Deshaun Watson’s admission of sexual activity with three of the 22 plaintiffs could become a major problem

In 22 of the massage sessions that resulted in civil lawsuits being filed against Browns quarterback Deshaun Watson, Watson admits — through his lawyers — that three of the massages resulted in consensual sex.

“What little sexual activity did occur was consensual,” attorney Rusty Hardin recently told Gabe Feldman during a podcast appearance. “And there are only three occasions in our cases that any type of sexual activity occurred.”

On Tuesday, Hardin’s office separately distributed a video from Hardin that, among other things, reiterated the admission that consensual sex occurred with three of the 22 massage therapists

“As we’ve said, as Deshaun has insisted under oath, each of those three occasions were consensual and instituted by the women,” Hardin said. “But in the other . . . 19 cases there was no sexual activity. And Deshaun has already given nine depositions — 11 now — and sworn under oath that there was no sexual activity except those three incidents, and they were consensual.”

Another member of Watson’s legal team, Leah Graham, made a similar admission during a conversation with HBO’s Soledad O’Brien.

“Well, in every massage, I will tell you he did go, intending just for a professional massage, and only those three instances where sexual conduct occurred — consensual sexual activity — it occurred after the massage session had ended,” Graham said. “And Mr. Watson has testified and is insistent that that sexual activity was initiated by the plaintiff in every single instance.”

The lawyers presumably have made these admissions regarding sexual activity because they have no choice but to make that admission. However, it’s hardly a strength of the case. In reality, it’s a potentially significant weakness.

Broaden the lens. Watson was getting massages from a broad array of female therapists. Between the 22 who have sued him and the 18 who later vouched for him, that’s FORTY. For a guy who has access to any and all massage services that he would need or require.

The fact that he admits, through his lawyers, that three of the 22 massages that resulted in lawsuits ended with consensual sex underscores the potentially persuasive argument that he was looking not only for massages, but for something more.

Yes, he insists the three instances of sex were consensual. Yes, he claims the massage therapists initiated it. But if Watson is finding massage therapists on social media and after 13.6 percent of those massages actually engaging in post-massage sexual activity, is it unreasonable to conclude that he entered the massage with the thought in mind that maybe, just maybe, it will turn sexual? That maybe, just maybe, there’s something he can do to nudge things that way?

The bulk of the cases against Watson arise from allegations that he tried to nudge things that way. The fact that, in three cases, sexual activity occurred necessarily adds credibility to the allegation that, in the other 19 cases, he at least attempted to move the massage in that direction.

Several weeks ago, the presiding judge allowed the 22 plaintiffs to seek evidence regarding whether Watson engaged in sexual activity with the 19 massage therapists who provided statements of support for Watson. This ruling — and our fair and even-handed treatment of it — actually triggered an angry response from Watson’s camp.

Why would it make Watson’s lawyers mad? Because they know that if Watson can be painted as someone who had a habit of lining up massages on social media with strangers and hoping that he’d get something more than a massage, it meshes with the claims made by those who claim to have been traumatized by his affirmative effort to get something more than a massage.

  1. The more information that comes out, the more we can all see that Watson is a sick self-absorbed pervert.

  2. This is going to drag on for years. Browns made a huge blunder in thinking everything was just going to vanish after the grand jury didn’t indict him. They should have made him settling all 22 cases a condition of signing him. And if some were holdouts he needed to just keep adding zeros to the check until they finally settled. That’s the only way this was ever going to die down. Watson’s too dumb to see that but the Browns should have realized that.

  4. Watson didn’t settle when he had multiple opportunities. His lawyer or his own stubbornness is doing him a disservice.

  5. 230 Million divided by 23… Hmm… 10M each okay that works. Watson gets 10 million over the course of 6 years. So do each of the plaintiffs.
    Remember, civil is preponderous of evidence. Criminal is beyond a shadow of a doubt. Criminal there should be enough doubt.

  6. The money they gave this guy with all this hanging over his head was not only foolish, it’s disgusting. I have a daughter, a mom and a gf I love very much. What does this say to the women in the world? What message are the Browns and the league sending to women? It’s an absolute disgrace.

