Goodell is given the opportunity to take a step back and actually be objective he does not – he doubles down.

I will admit I was wondering why he hadn’t spoken out before but I think in retrospect Brady was the only one to show any level of restraint in making public statements trying to sway public opinion. Facts are that the NFL did leak/release/ make public a whole lot of lies surrounding this whole affair. I also will say that I wondered if Brady wasn’t as smart as I and others thought by not saying something but I do think now that the guy really is justified in having carried himself the way he has and I also think that he is 100% confident that he did what he was supposed to do in regards to cooperating with the NFL. I really am glad this is going to court and hope that all of the buffoonery by the NFL and Goodell et al is exposed. Happy Hump Day.

  41. I am an Eagles fan. The fact that this has taken on more repercussions than Spygate is comical. If there was something to complain about and claim Tom is a cheater it was his coaches knowing defensive signals, not inconsequential air pressure in footballs. For all I know we lost our only Super Bowl appearance in recent history as a direct result of their cheating. But as an Eagles fan, I will say that Tom Brady is GREAT with or without his footballs having a minute amount of air taken out of them. I can’t see the NFL logic in this punishment for what amounts to a way lesser infraction than that of receivers using unauthorized gloves to catch. It’s a uniform infraction at most. Goodell has to go, and soon. This league is becoming unsupportable.

    As a life long Patriot fan I am able to admit that the optics of this look bad for Brady. It has always been my opinion that Brady was up to something. Maybe it was as simple as putting pressure on the equipment guys to get the footballs just right. Maybe it was as direct as him telling the equipment guys to deflate the balls after the refs inspect them.

    But at this point am I the only one concerned about the league’s well timed public release of information? Going back to the original information about the deflated balls, which we now know was innacurate, the NFL seems to be more concerned with swaying public perception than providing accurate information.

    Again I am not arguing that Brady is innocent in all of this, because I really don’t know. But Brady has no history of lying. Roger Goodell? He lied publicly after the Ray Rice investigation and it has also been proven that the bounty-gate investigators severely misinterpreted evidence.

    I just don’t know how anyone can take anything either side says seriously at this point. And I definitely don’t know how anyone can give the league and Goodell the benefit of a doubt in all of this.

  54. Is there any good that comes out of this for Brady? That explanation for destroying his cell phone is a total crock. If he sues the NFL his attorneys know that phone becomes a key piece of evidence and they will be forced to allow NFL investigators to look at it. The league has a right to defend itself and the contents of the phone are critical to that. There’s no other plausible explanation for destroying the phone other than an attempt to conceal evidence. Only a guilty person does that.

    If he continues to hide behind his attorneys and the union he furthers tarnishes what would otherwise be a great legacy. Dislike Goodell all you want but Brady is in the wrong here.

    most common sense people think that when a guy named the deflator walked into the bathroom before game in which balls are found to be deflated, plus adding all the other circumstantial evidence into factor, and he was probably guilty

    I am still confused why if they have the records from the “so called” conspirators, what the value of his messages would be to the investigation?

    I have had the feeling that the NFL is stuck in the 50’s in them methods and sophistication since this started. First they are not using modern technoology and processes to protect their won product. Second, the senders phone must have more details than the recievers phone.

    The shocking part of this to me is the NFL is not protecting their own team or players, ultimately their product.

    1. They have limited evidence of any wrong doing, admit that and move on.

    2. They had poor processes in the management and monitoring of game balls and lack of understanding what happens to the air pressure, admit that and move on.

    3. If the NFL thinks it is so easy to negotiate favorable terms in the CBA, make sure in the next CBA all the hindrances to these investigations are addressed, such as turning over personal property etc….., and move on.

    I feel as thought there are no adults running the NFL. Most parents of young children would have been done with this before Super Bowl kick off. Instead we have war, dissolving the value of their superstars.

    Move on.

  65. Tom Brady lied and obstructed an investigation. Roger Goodell has no consistency in handing out punishment. In this case however Roger had no choice. If it got out that Brady destroyed the phone at the time of the investigation and the NFL did nothing about it (or at least tried), everyone would scream bias. If Brady just cooperates in the first place, this whole thing is finished long ago.

