Release of 13-year-old court document dusts off Peyton Manning incident at Tennessee

In the early days of PFT, an article emerged regarding a defamation lawsuit filed against Peyton and Archie Manning. The litigation, which arose from an allegation that the Mannings defamed a former University of Tennessee trainer in a book they had written (Peyton said that the trainer had  a “vulgar mouth”), sparked the publication of an accusation that Manning had placed his “naked butt and rectum” on the face of the trainer while she was examining him in 1996.

The longest-standing members of PFT Planet know that, from time to time over the years, we’ve used the phrase “naked butt and rectum” in reference to the story, which never caught fire in the pre-social media days of the Internet — even though the USA Today item was titled “Manning’s image could take hit in suit.” That article, which didn’t characterize the incident as a sexual assault, apparently flowed from a 74-page document filed in the defamation lawsuit. USA Today didn’t publish the full document, and it released no details beyond the reference to Manning allegedly placing “his ‘naked butt and rectum’ on [the trainer’s] face.”

Now that Peyton Manning has won his second Super Bowl and potentially will be walking off into the sunset, the same 74-page document has been sent to the New York Daily News.

The ensuing #longread from Shaun King of the Daily News is at times hard to follow, as it attempts to summarize most of the 74 pages in chronological order. Also, King’s article displays a clear anti-Peyton bias, and more than a little melodrama. This #notaslongread item comes from the 74-page document itself, which has been published in full by the Daily News.

Before going any farther, it’s important to understand what the 74-page document is, and what it isn’t. The 74-page document is a piece of advocacy. The 74-page document is something that was written by the lawyers representing Jamie Ann Naughright in her defamation case against the Mannings. The 74-page document is, necessarily, one-sided.

The 74-page document is not objective. The 74-page document is not supposed to be objective. The 74-page document is not a court order or any other decision made by a neutral party. And, ultimately, the 74-page document is incomplete without comparing it to the corresponding “Facts of the Case” document submitted by the defendants in the case.

There’s another very important, and intriguing, way in which the 74-page document is incomplete. While it contains testimony and allegations about the “naked butt and rectum” escapade, Naughright’s lawyers redacted when filing the 74-page document large chunks of information regarding an earlier alleged incident from 1994. At page 10 of the 74-page document, the lawyers for Naughright explain that, because Peyton Manning’s lawyers had asked that “certain exhibits and deposition testimony relating to this 1994 incident be designated as part of the ‘confidential record’ and not publicly be revealed,” the information absent from the public document was filed “under seal,” meaning that only the presiding judge and the judge’s staff could see it.

This means that the information about the 1994 incident was in some way more sensitive than the 1996 “naked butt and rectum” incident, which was detailed in the 74-page document, without redaction. Common sense suggests that this means the other incident possibly was more graphic and/or inflammatory and/or offensive and/or problematic for Peyton than the “naked butt and rectum” incident from two years later.

At page 14 of the 74-page document, Naughright’s lawyers tell the story of the 1996 incident, with excerpts from Naughright’s deposition regarding what allegedly occurred while she was examining Peyton Manning’s lower leg for a stress fracture.

“It was the gluteus maximus, the rectum, the testicles, and the area in between the testicles,” Naughright said. “And all that was on my face when I pushed him up and off.”

The 74-page document then alleges that Manning worked with another Tennessee trainer, Mike Rollo, to “hatch a story” that Manning was “mooning” another UT athlete. That was the version, according to Naughright’s lawyers, that Peyton Manning and Rollo provided to investigators and the media, and it was the version that appeared in the Mannings’ book.

In the 74-page document, Naughright’s lawyers attempted to expose that the “mooning” explanation was fabricated, describing the incident instead as a “sexual assault,” with Peyton Manning “committing a disgusting act and showing his contempt for someone he did not like.” The effort to debunk the “mooning” contention includes an affidavit from the alleged recipient of the “mooning,” Malcolm Saxon, along with a December 2002 letter from Saxon to Peyton Manning in which Saxon tells Peyton “you messed up” and urging him to “take some personal responsibility” for the situation.

