Statement from Steve Wilks’ lawyer is also a warning to the Cardinals on Brian Flores

The statement came swiftly from lawyer Doug Wigdor. And it should be regarded by Cardinals owner Michael Bidwill as a clear warning.

Wigdor, who represents former Panthers interim coach Steve Wilks, reacted sharply to the news that the Panthers had passed over Wilks for Frank Reich.

“We are shocked and disturbed that after the incredible job Coach Wilks did as the interim coach, including bringing the team back into playoff contention and garnering the support of the players and fans, that he was passed over for the head coach position by David Tepper,” Wigdor said. “There is a legitimate race problem in the NFL, and we can assure you that we will have more to say in the coming days.”

The statement comes at a time when the primary plaintiff in the lawsuit Wilks has joined — Brian Flores — is under consideration for the head-coaching job in Arizona. Wilks has sued the Cardinals for firing him after one year. Wilks likely will be suing the Panthers, given the content of Wigdor’s statement. And Flores joined the Texans to the litigation last year, after they interviewed him for the head-coaching job, made him one of three finalists, and eventually went off the board and hired Lovie Smith.

The argument that Flores made against the Texans, that Wilks likely will make against the Panthers, and that Flores would potentially make against the Cardinals is a simple one. The decision not to hire them was motivated in whole or in part by the fact that they have attempted to pursue their rights under federal anti-discrimination laws.

Although many non-lawyers assume it’s perfectly fine to shun someone who has dared to pursue available legal remedies, the law provides separate protection against retaliation. In many cases, the retaliation case is less difficult to prove than the original case, since it’s conceptually easier to sell a jury on the notion that someone who has legitimately made trouble for an employer is regarded derisively as a troublemaker.

By interviewing Flores, the Cardinals have made it hard not to hire him. Unless the person they hire is clearly and obviously more accomplished than Flores, they would be inviting a claim for Flores for retaliation. Basically, that means they need to hire Sean Payton (who interviewed for the job on Thursday) or Flores.

But at least the Cardinals gave Flores an interview. The Texans didn’t, even though he was a finalist last year. The Broncos didn’t; they’re one of the teams Flores sued, alleging a sham interview in the process that resulted in the hiring of Vic Fangio. Neither the Colts nor the Panthers interviewed Flores either, putting them at risk for a retaliation claim, too.

The Cardinals can do the NFL and all of its teams a favor by hiring Flores. The Cardinals also may be doing themselves a favor from a football standpoint by hiring him, since he could be exactly what the organization currently needs, in the aftermath of the loose ship that Kliff Kingsbury ran during his four seasons with the team.

For now, here’s the main point. Wigdor’s statement about the Panthers includes a very strong message to the Cardinals. If they don’t hire Flores, they’d better be able to prove that they have a good reason for it — and that reason can’t be “we don’t want to do business with someone who has dared to sue The Shield.”

  1. And so the pendulum will swing and now teams will have to ponder “will this coach sue me if I don’t hire” before they even agree to an interview.
    This is going in the opposite direction fellas.

  2. The dolphins passed over Dan Campbell too when had a strong interim job, but he didn’t sue, he went out and improved his candidacy.

  3. let me get this straight. Any team having a coaching vacancy somehow owes Flores the job? Did he win multiple SB’s without my knowledge? Sorry, but he is owed nothing.

    I like Flores as a coach. He did a great job in Miami and there was some shady stuff going on there that he got the short end of. But I can think of many more ways interviewing him can go poorly for you if he’s the plaintiff in a lawsuit against you. I would think there would be significant legal risk with doing that.

  5. Not smart, making them regret interviewing him. I believe if black coaches started threatening to win championships more black coaches would be hired. Just having a winning season for the ceiling isn’t enough.

  6. This situation has become ludicrous. Don’t interview a candidate – get sued. Interview a candidate, prefer a different one – get sued. Hire a guy as INTERIM, don’t hire him permanently – get sued. Initially I had some compassion for what has gone on but no longer. Now I hope this gets thrown out.

    Yes, it can. It’s a very good reason. It’s quite logical in the sense of self-preservation to be scared of someone suing your employer or your entire industry.

  10. This is beginning to look more like an extortion racket. A lot of interim head coaches (of any color) have done well only to be replaced at the end of the season (guy from the Raiders comes to mind).

  11. What I don’t understand in the case against the Cardinals…

    1) They HIRED Steve Wilks after interviewing a bunch of white Candidates.

    2) They previously hired Dennis Green a decade earlier.

    3) Rod Graves, The predecessor to Steve Keim was African American as well.

    I like Wilks, I obviously would have liked him to succeed in Arizona, however, he was ill prepared for that job, and it showed that season.

    He and his lawyer are omitting the fact the he justnwasnt.ready to be an NFL Head coach as that time.

  12. Their reason if they do not hire FLores is they hired the guy they think is best. These are private employers and can hire anyone they want for any reason as long as they do not openly discriminate. Hiring someone who has zero experience may be better to them than someone who has a losing record. Their option.

  13. Racism is real. But what if someone else really is just better suited for a job? This is a tough position to be in.

    Flores doesn’t scare anyone, which is why he continues to get interviews. Wilks is in the same boat, despite the desperate flailing and blovating by his guy who is paid to do so.

    The *law* protects “The Shield” because in these instances, no law has apparently been broken.

    Of course, that’s not to comment on whether hiring Reich is a good idea.

  15. I do not know the legal terms, but if they hire someone because they are afraid of getting sued from that person wouldn’t this be blackmail?

  16. I like Steve Wills alot, but he went 6-6 and the only reason they were in contention is because of the poor state of their division. Most coaches are on the hot-seat when they hover around .500. It seems as though these guys are now trying to force teams to hire them because of their minority status. Again, Flores was also hovering around .500 when Miami let him go. I don’t know what the solution is at this point, but litigation may make it worse.

