NFLPA president: Goodell’s discipline hurts competitive balance

NFL Players Association President Eric Winston says Commissioner Roger Goodell’s approach to discipline leads to unfair scheduling around the league.

“I think the one thing that has been lost in this conversation is how much it’s affected competitive balance throughout the league,” Winston said on SiriusXM NFL Radio. “The NFL is always so big on competitive balance but you see these random suspensions that have been handed down over the last two, three years, it’s definitely affected competitive balance.”

With the suspension everyone is talking about this summer, Tom Brady’s four-game ban, that means the Cardinals get to play against Jimmy Garoppolo in Week One, but the other three NFC West teams will have to play against Brady later in the season. And the Bills and Dolphins each get one game against Garoppolo, but the Jets will have to play twice against Brady later in the season.

“Your team might be playing with a guy who should have been out there but wasn’t out there. You know how it is with the schedules in the league,” Winston said.

Of course, that happens all the time with player injuries. And it’s always going to be true any time a player is suspended in the NFL. But Winston worries that Goodell’s approach to suspension is making it a particularly big problem, giving some teams advantages and some teams disadvantages, based on the schedule and Goodell’s whims.

  1. Mehhh…. It’s easy to bash Goodell but the same “scheduling issues” could occur due to injuries.

    That said, Goodell is a dishonest and shameless commissioner and is bad for the game.

    Is amusing this was written from the perspective of the teams who don’t get to face Garoppolo and not the team who is unfairly punished though.

  4. Nah, Pats fan here. I don’t buy the narrative. Goodell is ruining the game and I despise him as a human being but I think the union is barking up the wrong tree here. That said, Bradyless Pats for one quarter of the season for a bogus offense does seem to help some competitors more than others. Hummmmm.

  6. What hurts is when the NFLPA settles for a weak CBA. These players don’t get the required practice and that is why many get injured during training camp or the first few weeks of the season.

  8. Players chose money over discipline authority. You could have had a more neutral person, but you chose a higher share of the revenue pie instead. Why cry about it now when thats the deal you signed and agreed upon???

    My guess is that the 98% of the players who are not in trouble or under investigation are happy with that agreement and their higher paychecks. If not, they should have negotiated for more power and like any negotiations… If you want it, you have to give something up.

  10. Discipline is brought about by the inappropriate actions of the player. Any consequences caused by that discipline are the fault of the meathead that violated the rules, not the meathead enforcing the rules.

  12. Like it or not, both parties agreed to and signed the current disciplanary process and the comissioners authority. I’m sure the owners and coaches want some things back too, but this is the deal they both signed. Only 1 party is constantly complaining about their own agreement they signed. If you want better terms, you should have negotiated for it instead of agreeing and then complaining about it later.

Maybe as the President of the NFLPA he should try to convince the MEMBERS of the NFLPA that they need to stop taking illegal drugs, taking PED’s, getting arrested, beating your significant others, stealing underwear, cheating (pick any and all of them). After they stop doing that, maybe they won’t be suspended for important games. Stop blaming the commish for problems that the players created for themselves which hurt their team. Create some accountability.

  16. Well that’s it then. In the interest of ‘integrity’ and competitive balance by executive fiat henceforward all suspensions will have to be for a minimum of a complete season. Since it is in the best interest of the ‘integrity of the game’ and preventing an ‘unfair competitive advantage’ the decision to modify the schedule of punishments lies in the sole purview of the commissioner. As determined by the 2nd circuit court of appeals it is allowed for under the current CBA.

  17. The one thing that helps the four major sports do business is the public perception that they are not fixed. The one thing this whole deflate gate episode really does is start to undermine the NFL’s credibility on that point. If a team wins “too much” we’ll find ways to make sure they don’t do that anymore that exist beyond the regular competitive balance rules. The NFL has taken a giant step toward becoming the WWE with its actions in deflate gate.

    Goodell cheats teams who are good to alter parity, so he can manipulate more of a parity so the NFL and the owners who are lazy and stink as spoiled loser millionaires living off of daddy’s money, can profit even more.

    Hence, why Kraft and the Pats have been falsely accused of “cheating” coincidentally when Goodell took over in 2006.

    This is consumer fraud in the United States of America.

    One main reason why an injury report exists is to make sure gambling is legit in Vegas.

    So, there is a proof in place to show that the NFL is cognizant is not being a promote of a fraudulent product to the customer.

    Take Goodell down.

    It explains why the Jets can cheat their balls off, the Broncos can cheat the cap, other teams cheat, but if they aren’t considered good or great over a period of time, he either lets them cheat or barely punishes them.

    It’s all about money and how he can keep even just 1 owner from whining on his answering machine.

    Goodell is the pawn, but he’s part of the corruption.