    Uhhh, that’s not how the process works. Just because your lawyers are making a particular argument that relevant evidence shouldn’t have to be turned over doesn’t mean that destroying it is OK. Notice that he doesn’t say his lawyers told him it was OK to destroy it — only that they “made it clear to the NFL” that he wouldn’t turn it over. As a lawyer, if I ever counseled a client to destroy relevant evidence, I would “more likely than not” be disbarred.

    The main difference is that Brady had no requirement to turn over his phone at all and he already refused. There was no legal obligation to hold it. Still really dumb to destroy it given the circumstances even though it makes sense that is what he normally would do if switching to iPhone 6. Emails would all be available for sure, but texts would be mostly gone. He could have let it sit. If that was an innocent choice it was a bad one.

    The court isn’t going to find anything that the 5 million dollar Wells investigation didn’t find. The Wells report, by Goodell’s description, had access to all the Patriots digital media and communications. He turned over a list of people he says he texted who may or may not have the the same phone as 6 months ago and may or may not have deleted the text but all of which have ZERO reason to give their texts to the NFL.

Brady has always been an exemplary representative of this league.     6.) What did Brady and Goodell talk about for ten hours?

    This mess has gone on as long as it has because of complete lack of transparency. Brady refused to give up his phone and maybe that constitutes a lack of cooperation but what is the NFL’s excuse? Why so much misdirection and misinformation from them? We have two parties acting very, very guilty. At least one of them IS guilty. Maybe both. After dominating football talk for six months I think fans deserve some honesty and transparency.     I’d like to know more about the NFL counter offer/no counter offer. Someone is lying. Brady himself says no counter offer. “Sources” said there was. Which is it? Is anyone going to own up to being the source?

    I believe Brady was NEVER going to turn over his phone, however I don’t think it was a good idea to destroy it, at least not yet. Even being a victim of identity theft myself and one who destroys every cell phone and hard drive before disposing it – I still have the remnants of every hard drive I have ever owned, including the 105 MB (yes, MB) hard drive that I upgraded to from 80 MB because it was “all the storage you’ll ever need” – I don’t think I would have destroyed that phone. Not yet at least. It does bother me that Brady destroyed his phone.

    At the same time, it bothers me that the NFL is hanging their hat on the issue of Brady’s phone. What about what actually happened or didn’t happen? There is no transparency within the NFL. If they have nothing to hide, why didn’t they allow Brady’s team access to Wells’ interviews? Everything the NFL puts out seems to be manufactured in some way.

    I find it interesting that the same people that said Brady’s side offering a settlement was an admission of guilt also will not say that the NFL offering a settlement is an admission that their case against Brady is weak. I don’t know what is true in all this, but you can’t claim it for one side and then say it doesn’t apply to the other.

    What also bothers me is the lynch mob mentality I see on websites like this. I remember watching Superman every afternoon as a kid, with the line “Truth, Justice and the American Way” and have always thought of it as “Truth, Justice IS the American Way”. Although we Americans like to think our system of justice is better than every other country in the world, it is clear that people think that for the justice system only. People don’t actually apply it as individuals, they want it to be applied to themselves, but they won’t apply it themselves.

    I want the truth to come out, from all angles. If Brady was involved and did something, I want to know. If the league set up a sting or is out to get the Patriots/Brady in any way, I want to know. If there is corruption, I want to know. I want to know why the NFL execs can keep the secrets that they want to but not those that makes themselves look good at someone else’s expense.

    I’m going to continue supporting Brady and the Patriots……but I’m losing faith in the NFL, which really bites because I enjoy it so much.

But he and his attorneys knew that if the NFL upheld the suspension and Brady sued the NFL in federal court that the league WOULD then get access to the phone. This is where Brady’s case falls apart.     I agree with the exception of destroying his phone. He must have had lawyers involved by that point. At least his agent, who is supposedly a good lawyer. No lawyer would ever advise to destroy digital records once an investigation starts. Even if Brady had the right to do it and it was his normal process a lawyer would advise to keep it intact to avoid this exact situation. It can only make someone look guilty.