“Coming clean is the right thing to do!!” Saxon writes to Peyton Manning. “You might as well maintain some dignity and admit to what happened.”

The 74-page document also alleges that Peyton Manning later taunted Naughright by reenacting the incident two other times.

“Mr. Manning looked at me. The athlete was behind me. He pulled down his pants and sat on the athlete’s face,” Naughright testified as to the first incident of reenacting/taunting.

“Mr. Manning saw me,” she testified as to the second incident of reenacting/taunting, “walked over to the gentleman, pulled his pants down, and sat in the gentleman’s face while looking at me, pulled his pants back up, looked at me, and headed off to the locker room.”

The 74-page document contains other allegations aimed at showing that Peyton Manning had disdain and dislike for Naughright. The 1996 incident apparently was used against Peyton Manning in the Heisman Trophy campaign, which allegedly left him bitter. (Peyton admitted under oath that he said to Archie, “I’m not going to win the f–king trophy, read the papers, it’s going to [Charles] Woodson.”)

Also, Archie Manning allegedly made comments to the ghost writer of the Mannings’ book regarding Naughright, including an alleged statement from Archie Manning to the ghost writer that Naughright, who is white, “had been out with a lot of black guys.”

Again, the entirety of the 74-page document published by the New York Daily News was prepared by the lawyers for Naughright in connection with an effort to win her lawsuit against Peyton and Archie Manning. It’s not apparent from Shaun King’s article that he sought comment or a response from Peyton or Archie Manning. (PFT has reached out to Peyton’s agent, Tom Condon, for comment.)

It’s unclear how much traction a 13-year-old court filing regarding a 20-year-old incident will achieve, but I’ve already been alerted to the item published little more than four hours ago by at least four different people, and the article seems to be catching fire on Twitter. So there’s a chance that in this first weekend without NFL football since Labor Day, NFL fans will notice this one, even if few take the time to read all 74 pages of the document.

  1. So much for the carefully crafted “Aw shucks” image. Seems like the Mannings have been managing this phony image for decades. It also makes the thought of the Mannings sending their boys over to “visit” the HGH source (who the next day, recanted his hours of implicating discussions) all the more plausible. And the national media (including ESPN and Manning rump swab Nantz et al) won’t even mention it yet treat Tom Brady as a criminal. Hopefully, a few real journalists will continue to explore these allegations.

He cites to the “facts of the case” section of the filing as if it was written by the judge rather than the lawyers of a woman suing for millions of dollars. The only time he does cite a judge’s opinion, he insinuates that the judge agreed with the facts — but that too shows his ignorance. When a judge decides a motion to dismiss, the judge is required to accept all of the plaintiff’s allegations as true. The motion to dismiss is granted only if, after accepting all of the plaintiff’s allegations, the plaintiff’s claim does not entitle her to relief.

    I really don’t see why the NFL and media are out to tarnish the reputations of two of the best QBs it will ever see play.

But, since all you care about is a specific single elimination game, then we should include their head to head single elimination games. I believe that is 3 – 2? I would take more stock in that one, as they are facing each other, but that’s just one variable…I know more than one thing.

    And lastly, to the individual who says that Manning destroyed a doctor’s career, well I can say that I had looked into this doctor for a family member, and had serious doubts about their treatment methods after reading numerous articles about them several years ago, so I don’t think Manning was the first to cast doubt upon this doctor….

There’s a reason USA Today had this story years ago and did almost nothing with it; they’re real journalists. I was reading some of King’s writings about white privilege on the Daily News website. Looks like he wants to take down a white sports icon regardless of the facts.

    But do not worry Manning apologists, the 4-letter network and most of the media has been giving Peyton a free pass to do anything good or bad without an iota of criticism for the last 20 years. That will not change.

