Third-party brief in Brady case focuses on “integrity of sport”

The #Deflategate drama has a lengthy cast of characters. One of the fringe players has weighed in with a strong argument in support of Patriots quarterback Tom Brady. Or, more accurately, in opposition to the NFL.

Professor Robert Blecker, a lawyer and law school professor with a “scholarly and moral interest in cheating and the integrity of law and sport,” has submitted a third-party brief in the pending federal appeal of the case that scrapped Brady’s four-game suspension.

Dubbed an amicus curiae brief (Latin for “friend of the court” . . . not, as I learned many years ago, “cure for mice”), Blecker’s 34-page submission purports to explore issues that neither the NFL nor Brady address “relating to the integrity of sport and the proper limits of investigation and arbitral adjudication necessary to protect it.” In other words, Blecker takes aim at the entire process that resulted in Brady’s four-game suspension for alleged involvement in a supposed scheme to deflate footballs.

Blecker describes the process at page 2 of his brief as “infected with bias, unfairness, evident partiality and occasional fraud.” He reminds the court of the leak of false PSI data to the media, which went uncorrected “while public opinion congealed against the Patriots.” He calls the insistence that the Patriots’ balls were below the 12.5 PSI minimum but that the Colts’ were within legal limits as “literally true but contextually misleading.” He accuses the NFL of engaged in “deceptive logic and demonstrable fraud” in support of the notion that science alone could not explain the dynamic.

Blecker also chides the NFL Players Association for failure to “assert or explore the NFL’s bias, dishonesty, or fraud” in the investigation culminating in the punishment imposed on Brady, focusing instead on the idea that the labor deal authorizes fines but not suspensions for first-time equipment violations. “In short,” Blecker writes, “neither side challenges much less explores the integrity of the arbitration process and its effect on the integrity of the sport.”

At pages 7 and 8, Blecker explains that the NFL has in its appeal brief “largely abandoned, without any acknowledgement the entire scientific basis for concluding that human beings illegally deflated footballs.” Likewise, Blecker points to what he calls “[t]he NFLPA’s puzzling and distressing silence on the NFL’s unacknowledged retreat from the scientific basis for Brady’s guilt.”

Blecker believes that the NFL abandons the science because the science is hopelessly flawed. He points out at page 11 something that has gotten little attention throughout the #DeflateGate saga.

By way of background, Exponent (the outside scientific firm hired by Ted Wells to study the case) rejected the recollection of referee Walt Anderson that he had checked pregame air pressure in all footballs with the gauge that, if this was the gauge used, would have exonerated the Patriots immediately. Put as simply as possible, Anderson recalled using the “Logo” gauge; Exponent assumed that his recollection was incorrect, and that he used the more incriminating “non-Logo” gauge. (The two gauges varied by nearly 0.5 PSI, a fact that arguably should have short-circuited the entire investigation, resulting in a finding that the evidence necessarily is inconclusive.)

Blecker now explains that the air-pressure gauges used by the two teams to set football air pressure could have helped break the tie, but Blecker notes that the team-owned gauges “went missing,” and that the Wells report fails to explain how this happened or what was done to find team gauges that could have helped confirm or debunk the assumptions made by Exponent regarding which NFL-owned gauges were used to check the pressures before the AFC title game. “If adverse inferences should be drawn from a party’s failure to produce relevant evidence,” Blecker writes, “the League’s failure to produce either gauge overshadows Brady’s failure to produce his cell-phone — especially when all phone records confirm that the NFL has all relevant texts.”

At page 14, Blecker catches something that most previously had missed. When comparing the length of the needles used in the two NFL gauges via photograph, Exponent positioned the shorter needle against the ruler in a way that conceals the fact that one gauge had a needle exactly twice as long as the other gauge — a distinction that should have made referee Walt Anderson’s recollection more credible, and in turn harder for Exponent to ignore.

Blecker also points out the photograph comparing the lengths of the needles conceals the dramatic bend of the longer one, another characteristic that would have made Anderson’s recollection of which gauge he used more credible.

Later, after pointing out the flaws in the assumption by Exponent that, at halftime of the AFC title game, the NFL: (1) measured the air pressure in all of the Patriots footballs; (2) measured the air pressure in four of the Colts footballs; and (3) refilled and recalibrated all of the Patriots footballs, Blecker argues that the NFL’s effort to eradicate conduct detrimental to the integrity of or public confidence in the game of professional football necessarily amounts to conduct detrimental to the integrity of or public confidence in the game of professional football.