I think Flores should be a head coach somewhere.. but lawyers forcing a hiring would be only a short term win for Flores as for him and the organization to succeed he has to be wanted. unfortunately Lawyers are hard wired to divide/conquer – win at all costs and while that can bring some positive changes overall, organizations do not function well in forced environments. there is a race issue in the NFL, but these lawyers did not do their clients any favors for getting hired now. but I doubt they care, just want to win the case.

  18. I thought Wilks was a shoe in for that job. He took the Panthers from pretender to contender. I’d hate to believe in 2023 race would play into it but by god, what compelling reason was there to hire Reich over Wilks?

  19. Peter King made a comment that the Panthers could say they wanted a Offensive minded coach to develop a QB. Why couldn’t they have hired Wilks and made Frank the OC or QB coach to help develop a young QB instead of being a HC with lots of other things to focus on??? We all know the Texans wanted Josh McCown last year but couldn’t hire him after the lawsuit and going 1 and Done with David Cully and didn’t want to hire Flores cuz of the lawsuit so the just grabbed poor Lovie Smith as a scape goat to say they were not being racist just to 1 and Done him the same way.

  20. In all honesty, i don’t know why Wilks wasnt hired. From an outsider’s perspective, he seemed like a great fit. But, we don’t know what happened behind closed doors. We should be careful about jumping to conclusions without having all of the facts.

    As far as Flores goes, he got the interview. Wouldn’t collusion be an inability to get interviews? And to be fair – when considering his capabilities for a coaching opportunity, don’t they need to consider what happened in Miami? According to reports, he was difficult to get along with. In my experience in business, if you are going to be a PITA, you better be knocking it out of the park for people to tolerate it. Anything short of a rock star, and you won’t last long.

    Flores sued the NFL (And the Giants) after not being hired. Does anyone today believe that the Giants made a mistake in hiring Daboll? Does anyone have confidence that if they hired Flores he would have had the same or better results? I don’t think so….

    Its easy to look at numbers and say, there should be more XX type of coaches in the league. But we need to look at the individual situations before we can decide if racism is the reason behind the numbers.

  21. If there was a race problem, Tepper wouldn’t have appointed Wilks INTERIM HC. McAdoo was qualified to be the INTERIM too. Can McAdoo sue because he feels he was more qualified than Wilks? The league is CREATING a RACISM problem…
    Owners can hire whoever they want. The goal is still to win right? He didn’t hire Reich so the Panthers could have a worse season. It’s not a knock on Wilks, he’s a great DC, but let’s not forget he was 3-13 with the Cardinals previously.

    Sorry, Flores is a good defensive coach period. He needs a strong HC to keep him in line. He was the main problem in Miami. 4 offensive coordinators in 3 years, no one wanted to work for him because he’s a toxic coach. Look at how many assistants he fired over 3 years. Fired an O line coach a week after hiring and said it was a gut feeling, really! Ego gone wild.

  26. Flores is superbowl winning defensive coordinator who turned a terrible tanking franchise around and made them competitive. He is one the most qualified out there and it’s a shame people disparage him because he stood up to the racism of the Giants and Dolphins lack of integrity. No one has ever explained why his claims are not valid.

    Daboll being successful is irrelevant. The process in which they hired him and conducted sham interviews after was against the rules. and considering how the Dolphins overachieved when Flores took over I’m not convinced that the giants would not have been just as successful.

  28. Still waiting on Nathaniel Hackett’s upcoming statement and possible lawsuit, he wasn’t even given a full season to prove his worth in Denver.

  29. At what point is the “if you don’t hire me gun” pointed at a billionaires head going to make it impossible to sell an NFL franchise? (There are 192 people on the planet that have a net worth in excess of $10 billion) Not sure if a $5B – $7B toy is worth the headache.

  31. Apparently, this is a one way street to encourage racism. By same standards why no love for Ben McAdoo? Wilks is 9-19 as a HC and McAdoo is 13-15. Isn’t McAdoo just as qualified?

  33. Please stop using the word “great” when describing Flores tenure in Miami. He was ok or even good – but not great. He had two must win games (Buffalo in 20 and Tennessee in 21) and the Dolphins were blown out in each game with their season on the line. His offensive staff was horrendous and their defense was a little overrated. “Great” is not the correct word here.

  34. So only interview a minority that has absolutely no chance of getting the job. This will prevent the team from being sued. Do they not see how ridiculous that is and then they wonder why the Roonie Rule doesn’t work? They are not doing minorities a favor by having this rule and then having individuals sue teams when they don’t get the job. Best person gets the job regardless of the color of their skin. Isn’t this what everyone wants? Owners have a right to hire who they want. Even if a guy is successful in the past, doesn’t necessarily make him a right fit. Why do you think we have so much turnover in coaching year after year?

  35. The article implies that ‘for optics’ it’s a good idea. I’m not a fan of hiring a HC based on the optics of others. Imagine if in the dating world people told you to date someone based on optics….don’t think that’d go over too well. You do what is best for your club….winning is the only optic I want my team to hire based on.

  36. Not sure why folks keep saying Flores was a good coach in Miami??? Overall, he had a losing record and never made it to the playoffs. It’s well documented he was extremely difficult to work with and seemed to poorly evaluate talent (Tua, Minkah, etc.). Prior to being the Miami HC, he wasn’t ever a DC, all that time in New England and even last year with the Steelers he still was only a LB coach. I’m still pissed he ratted out his employer (Dolphins) after he was fired…it’s not noble, it was retaliation. I don’t think any team should see him as a good head coach let alone trust him with their franchise.

  38. If NFL teams are truly doing their homework, they will have plenty of questions about Wilks one and done year in Arizona. It was not pretty.
