Seven weeks later, no action from the Second Circuit

On May 23, Patriots quarterback Tom Brady requested a rehearing of the appeal that reinstated his four-game suspension arising from #DeflateGate. Nearly seven weeks later, there hasn’t been a peep from the U.S. Court of Appeals for the Second Circuit in response to the petition and a flurry of friend-of-the-court briefs.

Per a source with knowledge of the situation, the court has taken no action on the request.

Options include granting a rehearing before a three-judge panel, granting a rehearing before the full court, or denying the request entirely. The Second Circuit also has the option of requesting a response from the NFL, which by rule may submit a brief opposing a request for rehearing only if specifically directed to do so.

If a rehearing is granted, Brady undoubtedly would be available for the first four regular-season games, and possibly for all of 2016. If the petition is denied, Brady would have to decide whether to ask the U.S. Supreme Court to take up the case, and whether to seek an order from Justice Ruth Bader Ginsburg staying the suspension until the Supreme Court decides whether to take the appeal.

Even if Brady ultimately loses in court, he successfully has avoided the suspension for a year — and he possibly will avoid it even longer.

  2. The football PSI was never given a thought until the NFL tried to screw the Patriots for their success. Now, with these rule changes it appears the NFL thinks it is the most important factor in the games….except they won’t release any of their data to the public. Is this Transparancy?

  3. The NFLPA, and by extension, Brady, are simply trying to delay until such time as Brady retires, which will make the whole issue moot.
    Want a quick end to the matter? Have the Hall of Fame incorporate a rule that no player with a pending suspension can be inducted. The appeals would be dropped immediately and Brady would meekly serve his suspension so he could be inducted.

  6. Um… First, Brady was caught doing anything. In fact, no evidence exists that anything happened. And second, a black QB was caught altering PSI of footballs. Carolina vs Vikings in 2015. Only a few weeks before AFC champ game. The punishment for ACTUALLY ABEING CAUGHT… a warning.

    As much as I hate defending Brady, cause I really dislike him. But the NFL has been down this road before (somewhat) with 3 players suing them to get out of suspensions during the Starcaps case. The 3 players were Pat Williams, Kevin Williams and Will Smith. All 3 were black players.

    This issue has nothing to do with white or black, and everything to do with players who just won’t admit they were found doing what they were doing.

    Brady was caught doing nothing. Absolutely nothing. There is not a shred of evidence of Brady violating any NFL rules. None.

    Even if there were compelling evidence that Brady had violated rules – and there isn’t – the legal issues would still be legitimate. The players collectively bargained penalties for equipment violations (which is what this would have been, had it occured, which all of the evidence suggests it didn’t) and those penalties start with fines.

    But there’s no evidence of any wrong-doing on Brady’s part. None. Nothing.

    This is not about race at all. It’s about a union opposing management. It’s exactly the same as the Starcaps case. That took multiple years to resolve and several of those players were black.

  11. Maybe they are actually reading the appeal this time instead of making a judgement immediately like Chin did the last time. The first paragraph of his judgement reiterated two falsehoods..one on the intercepted ball and then on how that ball was handled..maybe this time he will actually have a grasp of what happened.

  12. Jeff Blake a black qb said he deflated balls for 15 years. Nothing done to him. Chargers qb in 2013 had equipment guys put stickum on ball, got caught and when asked by officials for ball refused to give it to them. NFL fines them 20k for this equipment violation. Jets kicker equipment guy got caught tampering with ball equipment guy gets suspended. Bikes get caught heating ball up on camera and got a letter of warning. All of these actions were to get a better grip on ball and NFL didn’t care until Ravens and colts started this accusation. Colts stuck a needle in pats ball on sideline, had 3 of 4 balls tested and were under legal psi and nothing done by NFL. The NFL should never have brought this into federal court to begin with.