    Florio, you’re right to point out that this document is a piece of advocacy rather than factual findings made by a judge. Doesn’t make the allegations untrue, but you have to take them with a grain of salt.

    The story would have benefited from more careful editing and at least a once-over by someone with more than a passing familiarity with the legal system. That would require the NY Daily News (!) to care more about the integrity of the reporting than generating clicks.

  45. The victim of Manning’s real classy act was against a highly regarded professional psychologist working for the same university that Peyton was playing football for. She was examining Peyton for a stress fraction when this ass wipe act occurred, so no way you can find fault with her unless you don’t mind Manny putting his ass and testicles on your face? If you read the main parts of this story and the court documented testimony, you will understand that it was Manning who broke the confidentiality clause in their agreement years earlier and then put more reputation smearing lies in his book after she built up the same sterling reputation after going to work with Florida, this according to many who have worked with this women. That sucks anyway you want to look it and this has more than a 50% chance of blowing up on Manning’s face this time… as more study and read the court papers which were taken under oath, keep in mind. Add the HGH drama and if Manning did this the gloves will be off very soon.

    Cam Newton just went through a tough media ordeal. Peyton hasn’t always had it easy. He’s experienced many tough losses and is now facing crumbling skills, injuries, and a tough retirement,

    King may not be a great writer, but the court docs dont lie. There was a 3rd party witness and THREE settlements, one paid by Tennessee, one paid by Peyton for defamation (which are hard cases to win which shows the trainer had evidence against him) and another one paid by Peyton for violating a court order against speaking publicly on the incident.

    Brady has a checkered history of scandals? Deflategate was a manufactured scandal that a judge laughed out of the courtroom, what else are you referring too?     Is there a reason either of those stories should have stayed hidden? It’s only a “leak” if someone’s trying to suppress something. And that’s actually what journalism is all about: getting to the crux of something that “some people” want to stay secret. I’m glad the Clinton story came out. And even though this isn’t a new story, it’s a new story to me, and I’m glad this story came out.

    Last week my son, a college freshman, and I were talking about who we were rooting for in the Super Bowl. I told him I was hoping Manning would get to 2-2 in Super Bowls so as to get some people off his case. I told him I thought of Manning as an excellent role model. So I care about this story because I care about what I said to my son. I try to be the best role model I can be for him, but I acknowledge that he, and all youth, look up to people besides just their parents. So the least I can do is try to steer him in the right direction. If this story about Manning is true, it absolutely matters to me. And I couldn’t care less that the NYDN published old news 20 years later. In fact, I’m grateful, and I hope they continue to pursue the story until we all know the truth.

    You have to read the documents before you jump to “there is no proof”. There was a 3rd party witness testimony (ie proof) and a judgement ruling that their was sufficient evidence that it occured when the Mannings smeared her in their book and she brought a defamation suit. Also the “mooning” characterization was brought by her supervisor who was not there and whose version of the story Manning latched on to afterwards. And what in the world does her “methods” have to do with whether Peyton sexually harrassed/assaulted her? Why did Tennessee let her work there for 10yrs if she was so terrible? What does it matter anyway? The fact that there is a witness and that Peytons story only matched her supervisors and no one elses version speaks to the weakness of their argument.     Let’s dispel a couple of things that you and some posters may be a little confused about.

    RE: HGH

    A package was sent to his wife, Ashley, that may or may not have contained HGH. Let’s assume it did. Why do you and everyone assume it was reall secretly for Peyton?

    You are aware that MILLIONS of Americans take HGH for a variety of reasons, right? About 10 years ago, an entertainment reporter wrote a piece about how HGH was the new “It” drug in Hollywood and described it as a combination of Botox and Cocaine. Why? Because a lot of people think HGH has anti-aging properties, and everyone in Hollywood was doing it. It was WIDELY abused (and according to the report, still is).

