Tanking allegation could take down Stephen Ross

The first rule of Tank Club is don’t talk about Tank Club. Dolphins owner Stephen Ross allegedly did, and it could actually take him down as an NFL owner.

The landmark lawsuit filed Tuesday by former Dolphins coach Brian Flores contains an accusation that Ross’s desire to tank in 2019 became sufficiently great to prompt Ross to offer Flores a lucrative incentive to lose games.

Here’s the allegation, at paragraph 14 of the complaint: “In January 2022, Mr. Flores, who spent three years as the Head Coach of Defendant Miami Dolphins, Ltd., . . . found himself without a job. He was fired by the Dolphins after leading the team to its first back-to-back winning seasons since 2003. The purported basis for his termination was alleged poor collaboration. In reality, the writing had been on the wall since Mr. Flores’ first season as Head Coach of the Dolphins, when he refused his owner’s directive to ‘tank’ for the first pick in the draft. Indeed, during the 2019 season, Miami’s owner, Stephen Ross, told Mr. Flores that he would pay him $100,000 for every loss, and the team’s General Manager, Chris Grier, told Mr. Flores that ‘Steve’ was ‘mad’ that Mr. Flores’ success in winning games that year was ‘compromising [the team’s] draft position.'”

After Flores was fired, we speculated that the team’s success may have been the first fissure in the Flores-Ross relationship.

[T]hat could be where Flores first lost Ross,” we wrote. “Entering the 2019 season, Ross realized that, sometimes, you’ve got to take your lumps. Although the object of a full-season tank job initially was Tua, Ross pivoted to Burrow. However, after a few ugly losses to begin his tenure, Flores apparently ditched and defied the tanking strategy.”

I chose the words “sometimes, you’ve got to take your lumps” because, at the risk of getting a federal subpoena (but, hey, the truth is the truth), I heard him utter those very words in March 2019, at the league meetings in Arizona, in the context of the short-term price of losing games versus the long-term gains to be realized.

At the time, it was believed Ross wanted Tua Tagovailoa. By the end of the 2019 season, Ross had become enamored with Joe Burrow. Burrow’s success surely didn’t help the case to keep Flores, if his allegations about tanking are true.

Regardless of the connection between the owner’s desire to tank and Flores’s termination, the former coach of the Dolphins is alleging that Ross OFFERED HIM $100,000 TO LOSE GAMES ON PURPOSE. That directly assaults the integrity of the game, and in an era of legalized gambling it can’t go ignored or unpunished.

As a high-level employee with another team put it on Tuesday evening, this allegation “is going to ruin Ross. . . . Ross may never recover.”

Indeed, Ross may eventually get ejected from Club Oligarch. Then again, they may want him on that wall, need him on that wall until the Flores litigation ends. Indeed, if Ross forcibly is removed while the Flores case is pending, Ross could decide to give up the goods when testifying under oath.

Meanwhile, Congress may be very interested in all of this.

    Flores’ testimony is actual evidence. Whether there is a lot of weight to such evidence is for a jury to decide.

    I would doubt there is any physical or documentary evidence of this.

  3. This is the one part of Flores’ lawsuit that could explode the NFL. An owner bribing a coach to lose games? We all know that tanking exists but this directly calls into balance the integrity and competitive balance of the game. What would prohibit a Dolphins executive or two from placing bets if they knew that this was happening. Gambling and throwing games almost destroyed MLB over 100 years ago.

  4. It doesn’t make any difference if you approve of tanking, or if you demand talking. It’s the same exact thing. If you approve of tanking, you don’t really have a leg to stand on criticizing someone for being more direct about it.

    Nothing. Nothing at all. True or not, the claim is in the suit purely to attack Ross. The claim was made by a guy who was invited to a 2nd interview with a Texans team that really could have used a guy with Flores’ record of turning around a moribund franchise. Now it is doubtful that the Texans – one of the unnamed 29 teams Flores accuses of racism – will follow through with that interview. Flores will scream “racism!” (again) when it really is just common sense–no sane person is going to interview a person who accuses people who interview him of being racists.

I totally believe the 100k story. Even Ross could see Joe Burrow was gonna be the one. Been a Miami Dolphins fan since I was 8 years old growing up in NC when we didn’t have a team. When the Panthers came along I stayed loyal. ALL my friends switched over. What has my loyalty rewarded me with since then… DRAMA. MEDIOCRITY.SCANDAL.ATROCIOUS NEW LOGO.J-LO. B-FLO.ZERO PLAYOFF WINS.

  10. According to Flores the Broncos are racist too because they were late for their interview. If Flores was that good as HC would he have been fired by Ross? No way. Flores in his 3rd year didn’t beat anybody with a winning record and no playoff appearances. On top of that he had trouble getting and keeping quality coaches. Caldwell never even made it to the field once he got close to Flores. Extreme health issues was declared but healthy 10 months later to want a HC job. Flores is just a bitter person using an excuse that should be reserved for people with real cause.

  29. If you were a bad team and did not discuss tanking for Joe Burrow or Trevor Lawrence then you have a very low business IQ. I love how everybody grandstands and takes offense to the idea of tanking, but if my team was in a similar spot I would absolutely want them to lose the one extra game to get a potentially franchise changing pick. Sure you can miss on the pick, but I’d rather take a shot at the home run than never had a shot at all. Unfortunately, too many people are idealistic and I wouldn’t want them anywhere near my franchise. I’d prefer non-emotional adults who can see the big picture and and there is no material difference between going 4-12 vs 2-14 other than one of those can give you a new franchise QB for the next 15 years and the other is more likely to keep your franchise locked in poor mediocrity longer than your fan base would like to see.

