NFL can’t punish Matt Araiza but the Bills could cut him, in theory

USA TODAY Sports

The allegations (and at this point they are only allegations) against Bills punter Matt Araiza are horrifying. But the NFL can do nothing about it, because the alleged incident happened before Araiza was drafted by the Bills.

“We are aware of the matter but will decline further comment at this time,” the league said in an email to PFT.

The Personal Conduct Policy does not encompass alleged misconduct occurring before a player is drafted. At most, the incident would be used against him for enhanced or expired discipline, if he violates the policy once he’s in the NFL.

That doesn’t stop the Bill from cutting him, if they choose to do it. Although Araiza and/or the NFL Player Association could make a stink about a decision to dump Araiza for reasons that would obviously be unrelated to skill, the Bills ultimately can do whatever they want to do — and they may decide that it’s better to find another punter.

Especially since the Bills open the 2022 NFL season two weeks from tonight against the Rams in L.A. And since punter likely won’t be a heavily utilized chore for the Bills this year.

  1. Innocent or guilt don’t matter in the case of a punter! Kiss your career good bye! Only a predator like Watson could survive this

  2. He’s a punter and not worth the headache. Cut him and the guy can resume his career if he gets clear of the allegations.

  3. This allegedly happened how long ago? No criminal charges filed about how long of an incident that as far as we know hasn’t been proven anything happened. In today’s criminal justice system DNA stands supreme in evidence. So this alleged victim files a civil suit on the NFL player and nobody else? Sounds like a possible money grab. If it’s proven that he’s guilty, lifetime ban. If he’s innocent then she should be charged. Innocent till proven guilty in my book.

  4. Another upstanding citizen in the NFL. Love this NFL cant do anything but the Bills can. No Felonies League not in effect.

  5. I have no idea if he is guilty or not. But for the sake of argument, let’s say he’s not. Is it fair to rip away a promising career for what may be a money grab. We don’t know all the facts yet. At least in Watson’s case he had 22 women come forward.

  6. So it doesn’t matter if he did it, because to some he is already a “predator” by the accusation alone.

What a sad place we are in the US.

  7. Fans already calling for this guy to be on the unemployment line over getting sued.
Football players don’t get the same right to the presumption of innocence that everyone else gets?

  8. For anyone screaming that he should be cut from the team just because there are allegations, we live in a country (thankfully) where you are innocent until proven guilty. Don’t get me wrong; anyone found guilty of committing an act like this should rot in jail. Unless he is found guilty of committing this act though, he should be able to continue to work and provide for himself and his family. Remember, allegations are just allegations.

  9. Has the policy changed? Because the NFL suspended Terrell Pryor in 2011 for actions before he was in the NFL, while he was at OSU. All he did was sell some autographs, nothing like this.

  10. NFL and media needs to leave these stories alone and let the justice system take it’s course. NFL is sports entertainment, not court of public opinion.

  11. There’s enough smoke there.
Seemed like a good kid, great talent.
But if it’s true I think you gotta cut him.
Interesting to see the Bills move here, since they literally
    Just cut Matt Haack

  12. I don’t understand why the NFL “can’t” do anything. It’s a private organization. If he isn’t in the league and therefore isn’t bound by NFL rules, why should they follow rules that do not apply to him. Why can’t they just say “yeah…thanks but no thanks”?

  13. The fact that another punter was drafted before him made no sense, but now it’s clear that the Ravens and Bucs knew about these allegations. He’s a damn good punter but I’d cut him and let him be someone else’s problem.

  14. The NFL may not be able to punish him but the Bill’s should do an investigation into the matter. He deserves that much. But if there’s anything there cut him immediately

  15. If the bills want to keep they need to disclose what they uncovered during their investigation

  16. Did we learn nothing from the Jeff Gladney situation? Presumption of innocence is a fairly important pillar of American jurisprudence…… or at least it used to be.

  17. Who knows if he did this or not,but just having his name attached to this accusation does not bode well.

  18. In 06 Ahmad Bradshaw was accused of stealing an xbox if I remember correctly at Marshall. The case played out during his first couple of years with the Giants. I believe the league disciplined him.

  19. Innocent until proven guilty has taken a back seat of late. This all has to play out first. If he was wrongfully accused, he should not be penalized.

  20. Not a fan of mob rule but he’s just a punter. Cut him and let another franchise deal with this.

  21. Teams employ retired FBI agents to investigate players backgrounds before the the draft or incidents that occur while they are members of the team. The Bills could suspend Araiza with pay until they know one way or another if these allegations are valid.