    3: That taping signals is illegal. It isn’t. It wasn’t then, it isn’t now. The penalty was for recording the signals from the sidelines, rather than a few yards further back.

    4: That there is evidence that Brady asked the equipment managers to deflate footballs. Just the opposite. In the Wells report, there is a text from the equipment managers stating that Brady wanted his footballs set to the legal limit of 12.5 PSI.

    5: That deflated footballs somehow gave Brady an advantage in the AFC championship game. Stats don’t lie. Brady scored more points and had a higher passer rating in the second half, the half in which the footballs were properly inflated.

    This case is going to court, as it should, where facts and evidence will take precedence over the biased delusional rantings of the Brady Hater cult.

    While I understand it looks bad destroying his phone, he was not obligated to turn it over. They have the text messages from the other phones, a transcript of the people he texted and when. The Wells report turned over no actual evidence that Brady did something wrong. Why can’t they investigate the information they do have? 7 months and 7 million dollars for no evidence but a report saying he probably had some knowledge or involvement. Who is to say that he didn’t destroy his phone because it had embarrassing, non deflategate content that he didn’t want others to see. On top of that the NFL JUST came out with a new policy for the game balls.. What policy (in effect at the time) did he break and please show me the hard evidence. He started talking about Jason Pierre Paul and laughing about him and calling him stupid (which I thought was pretty bad style and I’m not even a Giants fan). I did not say anything negative or accusatory or opinionated on the subject, I just brought it up. Suddenly my friend went totally crazy and blew up, accusing the NFL of lying, accusing me of stuff, talking about conspiracies, just going absolutely nuts. I couldn’t believe what I was witnessing, it was a total meltdown. And this after he dissed a player who was unfortunately injured.

    I don’t get Pats fans, they are crazy. I do understand the NFL since it is clear that they are trying to preserve the integrity of the game. I think everyone can agree that cheating should not be tolerated, and even the perception of cheating should be addressed.

    These comments are laughable. Like Goodell and the NFL, you have blown the whole thing out into Watergate.

    In baseball, foreign substances used by pitchers in game (with video evidence) is an 8-game suspension. No investigation. No invasions of personal privacy. No disgusting cheater label, just one of many pitchers trying for some extra mustard, and a suspension for around 1/20th of the season. It happens a few times a year and everyone moves on.

    Even for the big scandal in the baseball, steroids, the MLB did not suspend players without positive test. Barry Bonds was never suspended, even though there was enormous piles of evidence that convinced everyone he was on ‘roids, because they never caught him.

    Compare that to the NFL. Equipment violations happen every season. But prior to this incident there was no justification for seizing phone records for on-field violations. Now they are asking for private phone records to prove an in house rules violation? They spend 6 months on an investigation that proved “general awareness” of “more probable than not.”

    The indisputable truth of the whole matter is exactly what Florio said from the beginning: the NFL did not care about these violations prior to this game, they were not enforcing these violations, they clearly had no policy in place to assess air pressure readings throughout the game. Instead of acknowledging that no mechanism was in place to enforce the rule, they decided to back-pedal and blame Tom for not being forthcoming.

    He probably cheated, as Wells stated, but the actual truth is the violation is not a big deal, and the NFL couldn’t prove it happened. Cheating is an unfortunate but very real part of sports. The only explanation for this comment is a predisposed hatred of Tom.

  263. Ummm….I just upgraded my phone, and in every other case I’ve upgraded my phone, the text messages, contacts, photos and everything else are ported over. Whether the physical device was destroyed should be irrelevant. The texts should still be there. Give him the phone. If the texts aren’t, then Brady consciously destroyed evidence – guilty. If the texts are there like every other phone upgrade, let the evidence speak.

    Uhhh, that’s not how the process works. Just because your lawyers are making a particular argument that relevant evidence shouldn’t have to be turned over doesn’t mean that destroying it is OK. Notice that he doesn’t say his lawyers told him it was OK to destroy it — only that they “made it clear to the NFL” that he wouldn’t turn it over. As a lawyer, if I ever counseled a client to destroy relevant evidence, I would “more likely than not” be disbarred.