So he’s, what, counting on enough of a big payoff from the law suit to sustain him for the next 70 or 80 years of his “early retirement?” On the other hand, it is going to be interesting to see how the NFL tries to spin having only ONE black coach out of the 32 teams in their good old boy’s league. “Who, US? Of course we don’t discriminate. It’s just that us rich white owners believe white coaches are just more qualified than any of the black coaches we’ve interviewed.” Get the popcorn ready.     These owners aren’t profiles in courage, they are, in most cases, men who have built wealth that they could horde and invest in a no risk venture that strokes their ego better than a pregame visit to Orchids of Asia Spa.

If the timeline from the Belichick texts are correct, the Giants’ decision was made even before they interviewed Flores. I don’t blame him for being upset and finally being pushed to try and do something about it. I don’t believe team owners and front office people are “racist,” but I do believe the NFL like many other institutions is an “old boys club.” It’s hard for them to get beyond hiring those they have familiarity or connections to. To parade people for interviews just to meet a requirement rather than because you legitimately think they are a candidate is insulting and demeaning– it doesn’t matter if you’re applying fore a HC job, accountant, chef, or janitor. All we do know is Flores is a more capable coach than Ross is an owner.

    Err, you have heard of anti-trust laws, right? The ones preventing a few rich companies or people from screwing the rest of us? Exemptions to antitrust legislation can be stripped away if abused. That is exactly what Congress can and should do if the abuse is bad enough.

I hope somehow the league can force him to sell but I just don’t see that happening. Looking at this lawsuit and all that is involved in it seems like Flores is throwing “you-know-what” at the wall and hoping something sticks. As much as ESPN wanted him to get another job the dude just doesn’t have the chops for it. Two offensive coordinators this season after firing the previous two? This is an offensive league and he just couldn’t put one together. Can’t blame teams for passing on a sub .500 coach who just lost 7 in a row the previous season. I’m really not sure what Flores was expecting?

    Even if there isn’t think of the fun we’ll have when he subpoenas all of the text messages and emails from the owners, coaches and GMs of 32 teams. How much do you think the NFL will be willing to pay to stop that from happening. They gave Kap $7 million. Somehow I think Flores will refuse their offer no matter how many zeros they put behind it. He’s going scorched earth.

  73. Racism will be hard to prove but this is much more serious. NFL has a see no evil hear no evil approach to tanking but this is bribery done on a mass scale. This impacts bettors, players, and the audience at the same time. NFL would do well to go after Ross and the Fins if this is true. This is much worse than deflating footballs or bounties this is criminal behavior.

  74. I’m not sure that this will matter all that much. There’s no law against intentionally losing it’s a tried and true business strategy. In the business world a struggling company is bought out, it’s employees fired en mass, costly assets liquidated and when the next quarterly report comes out the company has had a miraculous turn around and is flush with profits. Stocks go up and the company is either sold or the new management rides the investment wave for long term profitability. You can bet on that in the stock market too. NFL teams are in the business of providing a sports team and tanking is the dirty little secret that Ross may have exposed. It could cost Ross but it could just be that teams own up to giving up on a season to get better draft capital. At the end of the day NFL teams exists solely to generate money.

    Trading veteran players for draft picks as part of a rebuild situation is not at all the same thing as actual offering in season bribes to throw games.

  80. If the allegation is not in writing then this goes absolutely nowhere. Do you think Grier, a black GM, is going to throw away his career for what appears to be a malcontent? LOL, Nope! Not a Phin fan but forced to watch them locally as we lived in Miami. If anyone paid attention to Flores on the sidelines it appeared as if NO ONE liked him. The guy was a stiff that showed no emotion ever. I know that doesn’t make a great coach but many things make a great leader which he appeared not. That’s typical of most the coaches coming from the Belichick tree.

    What “obvious” racism are we talking about. I dont think Flores should have been fired, but I am yet to see any “evidence” of racism from his lawsuit. The Bills choosing Daboll before his interview isnt proof of racism either. Itrs proof of people being people. After every interview the team will rank the candidates and someone will always be the leader. But that leader can get knocked down a peg when the next interview happens. So daboll was the leading choice before Flores, so what? How does that equal “the Giants didnt hire him because they are racist”?. Remember Mike Tomlin? This has long been championed as a Rooney Rule victory. Black coach who wasnt supposed to get the job, the Steelers had already made their choice (sound a lot like the Giants and Daboll). But they interviewed Tomlin anyways. They were so blown away they reversed course and hired Tomlin. Imagine if Tomlin had decided not to participate in his “sham interview”. He wouldnt have gotten the Steelers job. So Flores has reason to be upset that “he was granted a sham interview” by the Giants, but thats simply his interpretation of the events. He is not going to win this case in court. But at this point he will be a hero like Kaepernick. He will probably be considered a bigger hero if he gets crushed by the NFL. Lets be honest, he is going to get crushed by the NFL.

  82. I fail to see how it will ruin anyone. The NFL is actually not listed as a sports venue, it’s listed as an Entertainment Venue. This legally gives the league and/or each team legally the right to do whatever they want up to and including ‘fixing’ outcomes [like the WWE does]. There is no such thing as ‘tanking’… it’s a strategy that is sound and makes sense. Just because you follow a team there is NO guarantee they are going to win and/or lose. It’s the reality of the business. How a person runs their business is their right. IF you root for a team with a crappy owner, find a new team. But trust me on this one most of the owners are the same. It’s a business and they are there to make $$$, not make you happy. It’s an investment they made and are looking for a return.

  84. I find it interesting that Josh McDaniels just said he had to work on his PEOPLE SKILLS the last 10 years ..that’s where he failed in his last HC gig…..I think Brian Flores should heed his advice.
