Marriott must respond Michael Irvin’s request for surveillance video by Tuesday

A Marriott employee has accused Hall of Fame receiver Michael Irvin of misconduct. The accusation got Irvin pulled from a pair of TV jobs during Super Bowl week.

Irvin has responded with a $100 million lawsuit, and an aggressive effort to get any surveillance video that Marriott has in its possession that would demonstrate what actually happened between Irvin and his accuser. The federal judge that is now presiding over the case has given Marriott a firm deadline for responding Irvin’s request for the video.

Via Michael Gehlken of the Dallas Morning News, Marriott has until 5:00 p.m. CT on Tuesday to respond. That doesn’t mean the video must be produced by then; it only means that Marriott must submit an actual response. A word-salad of objections (something lawyers paid handsomely by the hour pride themselves on whipping up) likely will be the front-line reply.

Marriott previously objected to the request when the case was pending in state court, firing off the predictable and common assertion of the attorney-client privilege and work-product doctrine as justification. If Marriott does it again, Irvin’s lawyers will file a motion to compel the production of the materials, and the judge will have to make a decision.

It’s hard to imagine how or why the judge would allow Marriott to hide relevant evidence that goes directly to the question of whether Irvin engaged in any type of wrongdoing.

It feels like Marriott has something to hide, because this is exactly what something with something to hide would do.

  1. If the video proves that the Marriott employee was in the right why wouldn’t they produce the video?

  2. The Marriott people should say they were drinking that night and forgot to turn the cameras on.

  3. The more I think about this the more I wonder why isn’t Irvin suing the people that took him off the air?

  4. Irving is no saint but if you’re gonna accuse someone of wrongdoing you better provide proof. No video no proof, period.

  5. Irving was skewered by about 80% of commenters on here. If Marriot is withholding evidence and hiding behind policies then why not point the finger at them? Irving was pulled from the air during the SB. His employers took this as a pretty big deal and it’s definitely hurt his image. If there’s accusations being made that are true, why not prove it?

  6. I hope he beats this charge/accusation. I’m certain Mike Irvin has made his share of mistakes but he seems mature enough to know but to do anything crazy in public.

  7. While I’m not a Michael Irvin fan, I hope he wins this LOUDLY and whomever targeted him is held very accountable. I’m assuming he’s innocent because that’s how it’s supposed to be, right?

  8. Of course the Marriott is hiding something. It seems they jumped the gun reporting the issue without reviewing the evidence!

    Not a big fan of Irvine as a person, too gobby for my liking, however to get him suspended on a word of an anonymous complaint made through the back door by a big sponsor is absolutely wrong, both by Marriott & NFL.
    USA is a laughing stock now around the world, not a bacon of democracy as they would have everyone believe 😏

  10. Not a matter of what he did but also matter of what he could have said to her as well. There could be video of him just talking to her and that could be enough.

  11. Why should Marriott have to turn over any information outside of the normal course of discovery? Irvin is making a demand for extraordinary relief. Marriott is perfectly within its rights to object to this abnormal request.

  12. Perhaps Marriott should file a request to require Irvin and his supposed eyewitnesses to sit for early depositions. Let’s see what Irvin has to say under oath about his drunken behavior and if he actually remembers anything he said. Let’s see if these witnesses state under oath if they actually heard what Irvin said or admit that they were merely observing the encounter from afar.

  15. Are you sure it’s not being held up because it’s evidence of a crime and law enforcement doesn’t want it released? I get it that Irvin hasn’t been charged but it’s still a possibility.

Only the guilty refuse to comply with a court order.if the employee is guilty of lying and the tape proves it and the corporation is still protecting them then that employee must be very high up on the executive chain because they would not protect the average worker like this if they were guilty of lying about the incident.

  18. He admits he was drunk and doesn’t really remember. So in the long run how can he expect to testify under oath if it comes to that? Seems to be some typical “Irv” bluster going on here…

  19. If Irvin had done what the accuser claims I’m sure TMZ would have already had the video, and we all would have seen it by now. A Coverup is on full display, and it’s not looking too good for Marriott at this point

  20. Even when Irvin was young and stupid(er) he didn’t do stuff like this, he was a druggie. He’s now a middle-aged man

    Huge corporations do not turn video over to TMZ or any other media outlet, especially when litigation is involved.

  24. I hate to say this but if the video and the witness testimony proves Irvin did nothing wrong, it’s going to cause all women to lose credibility. The stupid pendulum never can settle in the middle. It always swings wildly from one side to the other and that hurts society as a whole.

    Actually, this IS the normal course of discovery. Any lawyer who’s 5 seconds past his bar exam would be asking for this first, as a matter of course. It’s an absolute no-brainer. Further, it’s the kind of no-brainer request that Marriott should have been prepared for out of the gate. That Marriott is resisting this at all makes it blatantly obvious that it has something, or some things, to hide.

  26. It feels like Marriott backed the employee’s version of what happened without really looking into the matter. They didnt expect to get sued over their decision. I dont know what happened but its looking like theres not going to be much, if any meat on the bone to the accusations made by the employee and after looking into the matter Marriott realizes this.

  28. I want to see this tape too…in it’s entirety without the primary parties being blurred out of the video. There are 2 edges to a sword.
