The immediate aftermath of the Ray Rice debacle triggered widespread speculation that the Commissioner had no choice but to yield final say over player penalties under the Personal Conduct Policy.

And then the league unveiled a new Personal Conduct Policy, with the Commissioner still having final say.

The Tom Brady suspension arises not under the Personal Conduct Policy but under the Commissioner’s Article 46 power to impose discipline for conduct detrimental to the integrity of, or public confidence in, the game of professional football. It’s the only other area of player discipline over which the Commissioner has retained the ability to personally process a player’s appeal.

The handling of the Brady appeal and its aftermath have raised new questions regarding whether Commissioner Roger Goodell ever can be truly impartial in cases where he has direct involvement in the underlying disciplinary decision.

As the NFLPA argued at paragraph 151 of the original court filing in Minnesota, “It is hard to imagine any person in Goodell’s position even attempting to serve as arbitrator under these circumstances, but that is exactly what he did. He denied the NFLPA’s Recusal Motion and simultaneously (and summarily) rejected the delegation [of the initial decision to Troy Vincent] argument — trying to pave his own path to stay on as arbitrator of Brady’s appeal. This conduct shows not merely evident partiality but actual bias, rendering Goodell unfit to serve as arbitrator under any standard.”

The NFLPA also pointed out that Goodell’s public statement of appreciation to Ted Wells made it impossible for Goodell to reach a contrary conclusion in the appeal, “as doing so would undermine his own competency as Commissioner.” Not specifically articulated in the NFLPA’s initial filing (but quite likely to be raised during the federal litigation) are the delicate balance Goodell must strike when placating his 32 constituents (i.e., the owners), along with the very real influence of P.R. concerns on his decisions. Given that he never is criticized for imposing too strong of a punishment on a player but was placed under siege after not going far enough with Ray Rice, the Commissioner will be far more likely to go too far than to not go far enough.

If the Brady case isn’t settled before the first of two scheduled conferences in court, Judge Richard M. Berman could hammer that point home via aggressive questioning of the NFL’s lawyers and, quite possibly, through a direct and pointed interrogation of Goodell in Judge Berman’s chambers as part of settlement efforts. And as Judge Berman potentially peppers the NFL’s non-lawyer CEO with questions about these issues that are difficult for even a seasoned litigator to properly explain, Judge Berman likely will insist that the answers come not from any lawyers in the room with him but from Goodell personally.

That’s why the NFLPA currently believes that, as a result of the Brady case, the NFL may finally be inclined to yield on the issue of Goodell’s power over players. NFLPA outside counsel Jeffrey Kessler addressed this dynamic in an interview with PFT conducted before Judge Berman ordered the parties to tone down the rhetoric.

“The union has been advocating for some time that the Commissioner allow neutral arbitration of all disputes in the NFL, just as there is in all the other leagues,” Kessler said, explaining that the “contradiction between the NFL Commissioner holding himself out as an arbitrator while also being the employer just can’t stand the test of time.”

Kessler added that it’s “better for the league, better for the Commissioner, better for the players if there was neutral arbitration.”

But what of the common refrain that the NFLPA should have insisted on neutral arbitration for all disciplinary issues during the 2001 Collective Bargaining Agreement negotiations?

“We did,” Kessler said. “That’s what people don’t understand. The final CBA has many things that the players demanded such as improved health and safety, reduced practice, and lots of improvement in many areas. And it has many things the league insisted on. The league made its no. 1 priority the ability of Roger Goodell to retain final say over issues of this type.”

And now the NFL may be having second thoughts about that. Kessler pointed out that the NFL doesn’t have to wait until the current CBA expires after the 2020 season to fix the problem.

“The union and the league have issues to address all the time,” Kessler said. “We changed the drug program after the CBA was done, including moving to a neutral arbitrator. There’s really no reason why the parties can’t sit down and re-do the whole Personal Conduct Policy now. . . . It boggles the mind that the league thinks it benefits from having constant legal battles. Why does the league think this is a good idea?”

