Man who killed Joe McKnight released without charges

The man who shot and killed former NFL player Joe McKnight was released without charges hours later.

Ronald Gasser, who was taken into custody after shooting McKnight, has been released, the Jefferson Parish Sheriff’s Office confirmed.

Police said Gasser and McKnight exchanged words in a traffic incident in a New Orleans suburb. Gasser reportedly remained at the scene and handed his gun over to police voluntarily. Although he hasn’t spoken publicly, he is presumably claiming he shot McKnight in self-defense.

According to police, McKnight did not have a gun either on his body or in his car.

A New Orleans native, McKnight was named the national high school player of the year by Parade magazine in 2006. After a college career at USC he was a fourth-round pick of the Jets in 2010 and played there for three seasons. He later played for the Chiefs and has most recently played in the Canadian Football League.

McKnight was 28 years old.

  2. The guy who killed Will Smith claimed self-defense and he is still sitting in jail. And there were a lot more holes in the cop version of those events. Hmmm. What could be the difference here?

  3. From the linked article: “A witness, who declined to give her name, said she saw a man at the intersection yelling at McKnight, who was trying to apologize. The man shot McKnight more than once, the witness said. She said he shot McKnight, stood over him and said, “I told you don’t you f— with me.” Then the man fired again, she said. ”

    Presumably, the shooter was released pending the completion of the investigation. It’s hard to believe that with evidence that McKnight was acting in a conciliatory manner, that a self defense claim will prevail.

  4. The original PFT report said McKnight was trying to apologize and that the shooter stood over McKnight when he was on the ground and said “I told you not to f with me.”

    I don’t think you need to be a homicide detective or a D.A. to recognize that if that original account is correct, that’s not self-defense.

    Did Joe attempt to run him over and was shot in self defense, was Joe lunging at him with a knife? How does one shoot a man MULTIPLE times and be set free?

    I guess we’ll have to wait for more information to be released.

Obviously we don’t have all the facts due to this investigation being at the infancy stage but, how do you claim self defense when you have a gun and the other does not have any weapons on his person?   13. Time Out. How many times do we hear “witness’ accounts that are proven to be inaccurate or outright lies. Let the investigation take place and if there is guilt, that justice is imposed. This story, on its surface, does not make any sense. Before we blame or convict anybody, let the facts be established.

  14. If he’s not being charged then it’s probably safe to assume the original witness’ account we heard is probably fabricated.

    People should be outraged. That’s why you hold a person pending charges, especially when it’s pretty cut and dry like this. He’s a danger to others if he flipped out and shot someone over getting cut off on the highway. Dude might just decide he doesn’t have anything to lose now and decide to settle scores. All kinds of reasons to keep him locked up until you charge him.

  19. I’ve never gotten into the back and forth about guns either way. But I know this to be true. All human beings are imperfect and subject to human emotions. Good guys do bad things in the heat of the moment. So sometimes when you have a gun, if a guy steps on your toe, he might as well’ve spit in your mothers face.

Immediately charging someone starts the clock on the whole ‘right to speedy trial’ thing. Waiting allows the police to thoroughly investigate.

I if they kept him in custody they would have only had 60 days to get him to trial otherwise he would have been free even with proof. Do some research before crying racism.     This story was released on here yesterday on how Joe was shot over road rage. No mention of race was given. The story was Joe shot multiple times over road rage and Joe was apologetic to the other driver who shot and killed him. (by a reported eye witness) That is what my anger is about. Will more facts come out, I’m sure. But to live in a time where this kind of action over anger is becoming the norm and not some horrific act is absolutely insane.

They can apply for an extension for up to 96 hours if they so choose. It takes a little bit longer than that to assess whether someone’s able to be charged with murder/homicide.   50. None of us was there, so let’s not pretend we know what actually happened. Witnesses also can sometimes delude themselves into seeing what they want to see, vs what actually happened.

    If he did shoot him while Joe was begging for his life, without being armed, then that’s murder. Hopefully this gets investigated further, and I’m sure riots and protests will happen soon enough due to the celebrity status of McKnight as a former NFL player.

    That’s all great, but leaves aside the fact that McKnight was shot in Jefferson Parish (25% black), not New Orleans, and the investigation is presumably being conducted by the Jefferson Parish Sheriff’s Department as they are ones who released information regarding the case.

What was once the ultimate sign of cowardice in the Wild West is now becoming alarmingly normal. People arguing and disagreeing is natural in a democratic society, but people killing other people when they do is not.

    Most in law enforcement will confirm that eyewitness is rarely the most reliable. We all remember Ferguson where many “eyewitnesses” false claims of a man being shot in the back while his hands were up.   68. The first unit on the scene ( and I live in NOLA ) reported that one man was pulled out of his car, then shots were fired. The local sheriff hasn’t offered details yet ( later today ), but if Joe pulled this dude out of his car, then perhaps he was justified in shooting him. A similar incident happened to a guy I knew. He got into an argument with another guy, they both pulled over, and my guy walked up to the car. The other guy got out and shot him…and my guy was charged with “aggression”….even though he was the one shot.

    one participant gets out with a deadly weapon he proceeds to go over and threaten the other participant with;

    said armed participant shoots the other and kills him;

    at no time during the incident was the victim armed with anything more than an apology;

    how on Earth can an obviously premeditated (and by all we know so far an unthreatened) killer walk away free?

    is this really America?