    If they agreed for a price, that’s prostitution.

    If he was paying like $60.00 a massage and the ones he had sex with got paid $150.00. That would be interesting. I assume he paid with a debit, or credit card. Would love to see the amount of money involved with each massage.

    There might be an interesting pattern here.

  8. I hope Baker comes in and does well just to make the entire situation worse for the Browns. I feel bad for their fans, but the organization brought this on themselves.

  9. Imagine seeing a minimum of FORTY massage therapists and saying he was only looking for legitimate treatment. Guy is a sick predator.

  10. I’m still just completely baffled his advisors allowed all of this to come out. Him not settling is perhaps the dumbest decision in my lifetime…and that’s saying A LOT.

  12. I watched Bryant Gumble last night and it left me wondering, Why does a professional athlete of his stature choose to see massage therapists that are just starting their careers? You would think that he would go to the best of the best but he chose the most inexperienced! This makes me think that he wanted there to be a power differential. He sought out those who would be more vulnerable to needing him as a client and thus less likely to complain and be believed. The best of the best would not tolerate bad behavior because they wouldn’t have to have his business. This behavior convinced me that he went to those places with an agenda.

  13. I don’t get the Browns… Sure, all things equal, Deshawn is probably a better QB…probably. Not like the guy doesn’t have a couple on field question marks himself. Bad team or not, 4-12 seasons don’t typically happen with healthy, elite QBs.

    But all things weighed, who wouldn’t rather take their chances with Mayfield and hope the guy is a quality QB when healthy and a good team around him over ‘probably good’ Watson with huge legal issues, suspensions, and PR nightmares hanging over your head? And oh by the way, it took fully guaranteeing an absurd contract to get him even interested in you in the first place.

    I dunno, I’da taken my chances with Mayfield…

    And what is the QB situation in Cleveland until the Watson situation is resolved?
    Is Baker QB1 until Watson is available?

  24. This is pretty much meaningless. The court can’t prove Watson’s intent or read his mind. The judges already deemed they couldn’t prove their case. Nothing in this post changes that.

  25. Just ask Robert Kraft how to get off from this mess .. no pun intended . Cleveland will be looking for a new Qb to start season . If I were Baker I would negotiate a insane contract to stay , he will be starting .

  26. Commissioner exempt list until all cases resolved. Probably gets paid $1m salary to hold clipboard in 2022. NFL doesn’t tip its hand. After all cases resolved, probably before the start of 2023 games, NFL suspends him without pay a game for each case resolved for the plaintiff and splits cases settled. This allows the NFL to suspend for up to 22 games and Watson loses real money. Browns have some guaranteed outs as Florio previously pointed out.

  27. If Baker is not traded, and holds out, he loses his salary and gets $0. It would be in his best interest to negotiate a written no tag addendum to his current contract and try to ball out to improve his landing spot in 2023.

    If any fans stuck with the Browns and all the losing and other things(bad/horrible decisions) they’ve made for the last 20+yrs then they deserve this and a lot more, no one should feel sorry for them it’s there choice and they just continue to stick with them!

    Another fan who cares about nothing but winning I guess. First, no judges deemed anything. The grand jury did not indict him. The prosecutor can bring charges against him at anytime in the future and does not even need a grand jury. One of the main reasons they do not is so they do not hurt their case until they feel it is stronger and wait for a civil case to go to court first.

    As well as in many cases they will wait until the civil case is over as it will bring out more evidence for a criminal case. If he loses (which he probably will since the level of proof is lower in a civil case) then that will strengthen the chance of winning a criminal case.

    Also, intent does not have to be proven but obvious intent can be used in a civil case to help in determination.

    Or he can simply show up and be nice but have medical issues that keep him from playing. The NFL can’t force him to play even if he cannot prove discomfort or pain because of the NFLPA. Basically a hold in instead of a hold out.

  32. Watson is done. So should the careers of the Spa Owner (she knew exactly what that 5K meant), along with the 3 women that did things with Watson way beyond a “professional” massage.
