Prosecution appeals suppression order in Kraft case

With the bulk of the evidence against Patriots owner Robert Kraft ruled inadmissible in the solicitation of prostitution case against him, the prosecution is playing the only card currently in its hand: It’s appealing the ruling.

Via USA Today, an appeal of the order suppressing the contents of the “sneak and peek” video and the identification of Kraft obtained via a traffic stop was filed on Friday.

“[Prosecutor David] Aronberg is acknowledging he has no case without the illegal video recordings that four Florida judges have now found to be unconstitutional,” Kraft lawyer William Burck (pictured) said in a statement issued to USA Today. “No evidence means no trial. So the State had only two options — drop the case or appeal. They chose to appeal, but we are confident the appellate court will agree with Judge Hanser and the other judges who threw out their illegally obtained evidence.”

Multiple judges have ruled that the “sneak and peek” video surveillance violated the law by undertaking no effort to minimize the intrusion on the privacy of innocent persons who were simply getting massages. If the appellate courts don’t overturn these rulings, there will be little or no evidence against Kraft — unless prosecutors can persuade the alleged providers of prostitution to “flip” on their alleged customers.

  1. Game over. How did the people who run the show down there not anticipate that targeting an extremely powerful NFL exec would turn into a lawyer apocalypse that they couldn’t win? Stick with picking on people who don’t have the money to legally annihilate your perverse sneak and peak operations.

  2. It seems like this prosecutor is hanging on for the publicity of trying to bring down a celebrity. Wow! Many people think that celebrities with money can afford to buy a favorable decision in criminal cases. Well not when there is a motivated prosecutor involved! There should be more oversight over a prosecutor who could only be driven by having his name associated with the Robert Kraft case.

    That might be a first. Cutting the individuals charged with a felony loose to go after those charged with a misdemeanor.

  4. Prosecutorial abuse.

    Whether you hate the Pats (like losers do) or love them (like winners do), you should appreciate that Kraft has the ability and determination to fight this abusive activity to protect the right of privacy that, in the end, benefits winners and losers alike.

  5. So if this is denied the cops lose their case as they deserve. That strikes a blow against cops using illegal methods. Meanwhile the humiliation and tarnishing of Krafts reputation is great enough that those who were itching to see him suffer (I personally don’t care either way) can rest assured he has. The only ones that don’t get what they want is the faux outrage crowd who’s real endgame was a hope this would be translated into something that would help their team against the Patriots.

    What possible legal fact or precedent is there that would cause an appellate judge to set aside the decisions already made in this case ?….None !

  7. 1) Cops knowingly broke Kraft’s rights inventing reasons to stop the car he was in to ID him.
    2) Cops exceeded specific surveillance permissions judge gave them for human trafficking.
    3) When cops exceed those permissions they already knew no trafficking was going on.
    4) Cops hoaxed a bomb scare in order to install hidden cameras.
    5) Cops tried blackmailing Kraft – threatening to leak their illegal vid if he didn’t admit guilt.
    6) Cops publicly lied about trafficking and falsely implicated Kraft was somehow involved.
    7) Cops lied about there being an even bigger name involved.
    8) Cops lied saying vid shows Kraft with 2 foreign girls – when it was one 58yr old local.

  8. Patriot fans go on thinking this is all made up just like every other cheating scandal their team has been involved in.

  9. I still say someone with more juice than this prosecutor is driving this. It just makes no sense for the local authorities to pursue this on their own, they have too much to lose if Kraft wins and decides to seek retribution.

    Think about it: Would you gamble your future livelihood on Kraft just going away quietly?

  11. The prosecutors are wasting too much time and wasting too many resources on a MISDEMEANOR, thats usually punished with a fine and community service. This is a complete waste of tax dollars, just so the prosecutors and sheriffs can get some TV time.

    I would hate to be a tax payer in that county, when the bill for this operation and the civil judgement against the state start piling up.

    Exactly, and how is it that the cops aren’t being prosecuted? If any of us called in a bomb scare we’d be in jail and get the book thrown at us…yesterday!

  13. The fanboys can argue against the cops all they want, but nothing changes the fact that Kraft hooked up with a prostitution ring that engaged in human trafficking.

Patriots’ fans who argued for the exoneration of the spygater, the deflator, Hernandez the murderer, and Brady the evidence crusher will no doubt go to their graves trying to convince themselves that Robert Kraft was just having a spa day and made no contribution whatsoever to the scourge of human sex trafficking. So sad. All they have is their stupid corrupt team to root for. What about a conscience?

  16. The local cops are not very bright. They should have cut him loose and said nothing. Robert Kraft donates a lot of money to Florida charities. Shaming him like this is only going to piss him off and end his donations. Anyone remember the fable about killing the goose that lays the golden eggs?

  17. The funds have cleared, so he can now relax about the tape being released. Hopefully copies have been made. Either way, his reputation (if you want to call it that given his history) has been further damage…..rightly so. Scumbag from a-z. Nothing counts under him or BB. Shame
