Does Goodell have full authority to settle Brady case on his own?

Judge Richard M. Berman has directed Commissioner Roger Goodell and Patriots quarterback Tom Brady to attend Wednesday’s proceedings in court, which will include both a settlement conference and, if the case isn’t settled, oral arguments on the merits of whether Brady’s suspension should be upheld or scrapped. Ostensibly, Goodell and Brady possess the ultimate authority to settle the case.

As the event approaches, some wonder whether Goodell truly has the power to resolve the case without making one or more phone calls to one more owners.

This is a different question than whether Arbitrator Roger Goodell was being lobbied, influenced, and/or pressured by owners while Brady’s appeal was pending. The question now is whether Commissioner Roger Goodell has the power to bind the NFL to a settlement of an official, final suspension without consulting with the members of the NFL Management Council’s executive committee.

Throughout the labor negotiations of 2011, the Commissioner was joined by the CEC, a group of 10 owners who were directly involved in talks that culminated in a new labor deal. Even if those 10 owners are currently ready to get a phone call with a recommendation from Goodell on a potential settlement after Goodell gets his arm twisted by Judge Berman, that’s no substitute for the 10 owners getting their arms collectively twisted by Judge Berman.

It’s a dynamic that lawyers with claims against large businesses commonly confront. When it’s time to try to settle the case, the representative of the large business who has been sent to session lacks the ability to close the deal without calling someone who isn’t present. Ideally, the person(s) who would need to be called by the representative of the company are the ones who need to be present.

Given that Judge Berman already has scheduled a second settlement conference in this case, that’s one of the issues that possibly needs to be addressed today, if the case isn’t worked out. If Goodell needs to consult with the CEC before settling the case beyond whatever bottom-line authority from them that he brings to court, next week’s effort to clunk heads until the case settles should include a lot more heads from the NFL’s side.

  1. Makes no sense. If he has to talk to other owners to change a punishment then it is simple logic that these other owners had influence–if not full control–over the original punishment.

    I hope the judge asks the question as to how the league operates and maybe get to the real facts that Godell is a cuckold to the owners.

  5. There will be no settlement in this case. Tom Brady, for the first time in his career, is putting himself ahead of the team. And he deserves to do so.

    It would be great to have the process by which the NFL approve major decisions made public by Judge Berman. Kind of destroys Goodell’s image as “the Enforcer, doesn’t it, if he needs approval of a group of owners.

    The way you get around the issue raised by Florio is that “The Board” puts in writing, prior to the conference, their authorization that Goodell has the authority to bind the NFL in settlement.

  7. Goodell is doing a terrific job. He should be commended for trying to clean up the league full of corruption, criminals and cheating.
    The only people whining about Goodell are those who are GUILTY of crimes, doping and cheating. The fans of these unethical players are even bigger whiners and just as lacking of ethics.
    You dont hear any crying from Packers, Chiefs, Colts or any of the other ethical and classy teams who only employ high character players.
    Dont cheat, dope, beat your kids or partner, dont and dont break the laws and you wont feel the wrath of Roger.

  9. The NFL’s system is flawed and broken beyond a small fix. The lack of basic fairness applied to the Brady case is, for me, beyond the pale. If one of the most rich and successful athletes in American can be successfully punished without any eyewitness testimony or direct evidence, and in the face of considerable science supporting the notion that there was no crime in the first place, anyone is vulnerable. I hope Brady fights them ’til the end of time because Goodell and his cronies are fundamentally dishonorable people.

  12. I suspect there is wording in the commissioner’s contract – in every sport – spelling out his powers, and that the public will never see such a thing released. So we can wonder all we want. But the answer is not forthcoming.

    That’s because according to Troy Vincent, Aaron Rodgers admission that he overinflates balls is not something NFL looked into because it was said after a game and NFL did not want to “overreact.”

    So, it affects integrity of game only if the NFL has no scientific evidence that Brady deflated balls but Packers & Rodgers get a bye.

  18. I’m really interested in how Goodell arrived at 4 games for the suspension. Goodell sandwiched both “the scheme” and “the cover-up” into this punishment and never explained if it was 2 games for the on-field stuff and 2 games for the off-field stuff, or was it 3/1, or 1/3? This case is going to set precedent one way or another and the league needs to say exactly how many games are being punished for each offense, otherwise Goodell can say “this happened” and “you couldn’t prove your innocence” so 4 games without any pushback.

