Judge refuses to restore Patriots’ first-round draft pick

A group of Patriots fans has sued the NFL in an effort to restore the first-round draft pick that was confiscated as part of the #Deflategate punishment. A judge has quickly chimed in regarding an attempt to get the pick back in time for this month’s draft.

Via the Boston Herald, Judge F. Dennis Saylor has summarily denied the request to replenish the pick pending the outcome of the litigation.

“After reviewing the complaint, it appears highly unlikely that plaintiffs will succeed on the merits of any of their claims,” Judge Saylor wrote.

It was as dramatic a slam dunk as a court can deliver.

“The Court is denying plaintiffs’ motion without the benefit of an evidentiary hearing or an opposition brief,” the order explains. “However, the federal courts are courts of limited resources, funded by the taxpayers, and it would not be a prudent expenditure of those resources to permit the motion to progress to the hearing stage.”

Judge Saylor’s assessment of the lawsuit hints strongly at the possibility of an award of litigation costs and other penalties against Seth Carey, the Maine lawyer who signed the civil complaint. The Federal Rules of Civil Procedure prohibit frivolous filings, allowing for a wide range of sanctions.

Although the courts rarely dirty their hands by meting out so-called Rule 11 punishments, Judge Saylor’s initial reaction to this specific lawsuit suggests that a much stronger reaction could be coming later.

    Second, I absolutely hate the argument of this being a waste of taxpayers money because it is just an emotional appeal to the masses. The fact is the judge and all those associated with the court don’t get paid for every case they sit in. They get paid regardless. If dealing with such lawsuits is part of the day, then it is part of the day. There is no extraneous expenses involved.

    He wasn’t fired. He was suspended. And has since been reinstated.

    Initially it was reported that the NFL requested the suspension, but they denied it. However, in order for him be reinstated, the NFL said they had to approve it. It kind of seems incongruent that they would insist on having final say on his reinstatement if they didn’t actually call for the suspension in the first place.

    It is a cost of any business. Resources are never utilized at 100%. So again, to pretend this “costs” the taxpayers anything is silly. Cases will be there today, tomorrow and the following day.

    If you want to make this an argument on cases like this making the courts inefficient, I can assure you that any government agency (as well as most businesses) have processes far more inefficient than this.

  10. First of all, Belichick usually trades out of the first round. And he was able to trade for a second rounder, so Patriots fans should be happy with the draft picks they have — 11 in all. Plus knowing they didn’t have the first rounder allowed Belichick to be more freewheeling than usual in free agency. We have some excellent pick ups.

    They would not have beaten the panthers, Pat’s defense was nowhere near the broncos and their o line would have crumbled from the panthers pass rush, just like they did against the broncos and dolphins in the previous games.

    That’s cute, a Miami fan bringing up other sports by way of taking a swipe at Boston fans. How many times have the Panthers won the Cup again?

    Fun fact: When it comes to historical rankings of cities by Big 4 pro championships Miami ranks 16th with 7. Heck Cleveland has more and they don’t even have a hockey team. Green Bay has almost twice as many championships and they only have one team. Only NY has been home to more champions than Boston and they have twice the number of teams.

    Looking at more recent results, the Pats alone have won as many rings as all 4 of Miami’s teams this millennium.

    As a Patriot fan, abninf’s comment is proof that haters have no clue about the whole Deflategate story. First, the Deflator was not fired. He was suspended indefinitely. It’s kind of a goofy finding, and will most likely be overturned.

    Would someone explain how going to federal court twice over .02 pounds of air pressure which could very well be explained by cold weather and add the fact that the oppositions game balls also came in under pressured is worth the millions spent and the time taken away from federal courts? As silly as it was for these “fans” to proceed it seems criminal that the powerful NFL has used it’s influence to tie up valuable time at great expense to taxpayers.

    Sure, find me where in his ruling the judge found Brady guilty. C’mon, we’ll wait. Here’s a tip. Don’t bother looking because it isn’t in there because he never ruled as such. On the contrary the judge basically said he didn’t need to rule on that but if he had to, well, you figure out what he would have said. That the NFL so botched the case he never even had to get to the actual hearing before Goodell because everything leading up to it was fubared by the NFL.

    Is it really a surprise they talked more after the news of a scandal involving them broke? I’ve never talked to you. If Florio all the sudden emails me saying he thinks you and I hacked his site or something I’d probably want to talk to you. I don’t get this “Angle” at all, seems quite logical they would want to talk about it. To me the more fishy thing there is why Rodger lied about they did talk about after. And I think you fell for that part of it. Goodell is very good at foooling…certain types of people with his carefully chosen words, I’ll give him that. Looks like he got you.