    So it is entirely plausible that, if it was HGH, that it very well could have been for Ashley. This may shock you, but a lot of wealthy women in their 30s are quite concerned about their physical appearance.anti-aging properties.

    It’s not out of the realm of probability that his wife could be taking it for its anti-aging properties. Furthermore, it also has been prescribed for reproductive reasons. And remember, they had twins only a few years ago (Which would put Ahsley in her mid-30s). It very well could have also been taken for reproductive reasons. (They also had twins, which could be naturally-occurring or the result of fertility drugs, which would further illustrate they were trying to get pregnant.)

    Now for this latest allegation…from 20+ years ago.

    This truly is a he said/she said. He was being examined for a sports injury and the trainer claimed he moved in a way so his butt and part of his private region touched her. I don’t mean any disrespect to women, but after reading the NY Daily News article, this could have easily been a misunderstanding. We are talking about a teenager getting his foot examined.

    But what if it’s not a misunderstanding? What if it’sa the “worst-case scenario” of him purposely doing it?

    It’s nothing any of us would condone, but let’s put this in perspective. This is not a sexual assualt in terms of him forcing himself on her, raping her, touching her private parts, etc. He was an 18-/19-year old teenager. It was the mid-90s. If this is 100% accurate, most of us would consider this a “prank”. Remember, this was 1994 and the world was a different place, a much less sensitive and PC place.

    Embarrassing? Yes. But to paint Peyton as a bad guy for this alleged incident that happened 20+ years ago is really reaching to me, especially when there is absolutely no proof that he purposely put his “buttocks” and private parts on her. I’m also curious as to why this comes out the week after he wins the Super Bowl. ANd PFT, why do you delete this comment?

  200. I did some research and learned that Manning did in fact settle this lawsuit. His attorney might argue that many famous people have settled lawsuits to avoid the costs and potential bad press that can come from any such litigation. But common sense tells me that no one settles a suit with no merit. Some judge must have listened to the motions and decided the plaintiff could proceed. Where there is smoke there is fire. It may be a little fire but can still burn you.

    I suspect that Peyton Manning is the good guy we all believe we know and respect. I think this HGH investigation will confirm my belief. Did he stick his “Butt” in the trainer’s face? Maybe! Did Brett Farve email a picture of Mr. Who-Ha to that Jets chick? Did Roethlisberger have an episode in a bar bathroom with some babe? The saga goes on and on! Who sells more junk on TV than Brett Farve? Amswer – Peyton Manning! How many Papa Johns pizza joints does Peyton Own? Can he ever spend all of the money he has earned?

    I suspect that you will see Peyton on CBS or Fox as a commentator. I also suspect that he will be drinking a beer on TV! This is a non story unless you are addicted to tabloid articles.

    I’m a Seahawks fan and I do not like him. I think he is one of the most talented QBs in NFL history, but his playoff performances are terrible (even this year) and suggest he cannot perform in the clutch. He should have accomplished more (won more championships and playoff games) given the amount of talent he has and the amount of talent he has been surrounded with his whole career.

    I know about 10 other people who are not Pats fans who agree.

    Note that the background of Sly checks out perfectly – he worked at the Guyton Institute at the time when Peyton was a client (and I’m sure it’s just a coincidence that his WIFE now gets shipments from them)

    Sly however magically recanted his story – though he went on record to state he had no idea what or why he was recanting it

    This all happened the day after two men posing as police officers who work for the Mannings showed up, not at Sly’s house – but his PARENT’S home – prompting his younger sister to call 911 in alarm (listen to the tape)

    All this may sound like the actions of an innocent man – but the rest of us are a bit skeptical

    Especially since it’s the same tactic used to squash the Sexual Assault that Peyton was involved in.

    Maybe if Peyton does what Brady did – insisting on stating his innocence under oath, under penalty of perjury – maybe some might be inclined to believe him – but for some reason Manning refuses to do so – and they could also clear this up by releasing their Guyton Institute medical records. Again – they refuse

    Yeah – innocent… right.