    Here is a great example of someone who hasn’t paid attention at all to this travesty since B$PN’s Mort released that phony, lie about “11 out of 12…”

    In fact, Cam Newton and Teddy Bridgewater also played with under inflated footballs that same year! They were seen by millions of people, on TV, having their footballs warmed up with the sideline heaters. They were doing this because the cold temperature naturally lowered the psi. For this clear case of tampering, they were quietly given letters of warning.
    Yet, the NFL still doesn’t believe cold reduces psi in footballs. Only in tires, basketballs, and soccer balls.

    The Well$ Report and science have conclusively proven that Brady’s footballs deflated naturally. Therefore, there should be no suspension. White privilege? Why should a white QB be punished for something he didn’t do, while 2 black QBs ACTUALLY DID commit the act Brady is falsely accused of doing got off scott free?

    The NFL brought suit, they are the cause of the litigation and taxpayers are most assuredly paying the judges, clerks and court expenses. The NFLPA is funding their end from a fund set up explicitly for that purpose. It is funded through the sale of gear. The number one selling jersey last year was Tom Brady’s.

  19. Ive been in legal field 15 years…this is simply not that important an issue (sorry Pats fans) and there are people in front of him with life or death (row) issues that have been waiting years to get their turn in front of the 2nd DCA.

    If Tom was smart, he would have been more willing to negotiate this outside the Court room. He should have taken the 2-3 game suspension that was on the table when he was still working with the NFLPA to address the problem.

    Instead, he let his ego (legacy) guide him and as a result has to wait his turn. I see him out the first 4 games of the year…Ginsburg will not stay this issue…not important enough. We are talking about someone playing a game. I dont see that as life or death or something affecting a large group of people, which is when the Supreme Court will get involved.

  21. I agree that Brady should serve his penalty when he has been found guilty of doing something wrong. The NFL has already clearly stated they have no evidence of him doing something wrong. Therefore no penalty should be assessed and hence no penalty should be served.
    The 2nd circuit issue is a completely different issue and is nationally significant. Its decision will impact people in a manner that far exceeds the importance of whether a single football player, whether elite or otherwise, regardless of race, sits out four football games. The ultimate result, whether for or against, whether decided at this level or by the US SC, will affect employee/employer relations long after the Football Hall of Fame building collapses having served it design life span. Too much is at stake. There must be an ultimate resolution. And it’s exactly the type of issue that tax dollars must be invested in so that the broader good is ensured.

  23. Yes, the tax payer does pay for this issue. Whoever said the tax payer doesn’t pay for the Court system really does not understand how our Courts work. The loser will typically pay for the legal expenses of the opposing party plus all Court costs unless the Judge says differently.

  33. 1) The case was based on a single secret allegation that the accused had no chance to answer before an against-the-rules sting operation was bungled anyway because the NFL knew nothing about psi in a ball.
    2) In absence of evidence the league published false data – the eventual figures, even massaged in favor of the league, come to 0.2psi under. 0.2psi when the error range of a good gauge when a clean, straight needle is perfectly applied is +/-0.5psi.
    3) An arbitrator can only assess the fairness of the case – not introduce new evidence (phone destroyed) then deny new defense (logs from said phone) and deny cross-examination of a hitherto secret league co-auther, and then lie about the defendant’s testimony and use that lie as further “evidence” of the defendant’s guilt.
    4) The rule isn’t even listed as a player-violation, its a team one, such as when the Jets were fined for their illegal k-balls, resulting in a small fine.
    5) Too much was made of a single off-season text unrelated to footballs anyway, whilst in-season texts explicitly stating Brady’s preference of 12.5psi were completely ignored.
    But the 2nd court should hear the case not because of Brady but because otherwise the league is handed the power to turn the CBA’s “arbitration” process into a completely kangaroo court to be employed against all players.

In other words Goodell cannot bring up knew charges which he did and this disturbs many of the legal minds in the country because they know this is not allowed and could be used by industry if the ruling is left as is because it would set legal precedent for years to come. No judge wants that on his record.