  26. Heard most of the interview this morning. One thing that was brought up was that the Commissioner has always had this power, but none before have ever abused it like Roger.

    So many people on this site want to blame the players saying they signed a bad deal. That is just not true. In regards to discipline the CBA hasn’t changed much for decades according to Winston. He continued to say Paul Tagliabue did things in a more amicable and consistent way.

    To this day I can’t believe the fans of the Steelers, Saints, Ravens, Vikings and now Chiefs too can say they love Roger and what he’s doing. Of all the fan bases, you know first hand what he like.

    Roger has shown time and time again to be wildly inconsistent.

    Everyone knows the punishment for speeding in a fine and maybe points on your license. What if the next time you were pulled over the penalty was 4 months in jail and car impounded. Would you feel any outrage over that?

    The parts of the CBA you’re describing as “weak” were not the parts the NFLPA “settled for.” They’re the parts the NFLPA *wanted* and collectively bargained for.

    I agree with the commenters here who see the bigger picture: Goodell’s abuses of power can hurt competitive balance. So can cheating. But in this case, keeping Brady out for four games might actually *help* the competitive balance. And the Patriots aren’t the only team bending the rules, so singling them out is probably more harmful to the competitive balance than it would be to leave them alone.

    If anyone believes the Colts didn’t lobby hard for questioning fair play, you’re crazy. How many fumbles did the Pats have at home versus away ?? It’s an improbable record of retaining the ball at home, improbable = impossible.

    Jets tampering with footballs? Minimal fine.

    Vikings and Panthers tampering with footballs, on National television? Memo.

    Chargers using stickum? Minimal fine.

    Jets filming signals? Hey, knock that off.

    NFL employees stealing footballs to sell on eBay? Blame it on the Patriots.

    The Referees leave the game balls back at the No Tell Motel, before a Patriots game, no less? No discipline.

    Colts owner, Jim Irsay was caught driving through a population center going 10 mph in a 40 mph zone. In his possession were 11 different prescriptions and 29k in cash. Ted Wells was not retained and paid $10 million dollars to find out how many of these prescriptions originated with the Colts team doctors. He was not retained to ascertain whether Irsay’s drugs, obtained through NFL channels, were responsible for other overdose deaths, such as the woman found dead in his condo. Irsay’s drug running was a threat to every man, woman and child in the area. Roger Goodell banned him from his owners box for 6 Sundays. Maybe the owners should be setting an example for the players?

    If you’re so against the NFLPA, I’m certain you must never watch a game on Sunday. That must give you extra time to rub Cowboys owner, Jerry Jones, feet while he watches.

  35. When people bring up the CBA, it’s good to remember that ownership has an unfair competitive advantage in negotiations. Because of the short career spans of players, as well as football players being treated as meat by owners, they are always in a poor negotiating position.
    Work stoppages are less tolerable for players than in other sports. Although it s the most physically destructive and dangerous sport, it’s the only one without guaranteed contracts.In 2011, until Judge Doty stopped it, the NFL owners were prepared to make their TV revenue, whether games were played, or not. Nobody goes broke owning an NFL team. The worst team still makes a fortune. The question of Comissioner’s power and clause 46 was a non-starter in those negotiations. So for ignorant people who blame the players for the lousy CBA,
    I would ask, what alternative does the NFLPA have in a climate where

    So, dummy, how did Brady’s stats improve and the fumbling stats improve when the league monitored the air pressure so closely for the 19 1/2 games Brady played after the alleged “deflated” footballs.

    I think it is obvious you didn’t read the Wells Report or Carnegie Mellon study that was out a week after the game. Ted Wells says balls don;t get wet in the rain, that’s what the NFL argument eventually comes down to. Goodell and Wells should be in prison for criminal fraud.

  46. NFL colluded to take down the Pats at all costs because they keep winning. Instead of fielding better teams, the other owners decided to make an executive decision to ensure they have it harder than the other teams.

    Just the the NBA took down the lakers with the Chris Paul trade followed by the new CBA to help out the Milwaukee’s of the league.

    Meanwhile, Goodell has ignored other AFC teams’ actual cheating moments like the Ravens or Jets, even Indy with crowd noise violations in the dome, etc.

    The reason why other AFC teams are never punished or barely punished, up until recently during the Deflategate appeal with KC, is because Goodell has been looking for ways to weaken NE because he knows they have the best owner, coach/GM and QB all at once in the cap era.

    Goodell knew his going lenient on AFC teams, minus NE and the lies he’s told about them looked fishy, so he over-compensated when punishing the Chiefs, the latter also a playoff and pretty good team as well.

    The Goodell lawyers will claim there is no pattern here and he has Article 46 to do as he pleases, but there is a deeper story here and it’s called consumer fraud, defamation against the Pats and now Brady, and sabotage, as he clearly takes cues from rival owners who tell him what to do to try to help cheat the Pats.

