Report: Peyton Manning won’t sue Al Jazeera

Peyton Manning has plenty of decisions to make, now that he has retired. One of the first decisions he made was a smart one.

Christine Brennan of USA Today reports that Manning won’t be suing Al Jazeera over the report that HGH was delivered to Manning’s wife in 2011, while Manning was dealing with chronic neck problems. Per Brennan, the decision came “after a dozen conference calls with attorneys” prompted Manning to conclude “that he doesn’t want to spend the time and money necessary to file a lawsuit that would make public the personal records and private lives of both he and his wife Ashley.”

That’s precisely what a defamation case would do, especially since truth is the ultimate defense to a claim of libel or slander. A lawsuit would give Al Jazeera license to demand the production of all medical records reflecting treatment received by Peyton or Ashley Manning at the Guyer Institute in Indianapolis, and anywhere else.

Brennan also explains that Manning is watching closely defamation lawsuits filed by baseball players Ryan Zimmerman and Ryan Howard against Al Jazeera arising from the same documentary. If/when those cases are dismissed, Manning will know that his case would have been dismissed, too.

Frankly, dismissal would have been the least of Peyton Manning’s problems. If the medical records suggest that Ashley Manning did indeed receive HGH for use by Peyton, that information could then be used by the NFL as part of its own investigation that according to Brennan remains stuck in neutral, five months after the report came to light. With Manning possibly aspiring to run an NFL team in the future, its possible that he’d be disciplined as an executive for violations occurring as a player.

Without litigation or some other court proceeding that will bring the information to light, the NFL has no way of obtaining the documents. Unless, of course, Peyton and Ashley Manning execute the appropriate legal documents authorizing the Guyer Institute to provide that information.

At one point, Peyton Manning suggested that he’d allow the NFL to examine that information. He may have a different feeling on that issue, now that his playing career is over.

Then imagine if Belichick tried to trip a player like Mike Tomlin did? Then imagine… You get the point. Double standard? you bet. Total jealousy? for sure. Will your team beat the pats this season? nope.

  3. Move on. The Manning’s ordered the drugs. Did Peyton use them? No clue. It certainly did not improve his on field performance. Did his wife use them? After years of trying t o get pregnant, she suddenly had twins. Draw your conclusions and try to focus on your life!

  33. There’s two main aspects to this:

    1) He’s not helped his case by giving partial answers, then saying the NFL could have full access but actually not giving it and instead sending his own team to clean up at Guyer, and sending his own heavies to threaten Sly’s elderly parents enough for them to call the police. And now he won’t sue, despite all his resources.

    2) The NFL doesn’t need full disclosure or Peyton’s signature etc for it’s “more probable than not” level of proof, they just need to ask: “Peyton, are the claims true and if not can you categorically say so and provide at least a doctor’s letter, or just their phone number, or get Ashley to sign a declaration? – do something, anything, to demonstrate it was for her? – otherwise you probably broke a rule.”

    It’s becoming clearer, from point 1, that he probably took HGH. And from their lack of applying their low-standard of “proof” it’s crystal clear that the NFL just wants it all to go away.

I can hear the conversation: look Peyton, you’re on your own on this one, we’ve done all we can. right now we need to keep our attention on covering our own butts. There’s a lot happening right now, just try to fly under the radar. With the Brady case and the CTE issue, it should be easy to do.

  39. If Ashley Manning had a legitimate reason for HGH, there would be no chance whatsoever she would be getting it shipped to her home by the dubious “Geyer Institute”. They’d have a legit doctor give it to her, one willing to vouch for them. I can’t imagine what the NFL would do to Brady if his wife were the conduit for PEDs like this.

    Brady handed over all cell data (and went above and beyond and provided emails as well, which were promptly leaked by the NFL who promised privacy) and NFL also interviewed everyone they thought had information they needed. Peyton Manning has provided no such information and is impeding any investigation by not opening the files.

    Doesn’t mean he is guilty at all, but if you are comparing the two cases , Brady was astronomically more cooperative than Peyton. And further, I think the NFL’s horrific character assault on Brady and his privacy is rightfully making Peyton very hesitant.

If he took it because he loved the game so much and wanted to get back out there it’s one thing. But it’s more egregious that he is pointing fingers at his wife, trying to sell us a silly story that his wife would go to a shady clinic with real tangible connections to the biggest PED scandal in US History to get a “fertility drug”…. instead of going to her own obgyn clinic.

    I’m so glad Brady never did it. I wasn’t sure for a while but it’s clear to anyone with a brain that he didn’t despite the league’s continued efforts to convince us otherwise. I prefer integrity to be associated with the 4 time World Champion Patriots. We win the right way through hard work, being smart and paying attention to detail. We play and win as a TEAM not a collection of separate taxi cabs.

    PEDton is a dirty filthy cheat who despicably used his wife’s name to cover up his cheating. He belongs in the HOF just as much as Bonds belongs in baseball’s, which is to say not at all.

  100. PEDton* should have taken advice from ex NY Yankee Andy Pettitte. Pettitte also cheated with HGH but he owned up to it, said that he just wanted to heal quickly to get back on the field, and apologize. Now he is looked at favorably by baseball fans.

    No using his wife as a shield, no lies and denials, no hired professional spin doctors, no using his family’s connections around ESPN and the league to squash the story and certainly no hired goons showing up at the source’s family home.