  22. If the Bills want to retain a shred of respectability, he better be cut by 8am. Then hold a presser at 9am explaining, and apologizing for, their keep/cut decision between MA and Haack.

  23. Innocent until proven guilty. Look at Duke lacrosse. If he did it….send him to prison for life.

  24. I really want to hear players speak out on these issues. You can’t talk about social justice if you don’t demand justice amongst your own ranks.

  25. Didn’t the Bills just cut their veteran punter to give the job to this guy? I would think they can’t get the vet back now?

  26. Innocent until proven guilty used to mean something in this country. In fact, it was sacred. And now people are calling for this guy to be fired? Lord have mercy.

  27. The reason people assumed he was not the first punter drafted was because he couldn’t directional punt, he just kicked it far without any accuracy. But maybe teams knew about his upcoming legal issues and thats why he dropped. In which case either the Bills had a scouting mess up being the team to not know this, or they knew and picked him anyways, which would mean they wouldnt want to cut him and waste a 5th round pick if they already knew about this. These allegations are a bad look either way unfortunately.

  28. My question is why has the criminal investigation gone nowhere? It seems fishy there’s been no Grand Jury put forth by the DA

  29. Bills did an extensive investigation when they just found out? Or did they know all along and didn’t care?

    Something doesn’t add up

  30. Whatever happened to innocent until proven guilty? Let the justice system deal with the case before we all start brandishing pitchforks.

  31. Where are (or were) the police in all of this? If the allegations are true, at a minimum the SDSU players are guilty of statutory rape. But this comes out as a civil suit? Something is very wrong about how this has unfolded, and yet it may kill Araiza’s career.

  32. Cut him. 6th round punter who has some serious accusations against him. The Bills will do the right thing.

  33. “And since punter likely won’t be a heavily utilized chore for the Bills this year.”
Don’t believe the hype…. Or are you already handing the Lombardi to the Bills….hahahaha

  34. Of coarse the league cant punish him. Because the NFL is lost and no compass on anything it does. Thank You for the effed up product we have today…..Roger. Its all coming apart at the seems under your pathetic, incompetant, DICTATORSHIP

  35. Then how did the league punish Terrell Pryor for getting free tattoos at Ohio State?

  36. Pretty horrific claim. But maybe we need to wait and see if it is true or not before jumping to a bunch of conclusions?

  37. Wait, tell that to Zeke! He got suspended 6 games for something from college, that was proven by the police and verified by the NFL investigator.

  38. What about Ezekiel Elliott, wasn’t he suspended for things that occurred before he was drafted?

  39. Yeah…lets not wait for details, lets not see what actually happened…just cut him and perhaps ruin his life needlessly. People amaze me….and it is all of our fault. We have allowed this to happen. With the overload of information we think we know everything even when we don’t. He may have done it but there is certainly the chance that he did not.

  40. His lawyer must be a village idiot. Stated it was a money grab because he’s on the Bills now. Unfortunately he wasn’t a Bill 7 months ago when a complaint was made. Sometimes it’s better to say nothing and be thought a fool………….

  41. Why no criminal case? Why just a civil case? Could it be be cause of the difference in needed burden of proof? Feels like a money grab to me.

  42. “But the NFL can do nothing about it, because the alleged incident happened before Araiza was drafted by the Bills.”

    Tell that to Terelle Pryor.

Aren’t people sick of presuming guilt before any real facts are known???
    ____________

Lots of people apparently fail to understand that innocent until proven guilty applies only in a court of law. The public is free to express its opinion at anytime.

  44. If it turns out that this accusation is true, he will not only lose his job, but his freedom, as well.

Innocent until proven guilty. Look at Duke lacrosse. If he did it….send him to prison for life.
    ____________

The Duke lacrosse false allegation was a horrible situation that should never have happened. However, it was mainly driven by a rogue, dishonest district attorney. It does not mean that all victims are liars. There are way too many people trying to justify sexual assault who wave the Duke lacrosse flag.

  46. Lots of folks giving him the benefit of the doubt and saying innocent until proven guilty….

Are you giving the accuser the benefit of the doubt as well?

She reported it the day after, school and police sat on it. She’s 17-18 years old. Pretty jaded to just disregard her as a money grab

  47. Sounds horrific, and obviously, if he’s guilty, he should face any and all consequences associated w/ that.

But yeah – as a society, we still rush to judgment. “Innocent until proven guilty” really IS a thing, and we’ve gone down the wrong road on that one before…

  48. To everyone screaming “cut him” do you remember the Gareon Conley rape allegations? Not only was he found not involved in anyway to move forward he was able to sue for defamation. That being said, if this is true the Bills need to cut him as soon as there is proof of that.

