Judge Berman “anticipates” Brady ruling by end of the week

On Monday, Judge Richard Berman said that he fully expected to issue a ruling in the Tom Brady case on Tuesday or Wednesday.

It’s after 5 p.m. on Tuesday in New York and there’s been no ruling issued yet, so it seems unlikely to be delivered on September 1. September 2 may not be the day either based on an order issued by Berman on Tuesday afternoon.

“The Court anticipates issuing its Decision and Order by the end of the week,” Berman wrote, via Bob McGovern of the Boston Herald.

That leaves more time to go over the potential rulings that Berman could make and the responses that the NFL and/or Brady could have to those rulings, although it’s probably safe to say that just about everything that could be said about the case, the suspension, the meaning of the nickname “Deflator,” courtroom sketch artists and the Ideal Gas Law has already been said at this point.

  1. I’m trying to look at this without bias, and the way it’s going, I think either berman rejects any suspension because he thinks the nfl has no justification, or he splits everything down the middle for two games because it’s about an agreement, not about the evidence. I guess we will see.

  3. I sure hope there’s a way for the judge to do the right thing. Giving the NFL a tongue lashing, then finding for the league due to the law…..is bothersome. There must be room within the law to rule for justice. That should be the ultimate goal. Not who is right or who the winner is, but what is just?

    I think most rational people know the just ruling is to vacate all discipline to Brady, restore the Pats draft choices, and reduce the fine. That is all the evidence supports.

    Cmon Judge, find a way.

  6. I think this is very bad for the NFL. “I don’t have the jurisdiction or power to reverse this suspension” wouldn’t be a very long ruling to write.

  7. Well, as a lawyer, please explain to the rest of us what “Decision and Order” means in legalese. From a layperson standpoint that would appear to be foreshadowing. I expected to hear a decision. Or an order. But a “decision and an order seems like an obvious sign that Berman has plans other than just upholding a suspension. It sounds like he’ll reveal the decision he’s made and order one or both sides to do something specific. For example, to fit in with a previous PFT item, the “decision” could be to cut the suspension down to two games and the “order” could be to block the ensuing appeal thus sending it up the ladder to the appeals court.

  8. I find his use of the word ‘Order’ very interesting. There would be no ‘order’ if he is going to uphold the arbitrators ruling, the ‘order’ would only come when vacating the arbitration award. I feel like the time is going to be the crafting of an airtight ruling so that it stands up to an appeal.

  13. It takes a judge and his clerks longer to outline support for vacating the NFL’s arbitration ruling than it would to uphold it, thus the need to go deeper into the week.

  14. Don’t read too much into the “Order” part of it, guys.

    A judge telling anyone to do or not do something is an order. A decision is an order and an accompanying set of opinions. Even if Berman’s accepts the NFL’s contention that Goodell acted properly and is thus entitled to significant deference, Berman still needs to issue an order affirming the NFL’s motion and rejecting the NFLPA’s crossmotion.

  15. the longer it takes to write the summary, the worse it looks for the NFL. Confirming an award through arbitration is a very brief opinion. However, scorching the NFL along with confirmation would take a bit more time. Vacating the award and writing an airtight opinion that would stand up to appeal will take time..

    of course all of this is happening at light speed compared to normal litigation….

    Failed knot execution could decide this case.

    It seems like Brady’s team has been more willing to follow Berman’s suggestions about ties and knots. Goodell seems afraid that he’s not showing strong leadership if he complies (too much) with the judge’s fashion tips.

    Decision is just the written portion where he explain why he ruling the way he is; will probably include cases to support his decision and references to Goodell’s Award & the CBA, etc. Could be 3 pages, 10, 25. However many he thinks he needs to explain his ruling (and insulate it from being reversed on appeal).

    Order is short & sweet & enforces his decision, ie.,

    “The NFL Award is hereby Vacated.”

    We are awaiting a real decision from a real trial in a real court, written by a real judge, and no one – neither the league, nor the PA, nor the judge – wanted to hear from the Ball Boys. So that thing you’ve “maintained all along” was utterly, and completely wrong. No one cares about them. No one cares what they have to say.