  57. Brady was never and will never be cleared in this case. The footballs measured below legal limits even after if the idea gas law was taken into effect. Brady challenged the science in his appeal hearing and the points that were challenged were in fact taken into considersation. However, what really hurt was that the author of the report basically challenged on errors he thought were made and had no expermentation documents to back them up. All of these other reports that have challenged the NFL’s wrote papers, none did experiments to back them up. More of an interesting question is why Robert Kraft has not hired his own team to conduct experiments to disprove the tampering? And anyone with any real knowledge knows why, he doesn’t want his own experts to confirm that the NFL’s findings. Why do you think in their latest round of PR they claim the idea gas law or nature COULD have accounted for the air loss. Flip side of that, the NFL’s experiments that proved that nature could NOT have accounted for it.

Proving the balls were tampered with. The Pats have not and can not prove other wise. The NFL has met their burden of proof. Roger Goodell did not lie about the conversations and the communications between TB and JJ. He said he did not believe Brady’s account of them. If you still cling to the hope that the Patriots deflated the AFCCG balls by less than 0.5 psi, Brady proved in the second half against the Colts and in the Super Bowl (that they won if you’ll recall) that inflation doesn’t seem to make a difference.

    The first three championships (’01, ’03, ’04) were before the memo the NFL office sent about the location of filming. The Patriots and all the other teams could film from any location.

    This is the level of intelligence of the average NFL football fan. No wonder they can’t comprehend that air, which is primarily nitrogen (78%) not oxygen (21%) expands with heat, contracts when cooled. For what it’s worth, both pure Oxygen and pure Nitrogen are ideal gasses.

    The reason for the term “ideal” in Boyle’s Law (aka the Ideal Gas Law) is not because this law somehow only applies to “ideal gasses”, it’s because the formula is only [i]exactly[/i] correct for an ideal gas. ALL gasses, regardless of how contaminated, expand and contract with changes in temperature. Period. In the case of a non-ideal gas that expansion is increased or decreased very slightly by the small fractions of the gas that in not a pure gas.

  81. Here’s what NFL & ESPN convinced the headline reading/watching masses to believe – On Jan 18, 2015 a Patriots 48 year old overweight ball boy named Jim McNally, displayed superhuman speed and dexterity while accomplishing the following in just 90 seconds:

    Start the clock — Jim McNally was filmed entering a bathroom and was then able to remove 12 footballs from a large bag and gauge them and then remove a precise amount of air from each of the 12 balls. He would have to gauge each ball again to verify that all 12 would all have the same pressure. (If he removed much air from a ball he would have to insert a pump and add air and gauge again). In those same 90 seconds McNally was also able to run across the football field unseen by anyone or the video camera outside the bathroom and locate the unattended Indianapolis Colts football bag. Then using the same psychic powers McNally had already used to predict the NFL sting, he selected the same 4 footballs that would later be checked by the NFL during half time. After gauging them and removing a precise amount from 3 of the 4 balls and gauging the pressure again he glanced at his watch he saw that he only had 10 seconds left so he didn’t have time to do the 4th ball. So he put them all back in the bag. Then with just 9 seconds remaining he sprinted back across the field unseen by anyone or the video camera outside the bathroom so that he could use the remaining time to catch his breath and then exit the bathroom while moving slow enough for the video camera to capture his image at precisely 90 seconds. — Stop the clock.

    Believing that McNally has superhuman & psychic ability is far more believable than accepting that a 48 year old guy might want to take 90 seconds to relieve himself & wash his hands before watching a 2+ hour football game. Or being able to comprehend that leaving a bag of NFL footballs worth over $1200 unattended on the ground outside a bathroom, when they are going to be needed for a nationally televised game in a few minutes, while you take a leak might be a bad idea. (Occam’s razor suggests that he took a leak)

    It must be easier for the uneducated and or biased masses to accept superhuman and psychic powers of McNally while denying a scientifically accepted law that explains that the pressure in footballs or car tires or any sealed container is lowered when the temperature drops. It’s not “deflation” because no air escapes, it’s just a lowering of the pressure of the air still in the container. (PV = nRT)

    The NFL knows that basic science is way too complicated for the low performers on the left side of the bell curve so Goodell will confiscate draft picks while hiding behind the “deflation” farce. The NFL is helped by a small volunteer army of biased low performers that continue to repeat false information in online posts.

    On a side note — why does my car have a tire pressure indicator, is someone removing air from my tires — and why does this air removing miscreant seem to always wait for the 1st really cold day of the year to remove the air and set off my cars tire pressure indicator? According to the NFL and intellect challenged masses someone had to do it and it can’t be explained by science or weather.
