Appeals court won’t hear Brady case until February

It’s now official. The Tom Brady suspension litigation will not be resolved during the 2015 season.

Via the Associated Press, the U.S. Court of Appeals for the Second Circuit has said that oral arguments won’t happen until February 1 at the earliest. With the Super Bowl set for February 7th, there’s no way a final ruling will be reached before the current football season ends.

Moving forward, the key word is “final.” Beyond the initial decision from a three-judge panel that will be assigned to the case in the Second Circuit, additional levels of appeal are available, culminating in the submission of a petition to the United States Supreme Court. Along the way, the case could be sent back to Judge Richard Berman, who has not ruled on several open questions about the fitness of Commissioner Roger Goodell to serve as the arbitrator in the Brady case.

It therefore remains possible that the Brady case won’t be fully and finally resolved until he has retired. So, like defensive tackle Pat Williams several years in the StarCaps case, Brady eventually could be suspended for games he’d never be playing, anyway.

    What you need to report about is the amount of penalties this year and how the game has become unwatchable and possibly fixed. Pat’s are great at exploiting terrible rules and flag football like offenses leave the defense with very little chance to actually play defense.

  13. Interesting. The league has one argument and one only. They can act in any manner they want because the CBA allows it. Technically, they’re right.

    What Berman’s ruling suggested to me was that in spite of the CBA, it still doesn’t allow the league to ignore and violate a player’s due process. Apparently, this is what happened and any other details are moot. Defenders points don’t matter. Critics points don’t matter. It’s all moot.

    The case wasn’t an appeal by TB12 & the NFLPA, it was a case filed by the NFL to have their rulling affirmed.

  16. I can see the NFL Strategy. Jeff Pash, NFL Legal Counsel will begin the legal proceedings with a ‘Pashionate” reading of Article 46 of the current CBA. The NFL will then argue that any person, who ever lived on this earth ( including the Pope) must defer to Roger Goodell, no matter how incorrect Roger might have been. The NFL will conclude its case by having the NFL billionaires owners choir, led by Jim Ersay, serenade Roger and the 2nd District Court with the well known hymn ” How Great Thou Art”!

    The NFL also vacated the suspensions of the Patriots equipment guys who they previously ordered suspended and claimed were involved in a conspiracy to deflate footballs. Obviously they would not remove the suspensions of non-union personnel if they really believed they were guilty of anything.

    So the NFL has now exonerated Brady, the equipment guys and the Patriots in and out of federal court. So why are they bothering with this ridiculous appeal? And, more importantly, when are they going to apologize to Brady and the Patriots and return the draft picks.

    As far as the $1 million fine is concerned, that goes to charity and I am sure the Kraft family is happy to support a worthwhile charity or charities with that money even though the money was taken via lies, innuendo, slander and libel.

    I don’t understand why the NFLPA agreed to an accelerated time frame, for as things stand today, they appear to be in the driver’s seat. And Tom, he could have played for a couple of more years before the case was heard.

    First the NFL was the party that filed the first round in Berman’s court.

    Second, that is a different court with a different procession time than the court its going to now. Which if you had actually read the article mentions that this is reviewed by a 3 judge panel. Meaning they have to coordinate the schedules of 3 judges to schedule the hearing, not just 1.

    Keep up whining and demeaning only yourself though.

I think that we will have to appeal, but that is just my opinion. I think that we’ve always had a system where the commissioner had a strong position, and I just think that it is something that we need to try to go to the appeals for and we can get this overturned.

    “As far as I was concerned, that is the commissioner’s job to figure out what the discipline is, and for something like this I didn’t think that there really was precedence, so I’m not sure what to compare it to. I think that there are a lot of factors that went into it, not just the original mislead, but what followed from there, and that’s why I think that the commissioner had to have some discretion to make that decision, and I think that is why we need to appeal.”

  63. Compare and contrast Luck’s play with Brady’s play starting with the second half of the AFCCG. It is pretty clear that Brady has played better with balls that have been closely monitored and that Luck has played worse. Is anyone questioning Luck and the Colts?

    This was an invented scandal to try to impair the Patriots chances of winning because they had exploded the NFL’s illusion of parity and because a subset of AFC owners conspired with league officials to “kneecap” the Patriots. Goodell went along so as not to look like he had lost control of the ship and to preserve his power as commissioner.

    Other owners jumped on board for reasons similar to Goodell and for their own private reasons (e.g., Jerry Jones saw the Patriots as a threat to the Cowboy’s legacy and #1 franchise valuation).

    The whole premise of the NFL’s case is being exposed as a fraud every week Brady suits up and takes the field. If you are a human being it has to feel good to watch how Brady has responded to the haters inside the NFL and out.

    The NFL announced there will be “random testing” only going forward. That was most likely intentionally vague. The league screwed this one up from the start–as in from the moment they tested the balls in the AFCCG.

    Once they spoke to Columbia University, they knew they could not win based on the data they collected, so they paid a consultant to validate their findings. Then Berman called them out on the lack of evidence. The last thing they need is a pile of data that proves the Pats did nothing wrong, so they are just measuring when they feel like it.