    Real fans appreciate greatness in players no matter what teams they play for. Trolls who cannot play sports. do what they have always done, and that is complain behind locked doors and most often take their ball and go home when ever tried to play a real game with real athletes.     The NFL never investigated any of these teams. They never fined any of these teams. They never penalized any of them either financially or by removing draft picks. The league can’t even prove Brady did anything wrong. Yet he’s been demonized when all 7 of these teams are 100% known to have actually deflated balls have suffered zero consequences.

With all the important cases before the courts, you could see their logic in not caring one way or the other whether Tommy cheated (that’s not even the issue before the court) and could care less about his legacy.

    Great story, but you’re missing a key fact. When Blake played the NFL provided all of the footballs that were used for games, there was no real opportunity for teams break them in.

    Brady and Manning lobbied against that and the NFL changed the policy so they would provide teams with footballs early in the week, the teams could do what they want with them and then have to give them back to the officials before the game.

    My team has a winning record against Brady. Including being 3-1 against him in the playoffs, the only loss was with Tim Tebow at QB. So I have no jealousy whatsoever.

    But here’s my question: You say that the rest of the league needs this to be able to compete, yet the Patriots have won 1 Super Bowl in the last 11 years. So how is it the rest of the league can’t compete with New England? Either they’re great and are a huge disappointment come playoff time (1 Super Bowl in 11 years) or they’re not nearly as good as you and the rest of the chowds like to claim. So which is it? Are they an annual disappointment or are you trumping them up to be something they aren’t?

    During 19 January, 2015 (day after AFC Championship Game), an official letter sent to Mr. Kraft from the senior vice president of NFL operations (David Gardi) informed the Patriots that an investigation will be conducted.

    1. FACT: On page two, the letter states the following: … “each of the Colts’ game balls that was inspected met the requirements set forth.” READ THE LETTER!

    That statement turns out to be totally not true. Page 8, of the Wells report confirms that 3 of the 4 Colts’ footballs were in fact deflated. Who from the NFL office directed to stop testing the Colts’ remaining 8 footballs???

    2. FACT: The NFL has admitted that they DID NOT know anything about the Ideal Gas Law (IGL). That admission is incredible!

    3. FACT: Brady was found guilty by the NFL office based on “ASSUMPTIONS AND DATA THAT IS UNCERTAIN” (quote Wells Report).

    4. What would you do if someone in your family was accused and deemed guilty based on “ASSUMPTIONS AND DATA THAT IS UNCERTAIN” (quote Wells Report)? Could you accept that???

    5. Why wouldn’t Brady turn his cell phone in? …… Would you provide your cell phone to folks that you know are not truthful (19 Jan. letter)???

    6. FACT: NFL announces creation of PSI rules shortly before leaking story that Brady “destroys” phone. Thus, the public quickly forgets the NFL admits they had no PSI rules or knowledge of the Ideal Gas Law.

Should this come to her review, I doubt the NFL will get away with a kangaroo court of new evidence, new rules and a failure to provide the accused to confront the evidence. And for all of you fools who think this is about Tom Brady anymore, may you, or your family members, never be in a union where they could sit before a biased arbitrator who can act arbitrarily, capriciously and without any regard for facts submitted by his own representative’s investigation and further introduce new evidence (Wells is on record saying he didn’t need the phone, yet the phone is the centerpiece). Hate the Patriots, hate Tom, but this has far greater implications for average Americans and you need to educate yourself on why (including the implication that your employer has a right to review your private phone)..

    A few years ago Jay Glazer revealed on Fox’s NFL pregame show that Arlen Specter, the longtime Pennsylvania Senator who initiated several Congressional prods at the NFL over the years, threatened to put him in jail if he did not release the SpyGate video, (he still supposedly shows it at parties), which the NFL had purportedly destroyed.     Only an idiot doesn’t realize the tapes being destroyed was a huge plus for the Pats and the NFL. If the public had ever seen those tapes they would have realized just how bad the Pats had been cheating and how the Pats games were practically rigged because of those tapes. That is the only reason the league destroyed those tapes. There is no other reason for doing so. If it remotely painted the Pats or the league in a good light you can bet they would have had those tapes all over ESPN.