  23. In my mind, after his long and storied career, Brady has earned the right from the Patriots organization and from us fans to take this all the way. If he loses and has to wrongfully eat four games, or if he gets an injunction that ultimately ends up sitting him down in the playoffs, this man has earned the right to defend his good name to the fullest extreme.     1. Goodell and the ENTIRE NFL office DIDNT KNOW THAT, so what were they to think when they saw the PSI readings . They Assumed there HAD to be foul play. Understandable.
    2. The Wells report says the balls were up to .7 PSI under and 3 of the 11 were within the specs they should have been.
    3. If you SIMPLY believe Walt Anderson used the LOGO Gauge he said he did, ( After all you believe everything else he said) the balls were up to .3 PSI under and 8 of the 11 were within the specs they should have been.

    Those are FACTS go read the wells report and appeal transcripts before you claim otherwise!

    REALLY 3 balls under by .3 PSI And that’s Believing the FLAWED WELLS REPORT!

    Many other reports show NONE.

    I hated MJ23 just because he was a Legendary basketball player who was destroying my favorite team.

    I hated the the Phenomenon Ronaldo9 just because he is the greaster striker to have ever played the game.

    Reporters need to ask each and every owner if they feel Roger Goodell meets the criteria they established for the continued employment of the Commissioner

    Article VIII of their own NFL Constitution states that only a person of “unquestioned integrity SHALL be employed as Commissioner.”

    Having been caught in a LONG list of lies, leaks and misrepresentations, there are MANY QUESTIONS regarding Roger Goodell’s integrity.

    Given the Owners’ silence – or outright support of their Commissioner’s lies – there are also many questions about the OWNERS’ INTEGRITY

  27. It is laughable that nobody in this multi-billion $$$ league knew about the impact of the weather on air pressure of the balls.

    It is reprehensible that the league is unwilling to admit they did not understand the issue, then took specific steps to exaggerate the issue through false leaks to the media, and continue to deny any culpability on their part and deflect their shortcomings against the best player in the game.

  28. Goodell switched horses mid-chase by punishing Brady for dumping a phone that Goodell’s own investigator told Brady didn’t matter. The league also declined to follow up on Brady’s offer of tracking down all his messages anyway, because it is was “too much work” — after spending months and $5 million on the investigation. Reporters at the Washington Post flat out called Goodell a liar.

    At this point I wouldn’t trust Goodell to change the wiper blades on my car without professional oversight and a team of EMTs on emergency standby.

Then when actual facts are put to them they cowardly are no where to be found. Said facts come in questions I have. One for example is the Colts balls 3 out of 4 were also under inflated yet the Colts skated why? I could go and on with the inconsistency of this fiasco the NFL put upon it itself

    But I also want to answer the question of the article. No Goodell the puppet cannot settle by himself. His strings aren’t being pulled by the owners.

  30. Here’s one way the judge might force a settlement. First he tells Brady, on the side, that there’s a good chance he’ll uphold the suspension. Then, taking the league aside, he tells the NFL that even if he ultimately upholds the suspension, he’s going to write an scathing opinion ripping the NFL for how it handled the manner (including the leaks, false and conflicting statements, and unfair proceedings) which will stain the reputations of Goodell and his minions going forward and could lead to some heads rolling. Maybe that might get the parties to move toward a resolution.

    If he has the power to suspend players and lessen suspensions, he should have the power to do whatever needs to be done here.

  32. As a pats fan I actually hope the 4 game suspension is upheld and Brady takes it. Although Brady is a longshot to win this case as it is solely based on process he is a slam dunk winner in a defamation case against the NFL. You really think the NFL owners want to face that if the 4 games s upheld and Brady then sues the NFL. His family makes over $50 Million a year and they have take taken serious popularity hits because of goodell’s which hunt. Anyone can do the math on $50 million a year on what he could claim future lost income. I think that alone will make some NFL teams squirm. From what I have read lawyers seem to think because of Goodell changing everything throughout the “independent, not independent, independent investigation and that is was now Well’s fault the correct information was never released about the balls. I think each team losing upwards of $20 million in a defamation lawsuit might get this resolved today.

    Side note if 11 of 12 balls where slightly under 12.5 “if they used the same gauge” then why hasn’t Andrew Luck and the Colts been charged with anything? 3 of there 4 balls tested where under 12.5?
    that averages out to 9 out of 12 balls ot 75% had they measured them all. Maybe that’s why they stopped measuring the Colts balls.

At no time did we ever dispute that he was not acting independently in his role as an independent prosecutor….I mean investigator.   37. Judge Berman ordered the principals to be there for the talks. I’m thinking that he may be pretty irritated to find they are not there. So Roger had better have full authority to settle this, or we will see one pissed off Federal Judge.

