Tom Brady gives up, will not fight NFL to the Supreme Court

Tom Brady has decided to give up and accept his four-game Deflategate suspension.

After this week’s ruling against him, Brady announced on Facebook that he will no longer fight.

“I’m very grateful for the overwhelming support I’ve received from Mr. Kraft, the Kraft family, coach Belichick, my coaches and teammates, the NFLPA, my agents, my loving family and most of all, our fans,” Brady wrote. “It has been a challenging 18 months and I have made the difficult decision to no longer proceed with the legal process. I’m going to work hard to be the best player I can be for the New England Patriots and I look forward to having the opportunity to return to the field this fall.”

Brady’s only remaining option was to take the case to the Supreme Court. He won’t do that. He’ll sit out until Week Five.

The owners know this will be a huge bargaining chip, but probably will never give up this kind of power. Sad day for workers rights. Owners must be thrilled with Goodell. $50 million next year.

  15. Haters so were the Colts. They checked the game ball then handed it over to Walt Anderson. That is illegal Then 3 of 4 Colts balls were also short of air. The league based their case on maybe while the Colts cheated with certainty and nothing was done to them.

    Tom made a good decision. I bet that he wishes that he came to an agreement and took is punishment last year.

    As a fan of a competing team, this does not lessen what I think about Tom Brady as a QB. He is one of the best in the history of the game. In fact as a fan of a competing team, one appreciates just how good a QB the guy is (maybe even more so than Pats fans).

    Nevertheless, in my opinion, he did what he is accused of doing. He is the poster boy for the NFL. I am sure that a compromise could have been reached last year that would have been less than the number of games lost this year.

  26. Briguy5 the problem is Goodell didn’t go against the CBA. The steelers players warned everyone that this CBA gave Goodell too much power but everyone said they were just tired of being fined and suspended. Well it looks like they were right not to sign the CBA.

    Hard work, innovation and success used to be respected in this country. Now the politically correct, want everyone to get a participation trophy and nothing more, lazy, whining, self entitled crowd find the hard work and innovation somehow “cheating” because they are either incapable and or to lazy to do so themselves.

    The corruption and stupidity of Goodell’s league office is incredible. They are the cheaters, not the Pats. They have lied about every major “scandal” they have manufactured against the Saints, Cowboys, Washington and Miami, and caught red handed lying about the Ray Rice incident in an attempt to cover it up.

I learned from reading the transcripts that he walked past DOZENS of NFL executives that lined the hall way between the refs locker room (where they checked the balls) to the bathroom. Then he walked past even more NFL employees to get to the field in full view of everyone.

He probably would have gotten the equipment violation for that, what he is suspended for is failing to cooperate and interfering with an nfl investigation into deflating the footballs which he is REQUIRED to do by the CBA

  51. What with the uncertainty of legal success or even that SCOTUS would hear it, I think he decided it reached the point where it was unfair to the team not to give Jimmy G the prep time. Still a crock though, because it now means the Commish can deny all NFL players their right under the CBA to an arbitration process.

  56. NFLPA doesn’t have the funds the NFL has. It’s financed by player dues. Rather than spend more on a Hail Mary, after discussion it was probably decided to pack it in and pick a more winnable fight. If you polled the players, I would bet they would say to give it up, whether they believe Brady is innocent or guilty. Goodell is still wrong, and maybe his ouster will be a bargaining chip in the next CBA. This comedy of errors and gaffes didn’t happen under Rozelle or Tagliabue. Goodell has become a laughingstock(see JCena). I’m sure the NFL can find another commisioner that can steward the profit making without the constant controversy.

    Well I’m a bengal fan and I know they were guilty. In 2014 not one Patriot RB put the ball on the ground. Also Benjarvis Green-Ellis never once fumbled in his entire career with the cheaters. He came to Cincy and in 2 years fumbled 5 times. I don’t believe in coincidences.

  59. Reading these posts it seems everybody was assuming the Supreme Court would even take the case. There was only one Appellate Court involved, and the NFLPA was not trying to push the boundaries of labor law. From the SCOTUS perspective there is not much reason to take the case.

    Maybe if there is another Appellate Court that rules opposite of the Second Circuit then the SCOTUS would have more reason to take the case. We’re just not there yet.

    There is no requirement in the CBA that says you have to give up your private phone. The last player that refused to do so was fined $25K. You can’t just make up fines and rules as you go. So if Goodell said he wanted to search Brady’s home and he wasn’t allowed to, is that also a requirement under the CBA?

    His thoughts were one a day practices would take away from the game and that the commissioner was going to have too much control over the game. The other owners laughed at the old man. Kind of like most of us when we were kids laughing at what our parents said.

    Hypothetical Question: What if Tom Brady’s lawyer Jeff Kessler, received a copy of the Wells Report prior to release and was able to make edits to it unsupervised?

    The entire world would be crying foul.

    Well that’s exactly what happened in this case, except the NFL’s legal council Jeff Pash was able to review and edit the very report used to base the punishment off of.

    That fact ALONE should have been enough to throw out the NFL’s bogus witch hunt.

    I disagree. While publicly the players are showing support for Brady, the reality is that very few players ever have to deal with Goodell’s discipline. Most players just don’t care that much, particularly if they have to lose paychecks.

    If the players really do make a stand, the NFL will gladly concede something on the discipline side if the players concede something on the financial side.

    The fans and media are much more concerned about the discipline structure than the majority of players.

