Deshaun Watson’s lawyer, Rusty Hardin: “Happy ending” remark was used “hypothetically”

Friday did not have a satisfactory conclusion for lawyer Rusty Hardin.

After his comment during a radio interview regarding “happy endings” during massage sessions not being illegal went viral in a bad way, the attorney representing Browns quarterback Deshaun Watson tried to fix things with a statement issued late in the afternoon.

“Deshaun Watson did nothing wrong,” Hardin said. “And as two grand juries have made clear, Deshaun did nothing illegal. Deshaun has always acknowledged consensual sexual activity with three of the plaintiff massage therapists after massages. And Deshaun has repeatedly sworn under oath that he did not force any of his accusers to have sexual contact.

“On a Houston radio show interview today, I mentioned that a massage that has a ‘happy ending’ is not illegal, meaning it is not illegal for someone to have consensual sex with a therapist after a massage unless the sex is for pay. Deshaun did not pay anyone for sex. I was using the term hypothetically and not describing Deshaun’s case.

“I have reiterated to others it’s not OK to do anything that a woman does not agree to do. These women have alleged assault in their pleadings. I was speaking in a hypothetical situation. If there is a consensual sexual encounter after a massage, that is not a crime nor the basis for a civil lawsuit. I was not talking about what Deshaun did or did not do or expected or did not expect.”

The comment from Hardin nevertheless bolsters the argument that Watson wanted or expected “happy endings,” and that Watson was actively seeking them out. In trying to make a massage turn sexual, Watson potentially offended and/or touched in an unwelcome or unwanted way one or more of the massage therapists with one or more areas of his body.

That’s what the 23 plaintiffs are alleging, that Watson went too far in trying to make the massages a sexual encounter. The mindset bluntly expressed by Hardin’s original comment and more subtly residing in his effort to clean up the mess his remarks made could ultimately bolster the 23 cases pending against Watson. If Watson and Hardin see nothing wrong with a massage becoming sexual and they see nothing wrong with an effort to make a massage become sexual, they fail to comprehend the foundation of the complaints against Watson — that he allegedly crossed the line in trying to get the massages to cross the line.

    Rusty Hardin is becoming the women’s best evidence.

  2. Hardin was supposedly the lesser offending lawyer until now. He and his client appear to be living in a reality bubble that’s about to get popped. Twenty-four cases?! If he’s trying to sway public opinion, this is an utter disaster. Why does this seem to be getting worse and worse for Watson? How did the Cleveland Browns not see this coming? And what is the NFL waiting or hoping for an outcome? At some point, an outraged public or media will not simply let this pass. The NFL may have to come down hard on Watson.

  3. The NFL needs to step in and come down hard to keep this from dragging them down. They need to suspend Watson indefinitely and will revisit it after all cases are solved. Then they will see how many extra games he will be suspended after that. Otherwise they look like they are Hardin supporting the happy ending expectations.

  9. Not sure why Watson’s lawyer is doing radio shows, especially after suggesting the other lawyer is only interested in media attention. His client’s defense will/should happen in a courtroom, not in the media.

    Then the bird hit the fan. Including Bauer. Let’s not forget Elliott/Hunt who you might not want your daughter to marry but Watson is a guy I don’t want to live near.

    The NFL will be LAUGHED at if it’s just one year. Ha Ha . Cleveland back loaded it. FEEBS. I strongly believe the back loaded guaranteed contract is what will do him in. OTHER OWNERS ARE NOT HAPPY with that contract.

    So, Cleveland scams the contract just in case and owners are peeved. Roger is not between a rock and hard place. He’s gonna hammer Watson. Cleveland is between a rock and a hard place. No pun intended (Rock=Baker).

  15. Something tells me that even if all these cases get settled at Watson gets to continue his career, some time down the road we will hear about his sex crimes once again. Guys like this don’t just stop doing it, until they go to prison.

Watson may get a 3 year suspension; or, a two year suspension and, after all 24 civil trials are concluded, impose a further suspension depending on the evidence given and the outcome of the trials. Cleveland’s owner, the Haslams, already sullied by the Flying J federal investigations, Berry, and Stefanski (who colluded to lose the last 5 games of 2021 in order to disgrace Mayfield in order to go after a different QB) are now reaping the fruits of their diabolic plan…what goes around comes around. I hope Mayfield graciously plays for the Browns in 2022 and takes them into the play-off rounds. After the season, Mayfield will be free and the Browns will still be writing checks, again, to a QB not on the team. However, I’m sure, no matter how well Mayfield may play for them, Stefanski will find a way to call ridiculous plays in order that Mayfield look foolish and the Browns lose any play-off seeding. It’s no longer Cleveland the Mistake By the Lake; it’s Cleveland the Snake by The Lake.

  22. FYI, as far as results go Rusty Hardin was like the Tom Brady of prosecutors and now he’s like the Tom Brady of defense attorneys. You can have your social media outrage laugh all you want. Try actually researching his history and results. Buzzbee is a decent defense attorney as well. He helped get himself out of a DUI.

  24. I guess it goes back to that old saying “It takes one, to know one”. Looks like Watson hooked up with a lawyer that thinks the same way he does. It really should make your skin crawl that there are people out there like this. Goodell is gonna have a field day if he somehow messes up this suspension. It’s a stain on the leagues shield and no matter which side you believe, Watson was the one who put himself in this position and he’s gonna have to pay the price. Baker may have his own issues but at least he’s not well… this.

  26. You can’t make this stuff up!!! I believe in the end, when its all said and done, the Browns will ultimately regret signing Watson. If they don’t already. In the short term and the long term. In the short term because Goddell is probably gonna snatch the season from him entirely. I don’t think he gets a 6 game or even 8 game suspension, but ALL 17 GAMES. So the season is almost already a wash. Even if he did get an abreviated suspension in the 8 to 10 game range, the stench of this whole fiasco will hang over the Browns all season and kill it before it starts. In the long term, by the time he does get to play in 2023 he will possibly have sat out 2 “prime of his life” seasons,while coming off of being one of the star attractions in one of the more salacious scandals in recent NFL memory, at which point you gotta legitimately ask if he can ever regain elite form. I’m not so sure the guy even plays another down in the league. And thats a damn shame. It’s all a damn shame man!!! The Browns and Cleveland deserve better. I hope Baker goes some place and tears s*** up!!!

  27. I’m not sure this situation will have a happy ending for Watson. Rusty should be working pro-bono, as Watson will need every cent for the settlements. Then when the suspension ends, Watson can resume his career in the newly formed NFL Seniors tag football league, at some point in 2042.

  29. apparently hardin thinks he did his job when he juiced the wheels of justice in texas to secure the no bill from the grand jury, and now wants watson to have to pay for his offenses in a financial and professional setting rather than the texas prison system.

  32. Best punishment: commissioners exempt list until civil suits are settled or decided. DeShaun can collect his $1MM salary while doing so. Suspension through 2023 season once they are all settled so DeShaun actually loses a real year’s pay. Then Browns can have a 3 year “well rested”Deshaun for the last two highly comped years.