  38. Berman does not live in a bubble. CEC approval of this award, either evident or implicit, would be partial and should force his hand. One question, theoretically, is unanimous CEC approval required for all decisions? If so Bob Kraft will effectively make this decision. That is the definition of irony.

    the balls aren’t within the Ideal Gas law, stop saying they were.

    We have what we would call a CONTROL CASE. You look at the Colts balls and what sort of pressure loss they experience, and it was NOT the same.

    So there’s basically a few things possible.

    a) The Colts are re-inflating their balls

    b) the Patriots deflated their balls

    c) there were some major differences in the gauges used to measure the balls.

    Thing is, re: c) that would require 1 gauge to be used for all the Seahawks balls, and a different one for all the Pats balls, and for one gauge to be more than a little off.

    So that leaves A and B, and considering the Pats are the accused, have a history of cheating, we have text messages about a guy named the deflator, we know teh Pats broke custody protocol for the balls, and Brady destroyed his phone . . . I’m pretty sure we can that this its more like than not its Pats deflation NOT Colts inflation.

  46. There is no way this gets settled. Goodell would have probably let Brady off with a fine if he had admitted he knew about the balls being deflated, but now short of that, he won’t agree to any reduction. The NFL lawyers know that they will win the appeal, because the CBA gives the commissioner almost total discretion in “integrity of the game issues” allowing the commissioner to impose the penalty he sees fit in cases where there is ” Conduct that undermines or puts at risk the integrity and reputation of the NFL, NFL clubs, or NFL players.”

    If Brady shows up today willing to admit to knowing about the deflation scheme, I think he might get a game suspension and a fine, but I don’t think he will ever admit it, so no settlement is likely.

    Because he is not, in this appeal, claiming he didn’t know about the scheme, or claiming that he didn’t cover it up afterwards, only that even if he did everything he is accused of, the punishment is unfair. Brady will serve his 4 games, claim he was wronged, and his reputation will remain where it is, stained beyond repair everywhere outside New England.

    If he is truly innocent, he needs to file a defamation of character lawsuit. This will allow full discovery of all his text messages (his provider has maintained these by law, and will only turn them over with a subpoena) and testimony under oath by Brady, McNally and Jastremsky. Proving he really knew nothing about this is the only way to clear his name at this point. Hopefully he does this.

  48. There is nothing to negotiate from the NFL’s perspective. Brady caused all of this and now its time for him to pay for his arrogance. Although, I’d offer a reduction of 1 game if Brady pays for the cost of the Wells investigation since it was his actions/ lack of cooperation that was a cost driver.

    Worst case scenario: Brady sits for 4. The Patriots, a team that won 11 games with Matt Cassel as starter, are in good hands with one of the greatest coaches in any sport at any time, and they get to find out a little more about what they have or don’t have in Jimmy Garoppolo. 🙂

    reality is that the CBA does provide the commissioner with the authority to be judge, prosecutor and jury, however it implies that the commissioner would not be unfair.

    there is a level of fraud and negligence that could be argued, and in that case that article 46 could be struck by the court.

    secondly, the commissioner must rule on what the CBA allows him to rule on within prescribed limits. the commissioner initially suspended Brady for the footballs being deliberately under pressure. that is not a player responsibility.

    he changed the reason for the suspension in the appeal ruling. blaming the “destruction” of the phone. We now know from the transcripts that the non independent wells told him he did not want the phone.

    there can be no settlement, there can only be a ruling because the NFL has acted with willful misconduct.

  61. You are wrong about the colts balls being the control. The colts balls were measured after they were in the warm room, and since they were not in play as much were not wet like the pats balls. Plus no calibration was done of the gauges & since none of the measurements were recorded before the game or if measured @ all there is record of where the balls started. By no means were the colts ball a control.

    because you enter into agreements with the expectation that the other side will not engage in willful misconduct. And if they do, the article of the agreement impacted by the action or inaction is not enforceable.

    The argument is is this isn’t one of “those” cases. This NFLPA asserts that this isn’t an integrity of the game case. Seeing as stickum isn’t considered “integrity of the game”, air pressure shouldn’t be either. “Integrity of the game” is stuff like match fixing and point shaving, not equipment violations.

    Goodell is trying to shoe-horn this into IotG because that allows him to do whatever he wants.

    Are you serious. The COLTS? The Colts that pipe in sound. The Colts that have an owner that drives around intoxicated. The Colts, that because they can’t win on the field participate in a sting about something so obscure that it’s never been checked before so they don’t even know that temperature changes the air pressure in balls. Something every kid that has ever played basketball outside in the winter knows (cold weather climes) The Colts are the opposite of a “Do it the right way organization”.

    That’s because even though Rodgers admitted in an interview he has his ball overinflated and therefore “cheats” the league has never punished or questioned them in any way.