    Put it like this – you are not only Tom Brady, you are TOM BRADY, world famous NFL QB who has a million people wanting to get a piece of him, and some minion from the NFL wants your cellphone. Not only does he not really have the right to demand it, but there is the simple fact is that for you to hand it over implies a level of trust in the people you are dealing with.

  283. You know, as someone that’s not even really a football fan…. its quite amazing to watch the responses to this whole situation.

    I mean, public opinion seemed to be shifting in the direction of Brady for a while now…. but than the commissioner, who some felt was going out of his way to target Brady, made a questionable accusation that Brady destroyed evidence (without backing it up) and suddenly everyone is back on the “He did it” bandwagon.

    At the end of the day, the objective viewpoint is still this: There is zero evidence that anything was actually done to the footballs in that game. A couple ball boys exchanged questionable texts and Brady destroyed a phone… one he would never have had to turn over anyway. That’s the basis for all of this, because the evidence that the balls were actually tampered with is inconclusive to say the least.

    So it really is amazing how being a winner just makes people hate you. Anyone saying he’s “clearly guilty” is clearly an idiot without any reasoning skills that’s unable to form a non-bias opinion. I’m not saying he’s innocent, but as a rational person with no pre set bias, there is no way in hell to come to that conclusion.

    Oh and one more thing… when you really think about it, why would Brady destroy his phone to hide texts? The NFL doesn’t have subpoena power and would never be able to compel him to surrender his phone… and that’s true even if this goes to court. Not to mention the texts could still be recovered from whoever he sent them to. So again, what reason would he really have to destroy a phone the league would never see anyway? Again, rational thinking goes a long way.

That said, I think either BB or Kraft or both were implicated on Bradys phone records. Why else would he destroy his phone unless they were complicit with the deflating of footballs. Bradys punishment stays the same regardless and as of now he is guilty and serving a full suspension, Goodell could jave even increased his penalty for the destruction of evidence. Brady and the Pats are not naiive.

    The referees handle the footballs all the time as well, and they didn’t notice anything out of the ordinary.

    Because now Brady claims he doesn’t have the texts to turn over. At first it was ” I will not turn over the texts”. Now it is “I can’t turn over the texts but I would if i could so please reduce my suspension”.

    It falls under “not cooperating with the investigation”. While Goodell can’t compel the phone or the phone information , he is allowed to take that into consideration when determining punishment.

    At the end of the day Brady’s appeal is a lame cover up because he still did not turn over the phone or the texts from the phone. He turned over a list of people he says he texted who may or may not have the the same phone as 6 months ago and may or may not have deleted the text but all of which have ZERO reason to give their texts to the NFL.

    It’s like saying i destroyed the information but I have a list of 10,000 locations that may or may not have 1/10,000th of the information and if you go through the 10,000 locations and IF they all have the information and IF they all give you the information willingly you may possibly be able to reconstruct what I destroyed. Goodell made it pretty clear that Brady’s suspension was not as much the deflated balls, as his unwillingness to cooperate with Goodell’s goons, and perceived evidence tampering with his conveniently timed cell phone breakage. Brady (and his fans) still don’t see that’s he’s going to make matters worse for himself if he takes the fight to federal court. He’s unlikely to win unless he challenges the arbitration rules upon which his union approved. And Goodell did not violate those rules. Brady needs to shut up and move on.

    Let me start by saying I like my Job. It pays extremely well. My interest is to the NFL , ratings, and it’s owners.

    For years we have allowed the Patriots to cheat, Hell we even helped them. (tuck rule, Spygate, and overlooked other infractions) because after 911, we wanted THE PATRIOTS and THE GOLDEN BOY to be Americas team. It was good for ratings, great $, and good for America.

    Years have passed and things were good. Now, all things must eventually end. The other owners have been putting pressure on me that the cheating must stop.

    It was a good run boys but, Our interests have changed.
    King Goodell has spoken! Oh by the way Tom, it didn’t hurt that you were caught cheating.