  71. This seems insane to me. Even if it is found to have been self defense, how do you release a guy less than 24 hours after the incident before you know for sure?

    I hate when the race card is played but this sure seems to be one of those times where race factors in as I doubt this guy gets released that quickly if he was black…or if it was a black guy shooting a white guy in claimed self defense.

    Congrats to the cops there if they have set the stage for yet more protesting and probably rioting. Idiots.

    And kudos to the eye witnesses who have apparently given details that don’t match the apparent evidence. If those eye witnesses are black and did that to try and make the black person look fully innocent then great job for lying and trying to make a situation worse. Grow up.

  76. From what I read the autopsy revealed that McKnight was shot 3 times. Hand, shoulder and midsection I believe and the shots were consistent with the shooter being in a seated position so the shooter was still in his car. He didn’t stand over McKnight and mock him after shooting him. In a Stand Your Ground state this is practically acceptable. Ask George Zimmerman.
    There’s way more to this story than we know. I will bet on that.

    Sort of like when Susan Smith drowned her children and blamed it on a Black man! It didn’t stop police from rounding up Black suspects. Nobody wants to rush to judgment, but we know that even the justice system can be tainted. Trayvon Martin was stalked and killed but acquitted. If anyone had a self defense claim, it was him.

    Still waiting for all the facts but in any case where an “eyewitness” is found to have embellished or flat out lied in a racially charged case like this they should be held on hate crime statutes. We have enough real problems to fix without having to sort out that type of nonsense. Same goes for those in the new cottage industry of false claims about Trump supporters chanting while beating innocent minorities, illegals, gays etc.

    For starters, in Chicago the police rarely, if ever catch the criminals. Will Smith’s shooter was jailed immediately and remains in jail even though he claimed self defense and remained at the scene and cooperated with police.

  83. So in a mostly Black City, with a mostly Black Police Force, a white guy was released pending a further investigation. This screams racism to some of you? Do you have any idea how proud a Cop is when they arrest a murderer? Locking up a murderer is one of the greatest things a cop can do for their career. A cop wouldn’t intentionally hurt his/her own career by letting a murderer go unless there are circumstances showing self-defense.

  84. Why did Joe get out of his car in the first place? That’s rarely a good idea. One wonders what were his intentions. Who got out first? Did Gasser even get out of the car? Until we know this and more, it’s all speculation.

    It was widely reported that in 2013 Joe challenged a reporter on twitter to meet for a fight. That’s not speculation.

    You can choose to believe this or not, but it happened exactly this way,

    I cut a guy off once when I was about 19 yo trying to squeeze onto an off ramp. He passed me on the left then cut in front of me and stopped diagonally across the lane. The car behind me had to slam his brakes and was literally inches from my bumper. Nowhere to go. And yeah, 2 guys got out of the car and I took a beating that day. Probably should have locked the door, 20-20 hindsight and all but I’m glad I didn’t carry then or now because I was literally in fear for my life and may have resorted to deadly force.

The Joe McKnight tragedy is under investigation and until all the facts are on the table, inserting political shards into the conversation needlessly inflames the bloggers and diminishes the real issue we are confronted with.

I still find it hard to believe that a shooter in a deadly force incident would be released if the two “eyewitness” statements are any where close to factual; “Mr Gasser pulled McKnight from the vehicle before shooting him” and one saying “he was standing over him when he fired the third shot”. If they’re proven to be lies, those “eyewitnesses” should be prosecuted to the fullest extent that LA law allows.

    the point is the SOLUTION lies in the hands of a president-elect who says such things with no remorse and total conviction;

    remember, it’s the McKnights of the world who by and large drive the multi-billion dollar business football has become, so you’d think someone who claims to be so business-savvy would have an interest, but by his very attitudes expressed it is clear he doesn’t;

    so who will protect these business assets of the NFL off the field?

  93. So the shooter who killed McKnight was involved in a road rage incident in 2006, where he followed a driver to a gas station, and punched him several times. The shooter paid a fine and was let go.

    Can you believe that crap!?

    And with that sorry SYG law I hold out no hope that justice will find McKnight’s family in this case.

  96. This is justice in Jefferson Parish, La. They put a black kid in prison for 8 years for stealing a coke and a sandwich, until a competent lawyer had his sentence reduced and got him released.
    They had desegregation, until the whites brought back segregation.
    This is why I never go to New Orleans on vacation. I will not support a racist community.

    i agree with the above post that if joe mcknight had been a dog or another animal, the shooter would still be in jail.