“If [the] investigative and adjudicative process is biased, if its substantive factual findings fly in the face of probability and consistently impute misconduct — ball tampering — where there was none, that more than anything undermines the integrity and public confidence in the game,” Blecker writes. “In nearly a year since the AFC championship game, the NFL’s investigation of Deflategate has more adversely affected public perception of the integrity of the game than any purported misconduct by Brady.”

As #DelfateGate lingers, and as more legitimate questions are raised regarding the flaws in the NFL’s case against Brady and the Patriots, it’s becoming more clear that the investigation has done far more damage to the league than whatever it was that the Patriots were or weren’t doing. Nearly a year later, we still don’t know what the Patriots were doing. But we definitely know that the NFL has failed to make a persuasive case that the Patriots were doing something wrong.

    That’s what happened when poorly educated people who hate a team or person abandon all logic and reality to frame them.

    The league will lose the appeal in extremely embarrassing fashion. Its lies, fraud and delusion are clearly laid out in this 3rd party brief.

    From the beginning there has been zero evidence that the Patriots did anything against the rules. This whole thing is caused by nobody with the league knowing that air pressure in balls naturally decreases in cold weather.

    Imagine yourself in that room where they measure the balls at halftime. The indignation the league guys must have been spewing out caused by their own ignorance.

    Then once they leak the bad info and then find out about the ideal gas law there was no going back. That is the time the league should have basically said “oops…”, but they continue to try and put the Patriots and Brady in particular in a bad light to cover up their own failings.

  6. Guilt nor innocence have nothing to do with this appeal, contrary to what the un-educated masses seem to believe. This case is strictly about the procedure used and the penalties assessed under the CBA. Brady could confess unequivocally to deflating the footballs intentionally and the case would still continue.

    There are 3 groups of people in this.
    Group A) Patriots fans, if there is any doubt about what is trying to be proved, they are naturally going to defend their team, its only natural. I don’t see that as a negative trait to defend what you care about without clear evidence. See Hernandez, Aaron as evidence that the Patriots fans are not unreasonable, when the evidence started piling up, the Patriots fans shunned Hernandez. Note, they didn’t erect a statue for him.

    Group B) People that absolutely despise the Patriots. These are the people that, if Belichick was accused of having spy satellites, would begin citing Belichick’s spy satellites as one reason for their hate. They are illogical, and disturbingly anti Patriots. Allegations = facts to these folks. They believe Belichick has a weather machine, and uses the force to make opposing coaches make bad decisions (he used the force to make Pete Carroll call that pass in the SB).

    Group C) People that look at the facts, and only the facts. They don’t factor in which team was involved. They don’t factor in which players/coaches were involved. They simply look at the accusations, the facts to support the findings, and come to their own conclusion.

    Group A believes the Patriots/Brady. Group C believes the Patriots/Brady. Interesting isn’t it. If you find yourself in Group B, you might want to reevaluate your life. Join match and find a girlfriend (or whatever you are into, its 2015, we don’t judge). You wont be so frustrated with the Patriots success.

    I think the proof of whether or not the Patriots are guilty of these accusations is in the results this year. Has Brady looked terrible? Have the Patriots been fumbling at an alarming rate? All of the terrible things that would happen “when the Patriots began using properly inflated footballs” hasn’t happened.

  23. Put aside how the league lied about 11 of 12, and then disbelieved its own star witness on the key testing point while “losing” the relevant gauges. The phone issue actually played out as follows:

    “Hey, Mr. Wells, do you need anything else off my phone?”
    “No, I’m good.”
    “Ok, I’ll have my assistant get me a new one.”
    “AHA!”

    That Brady has a 103 passer rating and the Patriots have the #1 passing offense in the league using “proper” footballs will forever baffle these clowns.

    @iamkillerfan – Nearly a year later, and there is still not one shred of evidence that proves that any wrongdoing occurred. Under oath, the NFL admitted as much when drilled on this point by the court. They were asked to point out the proof of Brady’s involvement and their response was “There is none”. It’s in the transcript, look it up. Keep on hating though, I’m sure it keeps your warm at night.

    @steelsitywhitty – Brady didn’t get a new phone because the old one was damaged. He replaced his phone because that number was discovered and he was getting a lot of calls. This has been explained a few times. Now, I know you don’t destroy your old phones. Neither do I. Then again, I’m not a massive celebrity either. That being said, I do wipe my sim cards several times before trading in my old device.