Are the other men that are accused being sued or just Araiza? That would be an indicator on whether this is a money grab or not.

  49. Anyone who thinks this is a “cash grab,” involving two SD State players and an nfl rookie 6th round punter, has hit their hand slamming into tables too many times.

  50. “The Duke lacrosse false allegation was a horrible situation that should never have happened. However, it was mainly driven by a rogue, dishonest district attorney. It does not mean that all victims are liars. There are way too many people trying to justify sexual assault who wave the Duke lacrosse flag.”
    _______________________

The circumstances are different – but the basic principle remains the same: we shouldn’t rush to judgement, on either side of the equation.

If someone is trying to “justify sexual assault” – that’s a different story. Obviously, that would be terrible. But if someone is just saying “innocent until proven guilty” and “let this play out” – those should be sentiments we all have about this.

Duke Lacrosse was a valuable lesson for this country. We shouldn’t just marginalize it. The alleged victim in this case ALSO deserves the benefit of the doubt.

  51. Read the LA Times story. Apparently the Buffalo scouts were the only ones who didn’t know about the incident.

  52. This is funny, somehow they managed to punish Ezekiel Elliot for his incident that happened before he was drafted. That wasn’t even alleged he was proven innocent and still received a 6 game suspension. The NFL is a joke.

Yes it is a sad place. So was the place we were before, where women were SA without recourse. Where women sought justice only to be victimized again. Where athletes, pro & college, walked away unscathed. Women saw what happened to other women who reported & kept silent when they were attacked to avoid the same treatment. Actually we still live in that world too. But this world at least has started giving women some agency. Until athletes stop being treated as if there’s a different set of rules for them or until more of them face consequences, things wont change. And it will continue to be a sad world we live in.

  54. Guys, “innocent until proven guilty” is a legal concept that means you can’t be jailed by the government until found guilty in a court of law. Your employer can do whatever the hell they want; if the PA wants to fight it, there’s a process there to ensure his rights haven’t been violated.

Look, I’m a Bills fan, and I was really looking forward to watching this guy punt it 80 yards every time, but as a fan I also want my team to have upstanding guys on the field. It sounds from the LATimes reporting like he’s been caught on tape by the police admitting at the very least to sex with a minor. That’s not what I want on my football team all by itself, gang rape aside. Obviously I’d want the Bills to confirm that with the cops, but if accurate, 100% we need to cut bait. There’s gotta be a mediocre free agent punter available.

    _________________________

Good question. You should ask the authorities. The young lady reported it the next day.

  56. What this guy is accuse of doing is a BAZZILION times obviously worse than what a Deshaun Watson did, At least Watson DID NOT Physically VIOLATED his Accusers and is more on the avenue of the SICK & PERVERTED. The most puzzling thing in all this which just blows my mind, Is that the Bills are saying they knew of this with their Investigation which i find hard to believe and if they did, What does that say about them knowing what they knew & still going ahead drafting this guy.

  57. If true, these allegations make Deshaun Watson look like Mr. Rogers (google it, kids).

The lack of criminal charges on campus means nothing. San Diego State was having a great season and just opened a brand new 300-million-dollar stadium. No chance this was ever going to see the light of day in a criminal proceeding.

It’s simple enough to address fairly though; the Bills should suspend him, have their security organization do a thorough investigation, and deal with the outcome.

  58. They’ll only need a good punter when they play good teams so having one will only make the difference between success and a continuation of decades of abject failure.

  59. The university and the police sat on this case for months. It was reported immediately, and then… nothing.

  60. If he’s guilty, let a court of law make that decision, then cut him if guilty. Until then, he has the right to work. Guilt is not determined in the media.

  61. I’m in Buffalo and would have ZERO issue with cutting him. Yet this story is a day old and the situation happened 10 months ago. How is it just emerging as a story now ??
NFL and Bills would seem to need A LOT more info in order to do the right thing. Public opinion doesn’t mean anything right now.

Criminal is different than civil. He called it a money grab because the civil lawsuit didn’t come out until he was named the starter and the Bills cut Haack.

  63. It seems like only yesterday the NFL was suspending guys 5 games for free tattoos in college. I guess they closed that loophole but created more issues like this one in the process.

  64. The Bills still honor OJ. Why would anyone believe they will do the right thing in this situation?