    That one game concession of failure to produce the phone was a tactic designed to show Brady as being reasonable. It’s easy and cheap to appear reasonable when you know that your concession will be rejected by an unreasonable counterparty that is demanding unreasonable concessions. It bears no risk that your “reasonable” offer will actually be accepted.

  31. The NFL, after arbitrator Barbara S. Jones, a former U.S. District Court judge, reinstated Ray Rice, wholly dismissing the NFL claim that Rice had misled the league, calling the charge “an abuse of discretion”, decided it would dispense with independent arbitrators and use Goodell who has no training in law and is just the obedient servant of the owners.

    The professional ethics of arbitrators requires the process to be fair and for the arbitrator to be equally willing to find for either party. There was zero chance Goodell would find for Brady against the NFL. Nade. No chance. Judge Berman must know that reality and vacate Goodell’s decision.

    By the way, the NFL got around the Judge Jones’ ruling by having no NFL team give Rice a roster spot (not even a tryout).

  39. One of my favorite parts of this whole thing has been watching haters justify the lack of legitimate evidence with the supposed “rules.” No smoking gun? Don’t worry, the haters are literally CELEBRATING the lowered standard of proof, and leaned on the “this isn’t a court of law” defense. Like I’m not exaggerating, it was celebrated and they thumbed their noses at Pats fans about it. Who cares about making a convincing case, just make sure Brady is guilty. And now it actually IS in a court of law, and whether it gets overturned or not, the judge has destroyed the investigation, and the haters can’t see this out of a courtroom fast enough. Just in panic mode right now. Here they are today, strong again after three weeks of hiding, trying to reinforce the idea that Brady is guilty no matter what, and hopefully advance the incorrect agenda of Brady getting off on a “technicality”, when in fact it’s the NFL that is the only one getting off on a technicality, namely Article 46. But it’s too late. Regardless of the outcome, the truth is out there to be read by any of us willing to make the effort. The NFL has been caught in lie after lie, proven by contradictions in the appeal transcripts with NFL leaks, public statements, and the Wells Report. You don’t have to like Brady and the Pats, you can even think Brady is guilty, but the corruption in re league office is obvious.     This is what the lawyers for institutions do. They drag out the process. They expect to win a war of attrition. Even if they lose they see the process as lesson to the next guy that would dare challenge them.

    Brady is a hero, not because he is possibly the greatest player in the history of the NFL (so said Darelle Revis), but because he has stood up to the NFL, their slander machine and outlets like ESPN. Whether he walks away with the victory as he did against Seattle or without one as he did against the Giants, he still fought the good fight.

  47. Is “Decision and Order normal terminology? If it isn’t then it may point to a reduction of the suspension or a vacation order. If it were to simply uphold the suspension an order would not be needed as the decision or ruling would end his particular involvement.

    The judge knows he has no basis to rule against the league which is why he’s trying to badger them into a settlement.

    If he’s unsuccessful, Brady will serve the four games which is 12 less than he should have gotten.

    Simple. Brady cheated. The betting line is what made the NFL great and Brady’s cheating challenged the integrity of the game and more importantly, the sacrosanct belief in the betting line of NFL games. He must be punished.

    Because what he has to say is no longer at issue. The NFL/Wells requested an additional interview with him prior to issuing the report. The request was denied. The NFL/Wells factored that denial into the punishment they issued to both Brady and the Patriots. The question at hand is whether Goodell was justified in giving the punishments that he gave based on the facts and circumstances known to him at the time.

  58. Judge Berman and his law clerks are insuring his ruling will not be overturned. That is the only reason to delay his decision.

    Now to the NFL…

    Taking this into Federal Court will prove to be the biggest mistake the NFL made with the Inflation Gate scandal. This will change enforcement of the CBA drastically.

    The lawsuits will continue and likely result in “out of court” settlements enriching Brady substantially.

    Great points. Just remember that when an opponent dives into the rule book at figure out something different it is just hunky dory. Look back to 2008 when the Dolphins threw the Wildcat at the unsuspecting Patriots. In both cases the tactics had been used before and were completely legal. But in both cases you had coaches who were counting on being able to create confusion for the other team and in both cases they took full advantage. In only one case did you have the loosing team all but run and tell their mommy.

    Just remember that we are talking about the Ravens – the team that snitched about air pressure and even when emails came out proving otherwise they denied doing it.