    It’s kind of sad really. Because I choose to educate myself on this entire thing; reading the wells report, the pats rebuttal, the court briefs, countless sites on both sides of the fence, I’m an “unabashed fanboi” for Brady and the Pats. Then we have all the people just spewing their bile, without any real clue about what they are discussing. Seriously kids, if you’re going to join in the conversation, do us all a favor and get your facts straight.

  29. I don’t know who has the gauge the Colts used, but according to the Wells report, NFL Executive James Daniel was the last person known to be in possession of the Patriots’ gauge; he used it to test the intercepted ball 3 times just before halftime.

Roger Goodell could come out and say that he and his minions did indeed pull off a sting and try to take Brady and the Patriots down because of the hatred and pettiness of the Jets fans in the front office.     right. so what did the NFL/Wells say about the phone that Brady did turn over? The phone he used until Nov. 6th?

    The Wells report has a section, pages 75 to 85, titled “Communications about Inflation and Deflation”. It contains a total of 35 text messages, all dated between Sept 30th and Oct. 25th, which coincides with the phone Brady turned over.

    So….what did they find on that phone? I’ll wait…..

    Sure sounds to me like the Pats organization isn’t letting this go and hoping people forget about it… unlike what a guilty party would do. Sure sounds like the NFL front office will be getting what’s coming to them from the Patriots organization.

    Also, Goodell has had numerous opportunities to apologize throughout this whole ordeal when the NFL’s case was going up in flames around him. He has continually decided to go the opposite direction, see exhibit A: The NFL’s appeal and request to move up the appeal hearing.

    I seriously doubt the dodger will offer any sort of apology to the Pats, if/when the appeal falls flat. He will issue some generic 30 minute response where he states this was done for the integrity of the game and he will not apologize for attempting to protect the shield. Even though everything he has done throughout this whole affair has done more to tarnish his legacy. Especially when coupled with his handling of Ray Rice and Adrian Peterson and the other issues during his tenure. Goodel will go down as an overly aggressive, heavy handed, over-the-top authoritarian commissioner who his successor’s will use as a measuring stick for what not to do. “Is this how Rodger would have handled it? Yes? Ok, let’s dial this back and find a better solution.” Probably not a full 180, since that would make the next guy a pushover. They need to find a better middle ground though.

    Once again….it wasn’t the NFLPA and Brady who had a problem putting the ball boys on the stand during Goodell’s appeal hearing…it was the NFL who said no, they didn’t want them to testify. Why would the NFL NOT want the ball boys to testify? So that we can all trudge along for eternity wondering what would have happened had they testified…..or could it be that they knew that neither one said anything incriminating in the 4 times they were questioned by the NFL and Wells? Don’t confuse leaks and facts–they’re two different things.

  40. At the beginning of all of this, I believed the NFL that the Patriots had done something wrong. There was already an established narrative for it, after all the Spygate business, and the Patriots seemed to be darlings of the NFL, with the relationship between Goodell and Kraft, which made it all so easy to swallow. At the time I thought, “What does the NFL have to gain by lying about all of this?”

    Reports came out and the story was spun to make the NFL’s case appear, pardon the pun, air tight.

    Then, as the season opener drew nearer, and more scrutiny was given to the evidence, the NFL’s story fell apart. Denying science, ignoring witness testimony, and interpreting circumstantial evidence in such a way as to muddy the issue is not how a fair investigation is done. And I saw that the suspension was suspect at best and totally illegitimate at worst.

    Finally, you look at how domestic violence, which was the top topic before all of this, has completely disappeared from the national consciousness and you see why the NFL would lie.

There NFL owners demonstrate zero due process and zero accountability. Who would’ve thought because of unmitigated greed the NFL would shoot themselves in the foot!
    It’s like the Gov wanting to control Fan Duel and Draft Kings. Some guys come up with a great idea and the Gov like the Mafia want their take. Now there’s talk of the Gov creating their own Fantasy Lottery game while threatening a legit business with criminality. Bee Ess!

    this commenter wants the NFL to drop it because he doesn’t want the NFL to lose again. He wants to be able to continue yelling CHEATER with no basis. He doesn’t want the truth.

    good lord…really? They were both interviwed by Wells. Mcnally was grilled three times, twice without legal representation present. What more could they possibly have offered? Their entire testimony is in the Wells report. There’s really not much more they could offer. If the NFL thought their testimony had any value in proving their case, I’m sure they would have been called at some point. Given that neither was called by the NFL, what do you think that means? Right, they had nothing else to offer or that their testimony, under oath, would further Brady’s cause not the NFL’s.