In theory, it’s possible that the Commissioner’s lingering power over player discipline could be surrendered as part of the settlement of the Brady case. While that would complicate the back-and-forth over Brady’s ultimate punishment, if Judge Berman will be clunking heads together in order to get the NFL and NFLPA to settle their differences regarding Brady, why not push them for a broader settlement that would help prevent lawsuits like this one from ever being filed again?

  6. if Tom Brady is guilty, he should be punished. If Goodell has to concede some power to get it done, then perhaps he needs to do what’s truly best for the game. I refuse to believe Brady is innocent though. The NFL heard reports that the Patriots had deflated footballs prior to the AFC Championship game, per Nick Wright of CBS Sports Radio.

  7. I don’t know if he’ll lose any power but he probably should. I just saw that the NFL has paid $45 million to Ted Wells law firm for the investigation. That alone should get him fired. Anyone outside Massachusetts knows the footballs were a little light. They sure as hell didn’t need to pay $45 million to figure that out.

    With precedent being the cornerstone of most labor dispute settlements it is highly possible. It is also highly possible that attempting to preserve that power is a large part of why the owners are supporting Goodell in this.

Yes it will because the owners simply cannot afford more debacles than the ones Goodell has presided over, formented into major screwups, as well as the numerous violations Goodell looked the other way and chose not to act on or issue warnings clarifying that she subsequent violations of that nature will be pursued.

    Instead, Goodell acted as an arbitrary dictator choosing who he wanted to hang and being the 3 monkeys on others (see-hear-say no evil).

    Actually, with competent legal staff with labor issue expertise on board, none of these fiascos should never have occurred.

    Furthermore, there is still no evidence Brady had footballs either inflated or deflated to a certain PSI. Not giving up his personal cell phone, especially when he was told he wouldn’t have to does not make him guilty.

  22. A fair process could also work against the players, maybe force them to clean up their act. Goodell has been so reliably over the top that lawsuits are all but guaranteed. It is becoming the NFLPA’s default strategy. A truly neutral arbitration will be harder to challenge in court. As pointed out in a previous article, when Goodell insisted on being arbitrator on Brady he handed them a huge argumant for a lawsuit. I’d bet that the NFLPA actually wanted Goodell to take that bait. Gives team one more chance to take him on in court. I’m not even sure they care about winning, they like the battle. So does Goodell, apparently. Lose/lose.

  23. What would the union be willing to give up for that concession? The problem isn’t that Goodell has that authority. The real problem is that profit trumps integrity and the union does not trust Goodell. They argue everything, even when they know their member was completely in the wrong. Integrity is lacking on both sides. Maybe Goodell could manage discipline better if the union didn’t threaten a lawsuit every time a player does something heinous or stupid. If they police their own membership then the league would not have to step in so often. The union does nothing to curb the stupidity and the teams won’t discipline good players. Even if the teams did discipline players the union would cry foul if the Ravens did something different than the Packers.

    Goodell could have fixed many issues by acknowledging the corruption in the league office and handing out discipline on that front while also initiating a study on the natural deflation of footballs throughout this season. If it showed tampering was likely then punish the Patriots, if not then say why and move on. In his efforts to protect the shield he has managed to generate different problems much like the ridiculous rules generate unintended consequences while tweaking a problem that really didn’t need fixing.

    The bottom line is simple. There would be no problems with the disciplinary process if the teams and players demonstrated self discipline. This case was unwinnable from the league’s perspective. Find there was tampering and the integrity of the game is questionable but there are consequences. Find no tampering and the integrity of the game is questionable and no consequences makes it appear condoned. The obvious sting and/or setup just added another layer of distrust.

    Monkeys could fling their poo at a chart of options on the wall, and they’d do a better job at making decisions than the current regime.

    Goodell is digging his heels on this. I don’t see him voluntarily giving up power. Possibly when the CBA expires, but it would take a lot for it to happen before then.

  25. I would just like to postulate that it is possible for both of the following facts to be true:

    The NFL front office has run this whole ‘Deflategate’ situation like a bunch of sorry-a** clowns with a major vendetta.