  92. It’s more probable than not that the last decision looks very suspicious. It’s against labor laws to frame your employee, regardless of what some CBA says. Goodell was supposed to act in good faith and instead of finding facts he unleashed his own brand of industrial justice.

    If they had substantial evidence they may have had a case, but when you don’t even have the proof to back what you are accusing, you don’t go above and beyond with punishment. It was a team fine of $25k per football. Which they couldn’t even prove happened. There is nothing to suggest in the rules set in place that if this foul happened that it is deemed football tampering is detrimental to the integrity of the game worthy of $1M in fines 2 draft picks and 4 game suspension over a conspiracy theory because a rival team feels suspicious. The fine in the books should reflect how they feel about the rule. The NFL front office should do some research Goodell with that $32M/year should at least know what the US labor laws are.

    Nobody is suggesting this issue is a life or death matter but it is rather important in terms of labor law. But then again the last time I checked that isn’t the sole impetus behind taking something to the supreme court. Which ironically is where most labor law in this country has been decided.

    If you read the post it says Brady has the option to appeal to the USSC after exhausting the federal circuit appeals. The process will allow him to petition for a stay pending that decision. The same holds true at the federal circuit level. If the court decides to hear the appeal Brady will file for a stay.

    Nothing about kowtowing to Brady involved in this. The reason that it is so prestigous and honored an appelate court is because they normally get the difficult but globally significant judgements correct. This case is difficult and globally significant and therefore needs to be correct. It seems there is significant enough reason to believe that the original 2nd circuit ruling may have been incorrect. And if so, they know they need to correct the error or confirm the decision if they believe it was correct. Not a trivial matter and not a trivial case. The fact that Tom Brady is involved does not either trivialize the case nor enhance it. It’s important to get it right and that is why the 2nd circuit is considering hearing an appeal. As it should.

    It is known that footballs belonging to the Colts were also measured and some of the measurements were reported to be below 12.5 PSI. Below you can see NFL PSI measurements of 4 of the Colts 12 footballs when measured on January 18, 2015 at the end of halftime. These measurements were obtained after bringing the footballs indoors and after allowing them to warm up while measuring 11 of the Patriots footballs twice. The NFL indicated that they ran out of time.

    Colts football #4 12.55 — 12.15

    NFL rules stipulate that footballs are required to be at least 12.5 psi and no more than 13.5 psi. This means that all the Colts measurements should have all been within that range. It has not been reported what the starting PSI measurements for the Colts footballs would have been at the beginning of the game.

    Below you can see the NFL PSI measurements of the Patriots footballs measured on January 18, 2015 near the beginning of halftime.

    NFL rules stipulate that footballs are required to be at least 12.5 psi and no more than 13.5 psi. This means that all the Patriots measurements should have all been within that range. This is unless someone lowered the PSI or the temperature can naturally lower the PSI in footballs. Tom Brady has indicated that the starting PSI for the Patriots footballs should have been 12.50 PSI. You can easily see that there is only one measurement that is at 10.50 PSI so the false all but one of the footballs being 2 PSI below 12.50 PSI is unexplainable. The false report did forever influence the opinions of many.

    A fair test would have been checking the footballs of both teams while alternating between the footballs of each team. This would have ensured that the same number of footballs were tested in the available time. Alternating would have also minimized the measurement error from allowing all the Colts footballs to warm up. Not alternating the measurements between footballs of both teams should have invalidated the test results.

    Plus the NFL’s taking the ending PSI measurements of the Patriots footballs and comparing them to the ending PSI measurements of the Colts footballs is illogical when you don’t also compare the starting PSI measurements. If the footballs did not start at the same PSI then it is predictable that they would not end up with the same PSI measurements.