    It’s ok, hold on to that uniformed belief in Brady’s guilt. Without the science all you have now is extremely weak conjecture. If you can’t prove that the balls were purposely deflated by anyone, then there’s no case. Since the science backs up the claim that this occurred naturally, you have no case. Move on already.

    Kraft knew they were guilty that is why he took his punishment like a big boy. He never thought they would get away with it. The amount of circumstantial evidence is overwhelming. This is not a criminal trial. The NFL will win and do as it likes with its OWN business.

    Its become patently obvious that the NFL engaged in a flawed and fradulent investigation against it’s greatest player and team for political reasons. That there was a reasonable alternative scientific explanation, no evidence and no admission of guilt whatsoever and yet still this went to the extent it did should concern all NFL fans.

    We pay our money to this league and we love our franchises, yet what do this give us back: Lies deciept greed and fraud. Don’t you think there is something seriously wrong in the NFL office?

    I think there is something SERIOUSLY WRONG in the NFL front office, and I think it has shown itself in mutliple situations (Jon Martin, Bountygate, Deflategate,Rice, Peterson etc) and I think we all should be concerned

Brady is still a great QB, but on a cold, wet, Boston winter day, he wanted to get a little better grip on the ball, and let his receivers catch a bell that was a little softer. The Patriots have been caught illegally videotaping other teams too. I doubt that gave them a huge advantage, but sometimes just a little help goes a long way. If you ain’t cheating you ain’t trying.     Acutally, no, he did it hoping that the Goodell would back off the ridiculous charges against Brady.

    Also, there’s no circumstantial evidence that proves anything. The NFL came into this stating that the Pats deflated the game balls and that they could prove it. The science doesn’t even back it up. Even when using the other gauge, as Wells believes Anderson did. Because the Wells report clearly defines that gauge as being having a reading discrepancy when compared to the other gauges used. When you apply that discrepancy to the pressure readings that Well’s used, the numbers match up with the other gauges.

    The text messages were duplicated 20+ times throughout the wells report, and he only used a sub-section of a larger conversation. A conversation that occurred months before the season and had zero to do with deflating footballs.

    Not to mention the fact that there is no discussion, any where, that suggests a scheme to deflate balls was in place. The only reference to adjusting ball pressure occurred mid season after a Jets game, when the NFL’s own REFS over inflated the Pats game balls. After Brady ripped Mcnally and Jastremski apart for this, Mcnally said he would make the next game’s balls look like watermelons. In case your slow to catch up on this point, that would be inflating not deflating.

    Brady was never asked for his phone, he was asked for relevent texts. Given that the Pats had made all company devices and correspondance available to Wells, Brady’s legal team’s assertion was that Wells already possessed said communications. Brady did dump his phone, after he was told Wells didn’t need it. His number was discovered by fans, and he was getting a lot of calls. So he replaced it. Either way, he provided a list of numbers called during this time. The NFL declined to investigate the list.

    What else do you have? Oh, right…”The deflator”. I’ll give you that is an absurd nickname and initially I found the explanation weak. However, Mcnally isn’t the first person to use “deflate” or “deflator” in reference to weight loss. You can look that up if you want, it was used quite a bit long before this whole debacle started.

    Anything else you are unclear about?

    tl:dr version: Brady’s innocent and the NFL couldn’t even point to evidence of his guilt when Judge Berman asked them for it.

    That is evidence of taking footballs to the bathroom, not deflating them. They should have fined the Patriots for illegally handling the footballs in the pre-game, not for deflation.

    Despite how it looks it isn’t evidence of deflating the footballs. The science is the only thing that can prove that, and it is inconclusive.

    If they were deflating the footballs it seems per the science they were just trying to make sure they were at the lower limit of 12.5 PSI. Still against the rules, but pretty hard to prove conclusively without recorded pre-game measurements by football.