    But also:

    The clowns Did uncover a systematic scheme by the Pats to alter the balls post-referee inspection.

    PS….What’s the actual status of the 2 equipment guys?
    Are they still technically Pats employees on a suspension?
    Are they terminated? Do they still have any official ties to the NFL?

    I think it’s beyond bizarre that we still haven’t heard these guys stories from their own mouth. Why not??

  27. They need to set up an NFL / NFLPA independent three or maximum five person commission to arbitrate cases once it advances beyond the commissioner.

    They also need to develop a two their system for penalties. One to address on field issues. The other for off field problems. The two systems should not be equivalent and the penalties comparisons need to end.

    A player can get 2 games for one and 4 games for the other regardless of what the issues are. This will also give the commissioner (who ever it is) a better way to articulate how penalties are applied.

    I suggested this before and some people thought it made no sense. The sooner they reformulate their policies and make it known how penalties are applied, the better. This arbitrary application of games suspensions etc. needs to end. In the end, it would help balance out the powers of the commissioner and lets everyone know what will happen when infractions occur.

    Exactly, and that’s the money point that few are realizing right now. But first let’s visit history.

    Goodell’s abuses of power have been going on for years. But nobody in New England cared back then. Now that’s it’s THEIR boy on the short end of the Emperor’s decrees, and suddenly not only is there cause for outrage — these hypocrites actually have the nerve to DEMAND we join them in their cries of outrage.

    Best case scenario: 1. Goodell is removed as Commissioner. 2. Brady is given Pete Rose status. 3. Robert Kraft is ordered to sell the team.

    That would solve everything.

  30. I can’t stress this enough. BOTH the Patriots and the league have shown themselves to be rule-bending, technicality-riding, underhanded organizations that put success over ethics.

    In other words, the NFL and the Patriots are MADE for each other. And that’s what cracks me up when they both accuse each other of doing the same basic dirty things.

    Again, the logical solution is to depose Goodell (not for his persecution of the Patriots but for the stunts he’s pulled on other teams); reinstate Brady with no suspension but forever assign him Pete Rose status; and, most of all, arrange the sale of the New England Patriots to a new owner.

    Only then can the slate be wiped clean.

    And one more thing: someone tell Bill Belichick the next time he claims he can’t be bothered with such “trivial” things as the air pressure in footballs, it might be a good idea not to show up a couple of days later lecturing the press on the Ideal Gas Law like some MIT professor.

  31. Aren’t the NFL bylaws so poorly written that they are riddled with contradictions and inconsistency? The Missouri Supreme Court decision from April 28th this year took direct aim at Goodell’s ability to act as an arbitrator. Its a major forgotten piece as the Brady case is the first major issue to stress the legal merits of Goodell’s power in this avenue since the ruling.

  34. This specific story is not about Brady and the suspension. It’s about WAS GOODELL A FAIR APPEAL JUDGE. The answer is no based on the evidence. Here is a question. If not for Rice and the other bungled cases. Would Goodell have made the same decision on Brady? I’d argue he wouldn’t have… But Goodell was under pressure to be tough after these other bungled cases. Goodell is obviously using this case to try and make himself look good knowing how the public feels about the Pats and Brady.

    The NFL cannot lose this case or should I say Goodell can’t lose. An independent arbitrator may hare ruled to enforce the same 4 game suspension. Yet Goodell didn’t trust this possibility.

    Looks like the NFLPA is going try to convince the NFL to take away that power for Goodell in this lawsuit win or lose.

    I’ve already blocked ESPN and NFL on my tv and computer with parental control. Also vow to yourselves no NFL merchandise, don’t give these clowns your money. If sales are down, it hits the owners where it hurts, their wallets. Then they’ll reevaluate Rogers status.

    You’re one of the very few then. The game of football has never been worse than it is now. The only people benefitting from Goodell as commissioner are the owners. The league is making more money than ever, but the quality of games/entertainment part of it is going downhill with all the terrible ref’s, the rule changes, the commissioner acting as judge and jury will not stand the test of time.