    If this issue was so important in the first place, why is random testing enough? Why aren’t there new measures for ball security prior to games? Why isn’t there a system in place for collecting data on each ball in every game? The answers are all the same:

    The NFL knows the Pats did nothing, but they spent 5 million on the report, plus court costs. They basically admitted that was all worthless, and are now hanging onto Article 46. They are never going to be big boys and admit it was a sham. They are just going to get beat again in court, and try to get a better system in the next CBA.

    Coaches will have a decision to make after touchdowns, “Do I go for 1, 2 or 3 points?” Defenses will have no idea when a team lines up for what is now known as ‘going for 2’ if they plan to pass(2 points) or run(3 points). To summarize – break up the 2-point conversion. After a touchdown, if you kick the p.a.t. you get
    1 point. If you pass the p.a.t. you get 2 points. If you run the p.a.t. you get 3 points. Kick = 1, Pass = 2, Run = 3.

    I wouldn’t consider myself a Pats hater because they aren’t even relevant yet. They had 15 year run of cheating. They never won anything before that. Since they only won by cheating, I consider them the bottom of the barrel until they hire a new coach and win honestly. If I was a Pats fan, a Browns fan, a Vikings fan, a Lions fan, or a Jets fan then I’d rather lose with class then win with cheating. Of course teams cheat or get caught cheating once every few years. The Pats do it 100 times per game which is why Belicheat knew the exact percentage of weight that Spygate benefited the team. I’m sure he has a chart with hundreds.

    1) Brady, and the entire roster, is only a successful because Belicheat hires 3 people that design ways for the team to cheat 100 ways every Sunday. Not one way every Sunday. Brady is 6th round talent and would’ve been out of the league after his rookie year if drafted by any other coach. It doesn’t matter who the QB is of the Pats under Belicheat. I wouldn’t trade Eli for Brady.

    2) Belicheat is cheater so I wouldn’t want him. I wouldn’t trade Coughlin from Belicheat.

    3) Kraft is the second worse owner in the NFL right above Jerry Jones. A good owner would’ve fired Belicheat after Spygate, and hired a coach that could win Super Bowls without cheating.     It’s quite simple really. These courtroom appeals, both the initial one preemptively made by the NFL to the NY Federal court requesting to confirm the Goodell decision, and the latest one made to the US 2nd Court of appeals to overturn the Berman decision, have absolutely nothing to do with whether Brady or anyone on the Patriots was guilty of ball tampering.

    These appeals are ONLY about whether the NFL and the commissioner can do whatever they want when it comes to punishing the players in the league. The league and owners believe that because they have a CBA contract with the players union that allows Goodell to act as arbiter of his own decisions (which is yet to be considered) that Berman was wrong to have overturned the Brady suspension.

    But they are wrong. Even if Brady had been proved to have been 100% guilty with factual evidence, you cannot refuse anyone of due legal process afforded to every citizen in the country, regardless of what the contract says. In other words, you can’t give away your legal rights in a CBA.

    If this appeal does get remanded back to Berman for further consideration, he has already hinted that he would be looking at whether it is EVER possible for a commissioner to act as his own arbiter. If the court rules that it is impossible for that to result in a fair arbitration, that will permanently break that part of the CBA.

    1. It is not illegal to steal signals.

    2. All teams steal signals, or at least try to. Its part of the coaches job to try and decipher the other team’s defenses. Any coach not trying to steal signals is incompetent and not doing their job. If you don’t believe this then riddle me this as to why every single coordinator constantly covers their mouths with their playcards when making communicating with their QB or defense ?

    3. Lazy teams and coaches not only don’t attempt to steal signals they don’t bother changing their own. Or even worse they do something like the Jags did last week when they practiced fake punts in front of the media so of course the Pats expected them to try one.

    4. It is not illegal to film the other team’s signals, the only violation the Pats had was filming from the wrong location in 1 game which was not illegal to film from before then. This does not somehow “taint” previous Super Bowl wins even though the desperate whiners on here wish it was so.

    5. Every team keeps massive data bases of other team’s / coaches plays, signals, tendencies, formations, alignments etc. Claiming the Pats Super Bowl wins are somehow “tainted” for doing so is moronic. And if that somehow “taints’ what the Pats have done then ever Super Bowl victory ever is tainted.

    Lazy, incompetent coaches that whine about the Pats only emphasize they’re not very good at their jobs.

    The League admitted to Judge Berman … there is no evidence tampering occurred.

    This is a move to protect the collectively bargained gem and gold that is article 46 of the CBA. Which essentially gives the owners and League power to do whatever they want… including railroading a player if they want to!!!

  115. The NFL is dumber than was conceivable. Their appeal was filed to keep them in control of player infractions on and off the field. But the expedited request, easily delayed by Tom’s attorneys and the NFLPA’s, will still drag this out until kingdom come, or when the judge has Goodell shot for gross stupidity.