    My dislike of Tom Brady did not start with deflategate or even with a loss or losses to the Patriots in any game. My dislike of Mr Brady began November 30, 2014 when the Patriots visited Lambeau field. I sat right behind the Patriots bench. Myself and quite a few children had the pleasure of hearing Brady’s repeated screaming f-bombs on the sidelines as his team got thoroughly beat. His fans excused his boorish behavior as competitiveness. In reality he’s just a selfish jerk. Even if he or his team never have to pay a price for their unethical practices, just for his actions that day, I hope his legacy is forever tarnished. Thanks Tom for teaching a lot of little kids in Wisconsin that if you’re a rich and famous athlete it’s OK to swear at the top of your lungs in public.

    It amazes me how people can rationalize that Brady would authorize intentional deflation of the balls while completely disregarding historical precedence of Brady working within the guidelines to change a rule. If he knew about the PSI level and wanted it changed wouldn’t you think he’d follow the same path he followed with ball preparation? Of course not. It’s not like he deserved the benefit of doubt prior to this whole mess (rolls eyes). It’s much more convenient to latch onto a text that can’t even be connected to Brady in any manner what so ever.

    I don’t think it’s too much to ask to get a more global perspective on PSI levels as it pertains to weather for all the NFL teams. It’s fine to assume PSI levels would not be a problem for all but one team so long as you understand that’s anything but factual. Brady is on record (multiple times) saying he wanted the PSI levels set to just above 12. Nothing about getting rid of the PSI level or going under the minimum level. His lack of knowledge of the PSI level was within the context of events leading up to the Jets game the year prior. Which led him to wanting the balls set just above the minimum. Claiming Brady knew nothing about the PSI levels only proves people haven’t done enough factual research.

    What stand? The NFL process did interview Mcnally and Jastremski and they imposed the suspension. Then on the appeal they still imposed the suspension. Why did they need further testimony from Mcnally and Jastremski when the NFL already knew they were not going to overturn the ruling.

    The actual court proceedings didn’t need any NFL employees to testify. That’s not what it was about. It was about the NFL’s right to impose the punishment.

    After all this ended, the two guys were interviewed again by the league and their employment was reinstated.

    I don’t think there is anything more to know from them.

  98. I have no problem with how the NFLPA proceeded. It’s not their job to allege corruption on part of the NFL. Kessler’s job was to get the suspension and fines vacated. He could have gone down several paths. Fighting the NFL and how corrupt it was might have taken the focus away from the argument. He was also fighting for the NFLPA and not just Tom Brady and this was and is as much about the commissioner’s abuse of power as it is corruption. Give Judge Berman some credit here. He saw right through the corruption of the NFL and their really silly arguments comparing this to steroids and how they worked backwards to do industrial justice and that this whole episode was a second shot at exacting punishment for a spygate matter that was eight years old. Blecker is an academic. He is right about the absolute corruption of the NFL, but Tom Brady was in good hands with Jeffrey Kessler.

    Roger Goodell really needs to be taught another lesson on this one because Judge Berman obviously didn’t get through to his thick skull. I’d like nothing more than to see Tom Brady win the MVP of the Super Bowl and totally snub Goodell while taking it from him.

    I don’t think anybody is suggesting this brief will legally impact anything. I also don’t think you need intimate knowledge or experience in sports arbitration or specific knowledge of Labor Laws to highlight the flaws used by Exponent. Seriously, do you really need that type of knowledge to point out the difference in needle length and bend? I have a rudimentary level of statistical modeling knowledge and can come up with a cogent explanation how that in and of itself could impact the results. Not taht it matters since Blecker avoids that issue completely. He’s highlighting the fact that the physical differences in the needles make it practically impossible for an experienced referee (who handled the gauges dozens of times that day) could mistake which gauges were really used. Which is one of the underlying factors that Exponent used to draw the false conclusions they did.

The biggest tragedy in all of this is that the NFL can pay millions to investigate, but cannot spend 30 dollars to buy accurate Air Pressure Gauges and needles that are uniform in size, length, and NOT bent.     But then the murder victim shows up alive and well.

    See the problem? The science refutes that balls were ever deflated that day. Even Wells only accuses the Pats of deflating balls by .15 lbs on average, such a small amount it would be not worth the effort. No body, no crime.

    But the Patriots are cheaters, right? More than other teams, even though everyone is trying to get an edge and it’s always been that way. What about spygate? They were caught filming where they weren’t supposed to, a practice teams had long engaged in. What about the mysterious ESPN story if a secret stash of film and who knows what else, all buried by the league? Ok, you want to believe a story with unnamed sources knowing that those are likely the SAME sources who leaked the false info on the deflated balls…which the NFL refused to correct?