  130. As a Jet fan it’s tempting to antagonize Pat’s with the cheaters never win thing. But, consider that the Colts lost because they only managed one touchdown it’d to suggest the PSI was the root cause.

    Conversely, that doesn’t mean that there was a rule violation in either intent, fact or at least perception. Given the Pat’s past as it relate to ethics, it was the NFLs responsibility to follow up on that “violation” even if it was to merely dismiss it.

    Brady wasn’t sanctioned because he knowing or willing instigated or participated in violating the rules, no matter how incidental that rule might appear. He was suspended because he refused to participate in the NFL’s inquiry, specifically he smashed his phone rather than give it over as directed. Regardless of his innocence or guilt the CBA requires him to cooperate. That is why he was suspended. The same agreement that provides players with the frame work to make millions of dollars in salary and endorsements obliges him to work with the NFL on inquiries about their behavior, .. on or off the field.

    That said I’m still tempted to get give out a “cheaters never win” vibe but that whole 4 Superbowl rings kind of undermines that.

Brady received the 4 game suspension from Vincent after the release of the work of fiction known as the “Wells Report”, the gist of which was that Brady had cooperated fully with the investigation, that he Wells and the investigators did not require Brady’s phone physically, only the records from it, and that he must have been “generally aware” that the other employees had “more probably than not” tampered with the equipment.

    It wasn’t until Goodell’s phony self arbitration that he or the NFL became aware that Brady had destroyed the old phone (since he was told they didn’t need it) and accused him of masterminding the more probable than not ball tampering.

    Nothing was ever proven to have happened. The manipulated data did not prove that anything more than the weather reduced the pressure in those balls. What’s even worse is the NFL and Goodell are fully aware at this point that nothing happened since they measured the ball pressures over last season and saw exactly what happens when balls are brought into a colder environment.

    If I were Tom Brady, the next game they play in cold weather I would grab hold of the head official and complain that I believe that the balls are below the legal pressure limit and insist that they measure them at halftime, and report to him the results. And then I would blab those damning results ion national TV during the post game interviews.

    But the NFL knew that if they dropped this at his door the week before the Super Bowl, he would have to deny it.

    He routinely took the footballs down to the field.

    You actually think that a guy working for the Patriots stole the footballs, on a day when they were running a sting, and no one bothered to do anything about it, like check the footballs before the game, and not at halftime of a cold weather game?

    The Colts must have cheated because 3 of 4 of their footballs were below 12.5PSI.

    After he walked past all of these League officials and out the door of the Officials’ Locker Room to the hallway, he then walked past James Daniel, an NFL official and one of the people who had been alerted to the Colts psi concerns pre-game (pg. 45). Mr. Daniel, as seen on the security video, looked at Mr. McNally carrying the bags of footballs toward the field unaccompanied by any League or game official, and made no objection to Mr. McNally continuing unaccompanied to the field.

    In short, if officials lost track of the location of game footballs, it was not because Mr. McNally stealthily removed them. (Omitted from the investigation were interviews with all those League officials whom Mr. McNally walked past with the bags of footballs on his shoulders.)

    Even after halftime, when obvious attention was being paid to game footballs and psi issues by League and game officials, who took control of the footballs at halftime, the security video shows Mr. McNally, with no objection, taking the footballs from the Officials’ Locker Room back to the field totally unaccompanied by any League or Game official.

    Since I’m sure you don’t want to misstate the facts, I thought I should point out that the rule says no such thing. The rule as stated in the NFL Game Day Operations Manual says, “Once the balls have left the locker room, no one, including players, equipment managers and coaches are allowed to alter the footballs in any way. If any individual alters the footballs, or if a non-approved ball is used in the game, the person responsible and, if appropriate, the head coach or other club personnel will be subject to discipline, including but not limited to, a fine of $25,000.”

    The Game Day Operations Manual does not say an altered ball provides an unfair advantage. Clearly, there are ways a ball might be altered that would provide an unfair advantage. But language stating that alterations provide an unfair advantage is not in the rule as you suggest.

    Even if the rule stated that alterations provide an unfair advantage, that does not make it so. As an example, the NFL Constitution and Bylaws state that “The League shall select and employ a person of unquestioned integrity to serve as Commissioner…” Can anyone honestly say that Goodell is a person of unquestioned integrity (yes, that is a rhetorical question)?

    You could be far more persuasive (if that is your intent) if you presented your opinions as opinions and not state them as facts. You come down pretty hard on Tom Brady for saying things that are not true, after all. So you must understand that people are going to judge you the same way.

    The rule says no such thing regarding an unfair advantage. The NFL was just lazy and used the recommended PSI range that Wilson has on the side of the box and on the footballs.

    The Colts footballs started out higher, and had longer to heat up at halftime.

    They only measured 11 Patriots footballs, and only a couple were below the IGL threshold.

  170. My admiration for Brady only grows. This entire fiasco was never anything more than a possible equip violation. The real world equivalent would be getting a 4 year jail sentence for a parking ticket. Even though he should have been exonerated, Tom knows its time to put the team first a take this bogus penalty. Yes, but it was Brady and the Pat’s organization that turned an equipment violation into a conspiracy through lies, deceit, and damaged cell phones to cover the conspiracy of lies and deceit for an equipment violation. If Brady is honest and said I messed up, instead of lying and saying I had nothing to do with it the entire investigation would not have happened. Brady only has himself to blame because he lied rather than be honest.