    If the NFL wanted to know what the Deflator had to say, Goodell could have called him to the appeal hearing and had Wells’ partner, Lorin Reisner question him. Why didn’the they do that? Why didn’the they get the Deflator and Jestremski on the stand?

    My theory is, they didn’the want to know what he had to say. Wells had agreed to one shot at interviewing Patriots’ employees. Do you really think he missed that text about the deflator? In an investigation about deflating footballs, Wells missed a text message that contained a guy calling himself the deflator? I don’t think so. That’s a bunch of BS. Wells kept that card in his hand on purpose, because if he couldn’t get anything conclusive, then he could request to interview McNally a 2nd time knowing there was a good chance he’d be denied, and then could use that as a basis for non-cooperation.

    It was a tactic he used to chip away at the credibility of McNally, similar to what he did with the bit about the urinal (or lack thereof ) in the bathroom.

    In the end, the report contains 1 page that showe 4 of the Pats balls were above the predicted range of the ideal gas law, 5 balls that were within the range, and 3 balls below it. Plus 242 pages of distractions from that fact.

    Check the headset communications and or patriot player equipment. My guess is they are recording audio of opponents signal calls at the line of scrimmage and relaying it to Ernie Adams in the back room.

  74. Brady defenders keep on making the mistake to think that this is criminal case. The NFL does not have subpoena power. Based on the CBA it only needs to show reasonable doubt. The fact that Brady Destroyed his phone, the equipment man was called the “deflator”. The text conversation between the the equipment guy. The balls being taken into the bathroom.

    These are reasonable conclusions for the NFL to suspend Brady for 4 games. That is all that is needed for the CBA.

    Expect the ruling to be in the NFL favor.

    My hope is that they the NFLPA sues so that we can finally get the equipment guys on the stand facing perjury. Let’s see what they say then.

  76. One of the peripheral things about this fiasco has to do with the NFL owners. Those owners who have not won or come close to winning a Super Bowl and those such as the Ravens and Colts etc. They’re tired of losing to the Patriots. They are now behind this over the top exhaustive effort to bring down the Patriots. Give the Patriots a disadvantage in competing. So Roger Goodell has most of the owners on his side with this nonsense. If you can not beat the Patriots on the field, soften them up off the field with draft picks being taken away, suspensions and more. The reality here is that Roger Goodell has the support of most if not all of the owners in this latest NFL fiasco. I would expect Judge Berman to vacate the Brady suspension due to lack of fairness in due process irrespective of the CBA. Moreover Goodell and the owners are not independent arbitrators they are competing franchises who want to win and create a disadvantage for the Patriots. This situation does not have much precedence so lawyers are conflicted. Goodell is refusing to accept a settlement at the behest of most of the owners. He works for them and makes a few bucks doing so.

We will soon find out if judge Berman had some basic science training in high school and understands that air pressure will decrease naturally in balls and his car tires when temperature decreases. Otherwise we should be happy that only US watches US football and the other world would not laugh about a judge not understanding basic science.
    The judge should vacate Brady’s suspensions alone on the fact that the NFL had a pressure requirement on footballs, but did not understand how to to test for that pressure, did not train personnel for that testing and provided and used uncalibrated instruments for that testing.

  79. You don’t have to be a Pat or Brady hater to think he deserves the suspension. And it’s not even about the PSI of the footballs for me and for others. It’s about the lying and shady behavior after that.

    He initially claimed he didn’t know the two patsies yet sent them multiple texts and even had nicknames for them? I don’t make a habit of texting people I don’t know multiple times….do any of you? And we’re supposed to believe an NFL superstar, with a supermodel wife spends his time texting the ball boys about something other than deflating balls? Ummm no.

    He also refused to hand his phone over. And destroyed it to avoid having it subpoenaed, however likely that would have been.

    Pats and Brady didn’t pass the smell test once, and they’ve had ample opportunities. What can be proven and what is true are not always the same, but the NFL can act on either and in this case, that’s a good thing.

    Funny, that’s how I feel about Kensil & Goodel.

    Remember, The NFL interviewed the equipment guys numerous times and got nothing.

    On the other hand Goodel was already been found to be misrepresenting information when the actual appeal hearing transcript came out.