    So there are 2 legitimate reasons that explain why the PSI measurements of the Patriots footballs could be somewhat higher than those of the Colts.
    1. Allowing the Colts footballs to warm up while measuring the Patriots footballs 2 times.
    2. Not having the same starting PSI measurements. Remember the NFL rules allow for a range between 12.5 and 13.5 so they could have legitimately been up to 1 PSI different to start the game.

    A better comparison would be for the NFL to collect information taking footballs recording the indoor temperatures starting PSI measurements. Then after the footballs are used in outdoor NFL games played during cold wet weather recording the outdoor temperatures and the PSI measurements at the end of the game. Without allowing time for the footballs to warm up indoors.

    The NFL performed such a PSI study during the 2015/2016 season. To this day the NFL has not released the PSI information from that study. The only logical reason that this PSI information is being kept secret is that it disproves the NFL’s conclusion. Essentially this information likely exonerates The Patriots and Tom Brady. It’s easier to for the NFL to keep the PSI information secret than to suffer the public humiliation of having to admit that “deflategate” was about nothing.

    Remember, the field temperature in Foxboro, MA was 49 degrees on January 18, 2015 and it was raining. No less than 21 professors from universities form all over the country have officially notified the court and the national media that the cold/rainy weather explains the PSI measurements recorded at halftime during that game played between the Patriots and the Colts. If the NFL had information that would help them with their court case and win the deflategate public relations campaign the NFL would not keep that information secret.

    All other information about this topic is irrelevant since science explains that there was no tampering and the NFL is hiding information and has lied numerous times. If the NFL had integrity they would not be keeping this information secret while taking away Patriots draft picks and while making Tom Brady miss 25% of a season and losing the pay from those games. The only logical conclusion is that this entire farce is about establishing league parity and personal vendettas.

    Actually, the fact that they haven’tr done anything in the 7 weeks since the NFLPA request for a rehearing suggests that they may be leaning towards granting the rehearing of some type. This is now a very significant labor law concern which is why you have two of the most learned attorneys involved (one for each side) and a third writing a very comprehensive friend -of-the-court brief. Many people involved in collective bargaining and union contracts and employee punishment view this is a very critical case. Reagrdless of wins the next round this is going to be heard by SCOTUS and there’s no one to blame but Goodell.

    Nobody is holding you and others to the fire making you believe all the tapes were destroyed. That said you must have something compelling to suggest they weren’t. What is that exactly? Regardless, is it the distrust in the Patriots to hand everything over or the distrust in the commissioner to destroy everything in question? Most likely both. You have no reason to trust either. They were found guilty of breaking a rule the location of where you can film the other team’s sidelines, a practice that is STILL LEGAL if done in the proper place.     The only reason I have seen is that that he broke his phone, and got a new one. Regardless, Brady was under no obligation to say anything about his cell phone. Kessler certainly didn’t tell Berman that Brady’s lawyer told Brady to destroy it.

    The phone is a red herring anyway, and had no bearing on the fraud perpetrated against Brady, except as a tool used by Goodell to further extend the fraud. It is a matter of public record that Goodell misrepresented (lied about) Brady’s testimony in regards to the phone at the appeal hearing.

    Hopefully your statement is true but, so far, two Judges on the 2nd Circuit agree with your statement, and two Judges believe Goodell has the power to ignore the rule of law. Maybe the NFLPA will get a hearing before the full court. Whether or not that occurs, with or without an unjustifiable 4 game suspension of Tom Brady, it is more than likely that the Patriots will be playing in the AFC Championship game in January 2017.

    Whatever occurs, we have to be impressed (depressed?) that a throwaway blurb posted on this portal about nothing new will still likely manage more than 200 reply posts simply because it contains the name of the Greatest NFL Player of All-Time, Tom Brady.