    The rest of the league seems to see Earny Adams the way liberals see Dick Cheney: as Darth Vader.

    There is simply no evidence the Patriots ever did anything different than all teams do. That’s why coordinators calling in plays during the game ALWAYS hide their mouths. It’s part of the game.

    Except the gauges were absolutely challenged in the appeal hearing. Ooops. All you have to do is read the appeal transcript. I’ll even help you … start at page 183.

I’m more than positive attending Tufts or Harvard will play absolutely no role in that particular ability. In truth, my cat might be able to do it. Even setting aside the completely obvious statistical implications behind the physical gauge differences, it does nothing to explain how Walt Anderson could possibly not recall which gauge he used to measure the balls before the game. Simply, if the NFL accepted what Anderson told them (that he used the longer logo gauge) all the PSI measurements fall within the acceptable range. End of story.

    Ummm, huh? The issue isn’t “flawed science”. It’s flawed scientific process and you don’t need to be “in science” to understand that what Exponent did was incorrect. To discount an Economics expert or somebody from MIT etc only highlights the fact you don’t understand that scientific process extends to the practice of statistical modelling which is something that has practical applications in other fields like Engineering and yes, even Economics. It’s fine that you want to claim a scientific expert hasn’t refuted Exponent. Just understand you have no idea how non-sensical that sounds.

    BTW, Professor John Leonard has a fantastic video on youtube that highlights what these other so called non-experts have been saying all along.

Some of the best schools in the country are in Boston. He has since lived in New York for 40 years. But he is still blindly loyal to the Patriots? What about the statisticians at AEI? Which is the only point Blecker is really highlighting in that article. I would submit even the most ardent Patriot supporter could also point out the obvious failures by Exponent to follow basic scientific process but if haters want to cling onto that by all means go for it. The NFL is extremely lucky the facts of the case haven’t been truly scrutinized. If that was the case the failure by Exponent (among other things) would be exposed pretty quickly.

    Setting aside the fact that even the league has now distanced itself from ‘the science’ and the Well$ report itself. The science is discredited in the Well$ report’s own footnotes. The single greatest flaw in said ‘science’ was the statistical model and baseline that ‘science’ ASSUMED, hence bringing in experts on THAT subject.

    Not of course that it matters to anyone promulgating falsehoods but at least if you read the publicly available documents you might be able to at least blow some Well$ian level smoke

    Lies. Tom Brady never once said he wanted balls deflated as much as possible. The petition from several NFL QB’s that I assume you are referring to never once mentions PSI or the PSI rules. Never. Not once. You’re a liar. He also never said he didn’t know there were rules about it. He is on record, under oath, stating that he instructed his ball boys to bring the PSI rules to the refs so that the balls were not improperly overinflated again.

    The texts about “deflator” are irrelevant because the science says no tampering occurred, and those texts were from May 2014. It was also part of his job to help with ball preparation which would include inflating and deflating footballs. The texts were also reconstructed in the Wells report with no time stamps and put in an order to make them look incriminating with other relevant texts that provided context that the texts had nothing to do with football were completely omitted (see the text about “pressure getting them done” which was actually in a conversation about getting tickets for someone to some other event). The ESPN text is referring to stealing equipment from the team, which is blatantly obvious when the texts are in the correct timeline and full context. And, I also find it curious that people put so much weight on those texts yet never, ever, mention the text after the Jet game that Jastremski sent his wife saying that the balls are supposed to be at thirteen. That text suggest there was no such scheme to deflate ever before.

    Wells and the NFL have every single text record of Brady’s. There is not one slice of evidence showing that he instructed anyone to deflate footballs illegally or otherwise.

    In short, you are an uninformed liar.

    Maybe you had better read Blecker’s brief. Well’s reasoning was hardly air tight, as a matter of fact it is highly flawed.

    The article also does not mention that Blecker is a known Jets fan and has been for decades.

    Also, if you read the documentation and not just headlines you’d know that the independence of the Wells report and its conclusions were called into question during the appeal in the NFL Offices. Also, the NFL tried claiming in Brady’s appeal heard by Berma that the investigator did not have to be independent, after spending months trying to tell us he was.

    The lack of integrity here is found within the walls of the NFL Offices.