    I’ll go one further:

    The reason why Goodell tried to blow off the Ray Rice thing and lie TWICE to help Baltimore? They play NE tough and are in the AFC.

  53. Typical union statement. Goodell’s handling of discipline is a non issue for the majority of the union members. There is always a small percentage that will push the envelope, then act all outraged when the hammer comes down.

    The .02 example is mute. Colts balls were underinflated too. Ironically neither the team or Luck were prosecuted, fined, draft picks docked and a four game suspension handed down. Nope, nothing unfair about that at all.

    I keep wondering how all these people who assert that it was “proven” that Brady tampered with footballs weren’t part of the investigation and litigation. When the NFL was asked in front of a judge, under oath, twice they said they had no evidence. But you do! That’s amazing! How were you NOT subpoenaed to submit the evidence and testify? It’s just mind boggling…do you know how much money Goodell would have paid you to provide that?!?!? You missed your ship dude!

Do you know what I find is very interesting, in the case of deflategate, bountygate, bullygate spygate is that most of them, if not all of them started with a player, staff member, or an organization going to the NFL to make their complaints or concerns known. It is obvious these types of incidents have been going on for years and years long before Goodell was named com So what does this really mean? The past commisioners knew that cheating, wife beating, DWIs, PEDSs and drug abuse was going on and did nothing about it. And when a player was involved in a murder case, he got what, fined for $75,000? Goodell has not abused his power, he is the only one who has opened the door to these on going issues and has dealt out punishments. He is the only comissioner who has tried to make players and organizations accountable for their behavior.

  62. The CBA only states that the commissioner has the right to serve as an arbitrator – it does not grant him the power to ignore due process and be an unfair arbitrator, which is what deflategate was all about.

    So for those stating that the NFLPA agreed to this and now must live with the result – why was this never an issue under previous commissioners like Tagliabue, as article 46 is not new.

    The difference is the previous commissioners had “integrity” and were truly about doing what is best for the league, and not only about what was best for the commissioner and his owners.

  65. The NFLPA has done such a poor job of representing the players that it’s difficult to even consider anything they have to say that’s critical of someone else. The commissioner is working under the guidelines that were crafted by the NFLPA. There have been a small handful of players who were caught breaking laws and breaking rules, and the commissioner’s office had to deal with those few under these guidelines. Instead of representing the players, and helping them stay out of trouble, the NFLPA puts the blame on the league office. I’m sure they’re blaming the cops too, every time one of the bad apples gets busted. What a joke. That’s poor leadership. In fact, that’s no leadership. If the players aren’t asking the NFLPA for a refund, I’d want to see an investigation. What are these players getting for their money?

  71. There is no real solution. Any team can make an argument that suspending a player like Brady affects competitive balance. If they tried suspending a player against say only non conference opponents, that has possible playoff implications for teams in the other conference. You can try suspending a player for only divisional games but then all suspensions would have to be at least 3, or 6 game suspensions. I didn’t read any solutions being offered by the NFLPA.

    How are there still people that think NE taped any practices or walkthroughs? That was proven false over a decade ago now. All they did was film from a few feet lower than was allowed on gameday.

    We know the 12’s are new to this NFL/Labor thing having only gotten here themselves a few years ago but the language in the CBA that gave the commissioner’s office that power have existed relatively unchanged since the first CBA in ’69. The last 2 CBA’s have wrung more concessions for the players than all of their predecessors combined. If you want to pretend you have been here right along you might want to read up on things a little.

    It’s absolutely quantifiable. Home teams bring the balls to the field. So basically home games over N number of years.

    And no the NFLPA did not give Goodell this power. Article 46 pre-dates Goodell by quite some time. The issue is the commissioner abusing the power that has always been there.

    The President doesn’t have all of the power to declare war, it takes an act of Congress.

    The power to arrest, try and convict a person does not lie in one person’s hands, it lies in four areas: The police who arrest, the lawyers who try the case, the jury who decides guilt or innocence, and the judge who hands down the sentence.

    Why then, can one person be the judge, jury and executioner? And he’s not consistent across the board . . . Let the union and the League office work together to determine the punishments for 1) first time offense / drugs ; 2) multiple offenses / drugs; 3) domestic abuse, etc. . . .

    So Brady said in the Wells report he didn’t know his name, but under cross by his attorney, Kessler, Brady said he didn’t know McNally. Contradicted by Jastremski.

    Conclusion – Brady lied to Wells and lied under oath to Goodell.

    Also I find it very surprising Brady didn’t know McNally’s name as McNally was a 32 year employee that USED to travel with the team. Also note Brady never said he knew McNally by his nickname Bird. So Bird was just another deflection. He only knew his face. If Brady really didn’t know his name then that shows how shallow a person Brady is.

    So why did Brady lie?