    This isn’t even mentioning the Cowboys and Redskins being punished for treating an uncapped year as, well… An uncapped year. Everything was approved by the league prior as well. I really miss P.T as commissioner… Goodell is terrible.

  42. This is a pipe dream, it’s not going to happen. The players should have rejected the CBA but they didn’t want to….lose money with a strike! And the majority of players don’t get into trouble so this was considered a minor concession. Maybe the players, not the NFLPA should start standing up and policing themselves. Goodell is not going anywhere, he makes the owners money, until he fails at THAT, he’s not going anywhere. For both sides, its never been about ethics, it always been about the money!

That includes the Patriots team themselves, who released a string of incendiary emails immediately after a judge had asked for both sides (NFL/NFLPA) to cease hostilities — justifying it like a child would, saying “well you didn’t say WE couldn’t do it!” Does that sound like the work of a mature organization, or a selfish one?

    The Patriots have shown no concern for the game as a whole. So why should we?

    That’s why Goodell, Brady and Kraft ALL have to go.

If you read the filings, it is clear that his lawyers do not foresee him testifying. I suspect that neither side wants to be testifying under oath in a real court.   49. Unfortunately, the players (by teams) voted on and gave Goodall this much power in the last CBA. The only team that voted not to give him the power that he has, was the Steelers.

    And remember, during the whole bountygate fiasco, Kraft was front and center on how good Goodall was as a commissioner. Now, that it’s his team that got caught, Kraft thinks Goodall is bad???

    Notice, no owner in the league has voiced their opinion on this. With Jerry Jones only saying (last week) that Goodall is doing a great job as commissioner. Basically, what Jerry Jones really was doing was letting Goodall and everyone else know that the rest of the Owners are in support of what Goodall is doing to the Patriots.

    Nothing will change with Goodall’s powers.

    THE NFL UNCOVERED ZIP, NADA, ZERO EXCEPT FOR THIER OWN STUPIDITY AND BIAS. The two gentlemen in question are suspended for a year on request of the NFL office to the Patriots another story where once the Patriots suspended them the NFL quickly put out a story saying they asked them or told them to do no such thing.     The Patriots employees will NOT be interviewed, there will be no scientific evidence looked at, the ‘deflator’ will not be asked about.

The NFLPA will bring up reports that owners (Baltimore, Indy, etc) pressured Goodell and the NFLPA will also for communication between Goodell and owners including phones to be examined. They will also ask why this punishment of a player is so different from Jets ball issue in 09 (fine), Chargers (fine), Vikims (warning) and how this issue warrants the largest penalty on a team and player ever.

The NFL leaked false information to the media (and Patriots) to intentionally shape public opinion and reduce the Patriots will to fight. There can be no other conclusion.
    That proves the NFL had motive and desire to frame the Patriots and any statements or conclusions from the NFL from that point on have to be taken in that context.
    The Wells report makes many sketchy assumptions including:
    – which gauge Walt used,
    – deceptively makes calculations based on the Colts balls being measured in the middle of halftime when indeed they had to be measured at the end of half time given their own statement that they ran out time at the half measuring the Colts balls,
    – doesnt accurately account for wetness of the balls,
    – oversensationalize other events,
    – and relies on dubious texts, none of which state any intention to deflate or desire to deflate (they all refer to inflating – “rugby” balls “effing balloons”) except one reference JM makes of himself being the “deflator” in early March which had no surrounding context of footballs or the Patriots or Tom Brady which came in the middle of a seven month off season period when he was away from the team which came from a guy that does lift weights and go on diets (which Wells used over a dozen times in his report – how desperate is that?).
    The fact alone that the Wells Report after $5M and many months is so easily ripped by a number of very qualified and intelligent people should draw skepticism of it’s results but coupled with the undeniable bias of the NFL in the lead up to the report it is hard to conclude anything else than it was an intentional effort by the NFL to find guilt no matter what.

  76. The NFL needs and should have disciplinary policies, obviously. The problem with the current process is that Goodell is too involved – yes, he’s the spokes-suit for the league, but I think his ego has gotten in the way of the entire process.