    The difference here would be that I would be investigating something we know actually happened. You’re just living in a fantasy world, desperate for any kind of evidence that would validate the punishments that have already been imposed.

    Pretty pathetic that even after punishments have been imposed, you still need more evidence. That’s basically an admission that what the NFL based their punishments on wasn’t enough.

    My dislike of Tom Brady did not start with deflategate or even with a loss or losses to the Patriots in any game. My dislike of Mr Brady began November 30, 2014 when the Patriots visited Lambeau field. I sat right behind the Patriots bench. Myself and quite a few children had the pleasure of hearing Brady’s repeated screaming f-bombs on the sidelines as his team got thoroughly beat. His fans excused his boorish behavior as competitiveness. In reality he’s just a selfish jerk. Even if he or his team never have to pay a price for their unethical practices, just for his actions that day, I hope his legacy is forever tarnished. Thanks Tom for teaching a lot of little kids in Wisconsin that if you’re a rich and famous athlete it’s OK to swear at the top of your lungs in public.

  153. This is so awesome, when I first saw the headline I thought it was something frivolous, but it’s no small deal that a lawyer would do this. It puts everything the league did to railroad Brady out in the open, and maybe they will be held accountable for it, finally.

    I know a lot of people here blindly hate or love the Patriots, but the integrity of the game truly was spit on by the NFL, and it is becoming more apparent to everyone. Fans of The Saints already knew this, and Pats fans didn’t listen. Well now Pats fans know this and a lot of fans still aren’t listening. That could go a long way into proving if this was a case of low level gamesmanship or if it’s indeed a weather related concerned. My ten cent bet is they haven’t bothered or the data further weakens the leagues case. And two the most outrageous part of the draft pick thing is that, per the ESPN report that stated former employees of teams the Pats beat in Super Bowls knew there had to be cheating because it’s the only way they could have lost, basically a makeup call from the Spygate overreaction. Which proves Kraft wants to stay in the good graces of his fellow owners, nothing more nothing less.

    HE STILL REFUSED TO COOPERATE !

    He also gave testimony that was deemed less than credible based on other evidence.

    The arbitrator made clear that Bradys actions amounted to OBSTRUCTION of the investigation.

    He was suspended for CONDUCT DETRIMENTAL to the game for among other things, that LACK OF COOPERATION AND OBSTRUCTING THE INVESTIGATION !

    FOUR MONTHS LATER, In appealing his suspension, he revealed he DESTROYED THE PHONE WITH THE EVIDENCE IT CONTAINED.

    Once this was questioned, It was determined that this DESTRUCTION OF EVIDENCE OCCURRED ALMOST SIMULTANEOUSLY WITH HIS BEING DEPOSED BY THE INVESTIGATORS !

    In a FURTHER AFFRONT TO THE LAW, he tried to give the NFL A LIST OF 9900 phone numbers involved in texting on that phone and suggested the NFL contact those people and ask for any information they retained, ESSENTIALLY ATTEMPTING TO TRANSFER HIS DUTY TO PRESERVE EVIDENCE AND COOPERATE TO OTHERS !

    After the arbitrator added an additional ADVERSE INFERENCE for the SPOILATION of evidence, Brady took to facebook and crafted a statement that REQUIRED you to read, and re-read, it multiple times TO UNDERSTAND THAT HE WAS BEING DISHONEST WITH ANYONE READING IT !

    BRADYS ACTIONS DEPRIVED THE INVESTIGATION OF EVIDENCE THAT HE HAD A DUTY TO PROVIDE, HAD A DUTY TO PRESERVE AND THAT MAY HAVE PROVEN HIM GUILTY BEYOND THAT WHAT WAS REQUIRED !

    HOW ANYONE CAN SAY THE NFL WAS THE ONE BEING UNFAIR IS BEYOND ME !

    It’s IMPORTANT THAT THE COURTS REALIZE THAT THE PERSON SEEKING RELIEF IN THIS INSTANCE WAS SINGULARLY RESPONSIBLE FOR HIS BEING SUSPENDED FOR CONDUCT DETRIMENTAL, NOT FOR AN EQUIPMENT VIOLATION !

    Giving this RELIEF WOULD SET A TERRIBLE EXAMPLE for anyone involved in any actions in the future !

    “FYI, Dave will be picking your brain later about it. He’s not accusing me or anyone. Trying to get to the bottom of it. He knows it’s unrealistic you did it yourself.”
