#DeflateGate is officially over

On Monday, Patriots quarterback Tom Brady returns from his four-game #DeflateGate suspension. When he returns, the matter will completely and officially be over.

The NFL Players Association has announced in a statement issued to NBC Sports that no further appeals will be pursued in the litigation filed (by the NFL, actually) regarding the quarter-season banishment.

“After consultation with Tom Brady and our appellate counsel, we have decided to not pursue additional appeals in this matter,” the NFLPA said.

The decision is a surprise. When the NFLPA and Brady added former U.S. Solicitor General Ted Olson to the legal team, all signs were pointing to an appeal to the U.S. Supreme Court, which would have been the next step in the case. As Olson said during a May appearance on PFT Live, “[W]e are all very, very much committed to seeing that Tom Brady gets the justice which he is owed in this case, whatever it takes.”

From a competitive perspective, the decision means nothing, given that Brady ultimately accepted the suspension in July. As it relates to the push-and-pull between the NFL and the NFL Players Association, the decision means plenty, since the players have sacrificed an opportunity to limit Commissioner Roger Goodell’s power.

But the union had a steep uphill climb. Very few petitions submitted to the Supreme Court are rver accepted. And a chance remained that, if the Supreme Court had taken the case, it could have ruled in favor of the NFL.

From Brady’s perspective, he returns with the case finally over. It won’t be a distraction for him in any way, at any time. After dealing with the situation for more than 20 months, it’s hard to blame him for choosing not to keep trying to overturn the league’s decision.

  18. Anyone who thinks Kraft is very upset with Goodell needs to scratch beneath the surface. Kraft has been buddying and meeting with Goodell many times during the whole proceedings of Deflate Gate. There was never any doubt Kraft was going to take the punishment. Nothing he said after that matter. It was all a show for the fans. Goodell was handpicked and developed by Kraft. He is a Frankenstein of Krafts own making. Kraft is an NFL man first and the owner of the Patriots second. He’d sell Brady out quicker than ice melts on fire to further the league. Brady is a smart guy and understands all of this. He’s willing to shut up and bow his head just to get on the field a few more times while he can.

  37. The Patriots lose and the trolls are out. They are 3-1, anyone who thinks they wouldnt have done better today with Brady or Garappolo is crazy. Although I do think anyone who thought the Pats could do fine without Brady is crazy also, especially fellow Patriots fans. It didnt take long for Brissett to be exposed and while he played well only saw about 6 quarters of Garappolo. I think he would have seen some regression when coaches got more tape of him. On the other hand the Pats get a QB back that DC have been trying to shut down for over a decade, his boost to the team is going to be great. Pats survived the 4 game loss even if they didnt go 4-0.

  44. 3-1, first place in the AFC East. Brady saves 4 games of wear and tear. And the Pats could probably now trade Garrapolo for a 1st round pick and get the pick back they lost in the witch hunt. Brady’s suspension just could not have worked out any better for the Pats. Thanks Roger!!

  50. It’s amazing to me that we had to go through all of this because of confusion about the relationship between temperature and air pressure. Kind of embarrassing for the league and also the morally bankrupt owners, who seized on this as an opportunity to gain a competitive advantage against the Patriots, something their teams were too incompetent to achieve via normal football tactics. Talk about cheating! (And this is coming from a Bengals fan.)

    In any case, it’s over now and Goodell and the NFL can go back to worrying about important stuff like Color Rush Thursdays, London, Lady Gaga, Kroenke world, fining players for unsanctioned post-game hats, etc., etc.

    The next morning, Jastremski checked the balls and determined that Brady’s complaints had been justified.

    He texted his fiancee (“Panda”) around 8:05 a.m.:
    Ugh. Tom was right… I just measured some of the balls. They supposed to be 13 lbs [psi]. They were like 16 [psi]. Felt like bricks.

    Jastremski also texted Jim McNally, the part-time Patriot employee responsible for the officials’ room and subsequently accused of deflating balls in a washroom prior to the AFC Championship game, that the referees had over-inflated some of the balls to nearly 16 psi, adding the additional information that the referees had apparently pumped additional air into the footballs, but not deflated them with the gauge to regulation pressure:

    Jastremski: I checked some of the balls this morn… The refs f***ked us…a few of then were at almost 16… They didnt recheck then after they put air in them

    Such “rechecking” is required because, practically, footballs are inflated by pump above the target pressure and air is then released by gauge needle to get to the desired pressure. The procedure was described for the AFC Championship pregame in the Wells Report as follows:

    Yea, you’re right, the NFL did nothing wrong at all, except lie in open court, leak incorrect information to the media and refusing to correct it, paid a shady science firm to confirm their predetermined conclusions, set up an investigation that was riddled with conflicts of interest and zero hard proof, the ridiculous repeated lie of Wells’ “independence”, denied any dissenting scientific opinions (of which there were many), and numerous other ethical issues, and all this on top of their long track record of bungled investigations (bountygate, bullygate, concussions, Rice etc.). The NFL/Goodell are not credible when it comes to investigations. Their track record speaks for itself.

    Sounds like you’ve never seen Odell Beckham play. Brady only gets really angry at himself and when his receivers screw up a route. He does complain to refs occasionally, but no more than any other star QB in the NFL. There is zero evidence he does it anymore than the others.