    Setting clear policies – that ARE FOLLOWED and not re-jiggered on a whim according to public opinion – and assigning discipline that is backed by those policies and precedent and appears unbiased and fair would lead to fewer appeals.

    Deflategate, for example, has had a huge “the Patriots CHEATED” tag attached to it from day one where other equipment violations involving balls in the past led to warnings and/or fines for the teams involved. Roger allowed this one to get out of hand very quickly when he should’ve controlled it and seen it for what it was – a (possible) equipment violation.

    The NFL could easily contract with a neutral arbitrator to handle conflicts. Roger being the center of it all doesn’t work. He takes too long to make his decisions and is too wishy-washy.

    There is one big difference between #2 and the other three incidents you listed. There is clear and irrefutable evidence of the other three. There is no clear and irrefutable evidence that Brady told anyone to deflate footballs after they were inspected by game officials.

    Reread the Wells Report. Even if you’re 100% convinced after reading the report that it has proven its case (which many knowledgeable people say it does not), the report never said Brady told ball handlers to do what you allege. It says it is “more probable than not” that Brady was “generally aware” of inappropriate activities of team personnel.

    If Wells could make the case that balls were tampered with on Brady’s orders, he would have said so. The fact that the Wells Report doesn’t say this (or even come close to saying this) speaks volumes.

  113. I’m not going to read through this article. It comes down to the CBA and what the players will give in return. The owners aren’t going to want to have someone else do the job Goodell does when it comes to rules/enforcement because then they have to pay that person a ton of cash to do it.

    One bargaining chip the players could offer is the 18 game season with 2 preseason games and adding a playoff team.

    That would get the owners and Goodell to jump and do whatever they want.

  114. So is there a list of penalties for various rules infractions, or does Roger just have a big “wheel of fortune” in his office that has different penalties on it and he just gives it a spin for for each different case?

    Part of the reason that there are so many lawsuits is that he is so capricious with the penalties. It’s like a box of chocolates with that guy. You never know what you are going to get.

    The CBA did NOT give Goodell the authority to do as he wishes, to abuse his authority, to violate US Constitutional Law, to commit Anti-Trust violations and MOST importantly to Lie to the YOU the General Public, Players, the NFLPA and Team Owners.

    Go and review the CBA and see if LYING & giving FALSE & DEFAMATORY statements is part of it.

    The US Constitution = Freedom, Due Process, Integrity
    OR
    Goodell = Liar, CHEATER, Dictator

    Seriously, there are several issues here, but one thing that just seems like it should be unacceptable to everybody is the Commissioner sitting as arbitrator to hear appeals of the penalties that he has himself issued. The fact that he has no legal training exacerbates the issue.

    He’s burnt his bridges with one of his big supporters. As this case plays out, we’ll see how long other owners can stand by the nonsense that his office has been producing.

    The more this kind of stuff lingers, the more the game suffers. Unfortunately for the NFL, if it now capitulates for its golden boy before a trial then what message does it send to other players that were suspended that didn’t have the benefit of playing for Robert Kraft?

    Like the Jets’ kicker whose equipment manager was fined for tampering with K-balls a few years ago?

  118. Brady was hated by many other NFL fans because of the perceived bias in his favor during games. (ie. starting with the tuck rule)

    Brady has given them just want they wanted. By whining and keeping deflate gate in the news, now every housewife thinks Brady is a cheater too. Thanks for destroying your cell phone and texting the ball boys. Thanks for confirming what we knew all along.

    They will balance long term risk vs short term cost, with the latter carrying more weight.

    The NFL heard from the Jaguars that the Colts equipment guys had needles hidden under their sleeves on the sidelines last season. The NFL knows that the Colts equipment guy used a gauge and measured the PSI of the intercepted ball–totally against the rules…..the NFL didn’t investigate the Colts, they didn’t warn the Colts, they didn’t fine the Colts, they didn’t conduct a sting against the Colts, they didn’t take away Colts draft picks, they didn’t suspend Andrew Luck or even investigate whether he knew anything…..maybe the sting against the Colts is what Roger has planned for next season….I mean he’s heard that the Colts cheated.
